TOSFOS DH Matza Tachrich Shel Shetaros Mi Nicha Lei l'Loveh v'Chulei

(SUMMARY: Tosfos justifies the question.)

(a)

Question: Indeed, the borrower is happy, that when he will lend to someone else, they will return [the document] to him!

(b)

Answer: He does not want to lose now in order to have a Safek of profiting another time.

2)

TOSFOS DH Chamishah Asar Yom

(SUMMARY: Tosfos resolves this with the dimensions of Eretz Yisrael.)

(a)

Question: Eretz Yisrael is [a square] 400 Parsah by 400 Parsah, and a person walks 10 Parsah in a day, so it takes 40 days to walk the length, and Yerushalayim is only one day away from the Yarden, which is the [eastern] border of Eretz Yisrael, like it says in Beitzah (5a). There remain 39 days on the other side!

(b)

Answer: With vineyards and forests it is 400 Parsah, but the settled part is not so much.

1.

Note: It follows that everyone lived within 15 days of Yerushalayim, and most of Eretz Yisrael on the west side was only vineyards and forests. It says (Bereishis 49:13) that Zevulun will dwell on the sea shore, and we know that they sailed for business. It is astounding that they all lived at least 24 days journey from the shore! Ako is on the sea shore (Nedarim 30a-b); R. Meir rules that Ako is like Eretz Yisrael for Gitin (Gitin 1:2) Surely Yisraelim dwelled there! Some answer that people used to travel quicker; our Gemara connotes unlike this. In Gitin (57a), it says that Eretz Yisrael is called Eretz Tzvi, for it expands according to its inhabitants. She'elas Ya'avetz 1:127 brings from Chesed l'Avraham (Mayan 3, Nehar 3) that it shrunk to 100 Parsah by 100. Alternatively, 400 Parsah is with the lands of Kini, Kenizi and Kadmoni, which will be added in the future.

TOSFOS DH Lo Ba'inan Kuli Hai

(SUMMARY: Tosfos explains why three days suffice.)

(a)

Explanation: Three days suffice.

(b)

Question: Seven and a half days should be required, i.e. half of 15 days!

(c)

Answer: When caravans are not common, and they do not travel at night, also during the day, he does not travel the entire day, lest he not find a lodging place at night.

TOSFOS DH Even To'en

(SUMMARY: Tosfos cites the Yerushalmi.)

(a)

Citation (Yerushalmi): Just like a stone cannot be Nimchah, so we cannot pray [not to receive] much good (rain. It seems that Tosfos explains "Nimchah" to mean dissolved. However, Kos ha'Yeshu'os explains Tosfos like Rashi, that it means covered. I.e. I will not pray for the rain to cease until Even To'en, which was the highest, is covered. The (standard) Ritva brings both Perushim.)

5)

TOSFOS DH Sam Demeihem

(SUMMARY: Tosfos explained this below.)

(a)

Reference: Below (32a DH Beis Din), regarding the investment of Rav Safra, I will explain b'Ezras Hash-m.

6)

TOSFOS DH Ad Kan Lo Pligi Ela b'Nishtamesh Bahen

(SUMMARY: Tosfos explains that this really means that he may use them.)

(a)

Observation: This is not precise, for if he used [the coins], also according to R. Akiva he is liable [for any loss]!

1.

Since he holds that he may not use them, he is Shole'ach Yad in a deposit, and even if he returned them, this has no effect, for R. Akiva holds that below (43b) that we require the owner's knowledge!

2.

Rather, surely "he used it" is not precise, like I explained. Rather, he means in the wage for usage, that it is permitted to use it. According to R. Tarfon, who holds that he may use it, he has Acharayus (liability), for through the Hana'ah that if a sale presents itself, he will take [the coins] and buy with them, he is a Shomer Sachar for them;

3.

According to R. Akiva, who forbids using them, he is exempt. However, if [all agreed that] he may not use them, he would be exempt according to everyone, like Rabah.
