THE SHI'UR OF THE FOUR CUPS (Yerushalmi Halachah 1 Daf 53b)

(a)

(Mishnah): If one was Motzi any of the following [he is liable] - enough [raw, i.e. undiluted] wine to mix [with water] to comprise a cup (these Shi'urim will be explained), Kedai Gemi'ah (a gulp; alternatively, Malei Lugmav, the amount that one can hold in his mouth when one cheek sticks out) of milk, enough honey to put on Kasis (a wound), enough oil to anoint a small limb, enough water to rub the Kilor (an ointment for the eye, to dissolve it);

The Shi'ur for all other liquids is a Revi'is. All waste water, the Shi'ur is a Revi'is.

R. Shimon says, the Shi'ur for all of these [liquids] is a Revi'is [for most people]. All the Shi'urim [taught here] are for one who saves them.

(Gemara) Question (R. Ze'ira, to R. Yoshiyah): What is the Shi'ur of cups [that the Mishnah refers to]?

א''ל נלמוד סתום מן המפורש. דתני ר' חייה ד' כוסות שאמרו ישנן רביעית יין באיטלקי.

Answer (R. Yoshiyah): We learn what is concealed from what is explicit. R. Chiyah taught that the four cups [of wine on Seder night], they have an Italki Revi'is of wine [in all].

Note: This teaches that each cup has a quarter Italki Revi'is of raw wine. This is the Shi'ur for Hotza'ah. Below, we will derive the size of the cups after they are mixed. Perhaps "of cups'' should be deleted from the question (PNEI MEIR). It seems that if so, it should say "Shi'uro'' (its Shi'ur).

תמן תנינן מפנין ארבע וחמש קופות. ר' זעירא שאל לרבי יאשיה כמה הוא שיעורה של קופה.

A Mishnah teaches that we may clear out four or five boxes [of straw or grain, to make room for guests]. R. Ze'ira asked R. Yoshiyah, what is the Shi'ur of a box?

Answer (R. Yoshiyah): We learn what is concealed from what is explicit. A Mishnah teaches that they use three boxes, each of three Sa'im, to take Shekalim from the chamber.

(R. Yosi bei R. Bun citing R. Yochanan): [Our Mishnah] is like R. Yehudah, for a Beraisa teaches that the Shi'ur of wine is Kedei Gemi'ah; R. Yehudah says, it is enough to mix a cup. (AHAVAS TZIYON VI'YRUSHALAYIM)

Question: What is the Shi'ur for mixed wine?

Answer: We learn from this [Beraisa]. The Shi'ur of wine is Kedei Gemi'ah; R. Yehudah says, it is enough to mix a cup. (It discusses mixed wine, since the first Tana says Kedei Gemi'ah.)

This teaches that for mixed wine, the Shi'ur is enough to mix a cup (i.e. a quarter Revi'is, like we learned above. Chachamim say Kedei Gemi'ah; presumably, we answer according to R. Yehudah, for our Mishnah is like him.)

Question: What is the size of the cups [after they are mixed]?

ר' אבין אמר טיטרטון ורביע.

Answer (R. Avin): It is Titarton and a quarter (a Log, i.e. for all four cups together. We explained this based on R. SHLOMO SIRILIYO, Shekalim 3:2.)

HALACHOS OF THE FOUR CUPS (Yerushalmi Halachah 1 Daf 54a)

מהו לשתותן בכרך א'

(a)

Question: May one drink them at once [without saying the Hagadah in between]?

מן מה דא''ר יוחנן בהלל אם שמעה בבה''כ יצא הדא אמרה אפי' שתיין בכרך א' יצא.

(b)

Answer: Since R. Yochanan said about Hallel, that if he heard it in the Beis ha'Keneses he was Yotzei, this teaches that even if he drank them all together, he was Yotzei. (Surely, if one needs to repeat Hallel in order to separate between the last two cups, R. Yochanan would have mentioned this.)

(c)

Question: May one interrupt [more than once while drinking each cup, which is normal]?

כלום אמרו שישתה לא שישתכר. אם הוא שותה אותן מפוסקין אף הוא אינו משתכר.

(d)

Answer: Did they not say that one may drink [between the first cups, but not between the last two,] for he should not become drunk. If one may drink with [additional] interruptions, even [if he drinks in between], he would not get drunk!

(e)

Question: May one be Yotzei with wine of Shemitah?

Answer (R. Hoshayah): One is Yotzei with wine of Shemitah.

Question: Is one Yotzei with Konditun wine (it has honey and pepper)?

Answer: Since Bar Kapara taught that Konditun is like wine, this shows that one is Yotzei with Konditun.

(i)

Question: May one be Yotzei with mixed wine [diluted more than normal]?

מן מה דתני רבי חייה ארבעה כוסות שאמרו יוצאין בהן בין חיין בין מזוגין והוא שיהא בהן טעם ומראה יין.

Answer: R. Chiyah taught that the four cups, one may be Yotzei with raw or mixed wine, as long as they have the taste and appearance of wine. (We explained this Sugya like R. SHLOMO SIRILIYO, Shekalim 3:2.)

(R. Yirmeyah): The Mitzvah is with red wine.

This is like R. Yochanan taught elsewhere (in Terumos 2:3, that cooking wine improves it).

R. Yonah drank four cups on Pesach night, and he supported his head (with a tied garment, due to the pain) until Shavu'os. R. Yudah bei R. Ila'i drank four cups on Pesach night, and supported his head until Sukos.

וחמתיה חדא מטרונה אפי' נהורין. א''ל סבא סבא חדא מן תלת מילין אית בך אישתיי חמר את. או מלוה בריבית את. או מגדל חזירין את.

A Nochris saw R. Yehudah's face beaming. She said "elder, elder - one of three things you do [causes your ecstasy] - you drink wine, lend with Ribis, or raise pigs!''

אמר לה תיפח רוחה דההיא איתתא חדא מן תלת מילייא לית בי אלא אולפני שכיח לי דכתיב [קהלת ח א] חכמת אדם תאיר פניו.

R. Yehudah: That lady (you) should die! I do not do any of them. Rather, I often have Chidushim in my learning - "Chachmas Adam Ta'ir Panav.''

Note: One who suspects someone Kosher is not Chayav Misah, just his body is stricken (Bavli 97a). Further, she did not suspect him of Aveiros! (Chachamim limited the Heterim to lend with Ribis to Nochrim or raise pigs to sell them to Nochrim, but he could not assume that she knew this.) Perhaps she deserved death for belittling one of the Gedolei ha'Dor (R. Meir Eliyahu Shlita).

רבי אבהו נחת לטבריא חמוניה תלמידוי דר' יוחנן אפוי נהירין אמרון קומי ר' יוחנן אשכח ר' אבהו סימה. אמר לון למה. אמרין ליה אפוי נהירין.

R. Avahu went to Tiverya. R. Yochanan's Talmidim saw that his face was beaming. They told R. Yochanan "R. Avahu found a treasure!'' He asked why; they said that his face is beaming.

אמר לון דילמא אוריתא חדתא שמעתה סליק לגביה א''ל מאי אוריתא חדתא שמעת

R. Yochanan: Perhaps he heard a new teaching! He went out to see him, and said "what new teaching did you hear?''

R. Avahu said that he had learned a Tosefta beforehand [and sought it, and was elated to find it. R. Yochanan] applied to him "Chachmas Adam Ta'ir Panav.''

THE SHI'UR OF A REVI'IS (Yerushalmi Halachah 1 Daf 54b)

א''ר חנינא לוגא דאורייתא תומנתא עתיקתא דמורייסא דציפרין.

(a)

(R. Chanina): The Log of the Torah (four Reviyos) is an eighth of the old measure used to measure fish innards in Tziporin.

א''ר יונה חכים אנא לה. דבית רבי ינאי הוון מכילין בה דבש.

(b)

1. R. Yonah: I know well that R. Yanai's house used to measure honey [with this measure].

תני חצי שמינית טברנית הישנה.

(c)

(Beraisa): [The Log is] half an eighth of the old measure of Tiverya.

(d)

(R. Yochanan): This refers to our measure.

ולמה לא אמר עתיקתא בגין דהוות ביומוי.

(e)

Question: Why didn't [R. Yochanan] say "old'' (like the Beraisa did)? Is it because it was in his days?! (This is not a proper reason!)

אית דאמרי דהוות זעירא ורבת

(f)

Answer #1: [The old measure was big, and before R. Yochanan] it was made small, and [in R. Yochanan's day] it became big [like initially. Therefore, the Tana calls it the old measure, and R. Yochanan calls it our measure.]

(וזערת ולא זערת) [נראה שצ''ל ואית דאמרי דאזעירא וזעירת, כגירסת ר''ש סיריליו בשקלים ג:ב] כמה דהוות.

(g)

Answer #2: [The old measure was small, and they increased it, and in R. Yochanan's day], it was decreased [to the initial size. We explained this like R. SHLOMO SIRILIYO.]

Question: How much is the Shi'ur of a Kos (how do we measure a Revi'is)?

ר' יוסה בשם רבי יודה בר פזי רבי יוסי בי רבי בון בשם שמואל אצבעיים על אצבעיים על רום אצבע ומחצה ושליש אצבע.

(i)

Answer #1 (R. Yosah citing R. Yudah bar Pazi and R. Yosi bei R. Bun citing Shmuel): It is two fingers by two fingers and a height of a finger and a half and third (i.e. one and five sixths).

(j)

(Beraisa): Dry (congealed) wine, the Shi'ur is a k'Zayis. R. Nasan says so.

(Rabanan of Kisarin citing R. Yosi bei R. Bun citing R. Yochanan): R. Nasan holds like R. Shimon. Just like R. Shimon says [in our Mishnah that the Shi'ur of all liquids is] a Revi'is, so R. Nasan says a Revi'is. When it congeals, it will be a k'Zayis.

R. Simon citing R. Yehoshua ben Levi: A case occurred in which a mule of Rebbi's house died, and they were Metaher its blood from the law of Neveilah.

ר' אלעזר שאל לרבי סימון עד כמה ולא אגיביה.

R. Elazar asked R. Simon up to how much [blood is Tahor]. He did not answer him.

[R. Elazar] asked R. Yehoshua ben Levi. He said that up to a Revi'is is Tahor (when it congeals, there is not a k'Zayis. The blood from the dead mule of Rebbi's house was less than a Revi'is); more than this is Tamei. R. Elazar was upset that R. Simon did not answer him.

רב ביבי הוה יתיב מתני הדין עובדא א''ל רבי יצחק בר כהנא עד רביעית טהור יותר מיכן טמא ובעיט ביה.

Rav Bivi was teaching this episode R. Yitzchak bar Kahana said to him "[is] up to a Revi'is Tahor, and more than this is Tamei?'', and [Rav Bivi] reproached him.

R Zerikan (to Rav Bivi): Because he asked you, you reproach him?!

אמר ליה הא דלא הוות דעתי עלי

Rav Bivi: My mind was not settled at the time;

כדמר רבי חנין [דברים כח סו] והיו חייך תלואים לך מנגד זה הלוקח חיטים לשנה ופחדת לילה ויומם זה הלוקח מן הסידקי ולא תאמין בחייך זה הלוקח מן הפלטר. ואנא סמיך לפלטירא.

This is like R. Chanin taught "v'Hayu Chayecha Telu'im Lecha mi'Neged'' refers to one who must buy wheat each year. (He worries lest he not have money to buy grain next year). "U'Fachadta Laylah v'Yomam'' is one who buys grain each week. "V'Lo Sa'amin b'Chayecha'' is one who buys bread each day from a baker. I (Rav Bivi) buy from a baker!

Question: What was the conclusion?

Answer: R. Yehoshua ben Beseira testified about Dam Neveilah, that it is Tahor.

מהו טהור. טהור מלהכשיר הא לטמאות מטמא.

Rebuttal: What does "it is Tahor'' mean? It is not Machshir (food is Mekabel Tum'ah only if one of the seven liquids was put on it. [Stam] Blood is one of the seven. R. Yehoshua ben Beseira teaches that Dam Neveilah is not included), but it is Metamei. (We explained this like PNEI MEIR.)

(q)

Question (Mishnah): Blood of a Sheretz is like its flesh. It is Metamei, but it is not Machshir. There is nothing else like it.

ואין לנו כיוצא בו כשיעור טומאתו. אבל דמו מטמא כבשרו.

Answer: Nothing else is like it regarding the Shi'ur of Tum'ah [of Dam Sheretz is k'Adashah, i.e. the volume of a lentil, like its flesh], but [a Revi'is of] blood [of a Neveilah] is Metamei like [a k'Zayis] of its flesh.

אמר רב יוסף מאן דמר טמא כר' יהודה. טהור כרבי יהושע בן בתירה.

(Rav Yosef): The one who says that it is Tamei (R. Yehoshua ben Levi) holds like R. Yehudah (in Eduyos 5:1, he taught that Beis Shamai are Metaher Dam Neveilah, and Beis Hillel are Metamei), and [the one who says] Tahor holds like [the simple understanding of] R. Yehoshua ben Beseira.

אמר ליה רב אבדומה נחותה ויאות רבי יהודה מוריינא דנשיא הוה.

(t)

Support (Rav Avdomah Nechusah): R. Yehudah gave the rulings for the Nasi's house. (It is reasonable that R. Yehoshua ben Levi explained that more than a Revi'is is Tamei; they were Metaher the mule's blood only because there was not a Revi'is.)

(Beraisa): The Shi'ur of blood is in order to paint one eye.

(R. Yosi bei R. Bun citing R. Yochanan): This was taught about a bat's blood (it is good for the eye).

(Mishnah): Milk (the Shi'ur is Kedai Gemi'ah).

הדא דאת אמר בחלב בהמה טהורה. אבל בחלב בהמה טמאה כדי לכחול עין אחת:

Limitation: This is only for milk of a Tahor animal. Milk of a Tamei animal, the Shi'ur is in order to paint one eye.

(Mishnah): Honey (the Shi'ur is enough to put on Kasis).

הדא דאת אמר בהין עתיקי. ברם בהן דידן כדי (לבשל) [צ''ל לתבל - פני מאיר] ביצה קלה:

Limitation: This refers to old [honey, from bees, which heals], but our honey (from dates), the Shi'ur is to season a light egg. (PNEI MEIR, from R. N. Hertz, in Sidur ha'Gra (Sha'ar Naftoli) p.368.)
