THE SOURCE THAT THE KORBAN IS FOR TUM'AS HA'GUF (Yerushalmi Halachah 2 Daf 4a)

אין לי אלא טומאת הקדש טומאת מקדש מניין

Question: This teaches only Tum'as ha'Kodesh. What is the source for Tum'as Mikdash?

ת"ל [שם כב ג] וטומאתו עליו.

Answer: It says [here] "v'Tum'aso Alav" [and it says about Tum'as Mikdash "Od Tum'aso Vo." We learn from a Gezeirah Shavah "Tum'aso-Tum'aso".]

מה חמית מימר בטמא שאכל טהור או בטהור שאכל טמא

Question: Why do you say that it refers to a Tamei who ate Tahor [Kodshim]? Perhaps it is a Tahor who ate Tamei Kodshim!

ת"ל וטומאתו עליו בטומאת הגוף ולא בטומאת בשר.

Answer #1: It says "v'Tum'aso Alav" - Tum'as ha'Guf, and not Tum'ah of the meat.

רבי אומר ואכל וטומאתו עליו בטומאת הגוף ולא בטומאת בשר.

Answer #2 (Rebbi): "V'Achal v'Tum'aso Alav" refers to Tum'as ha'Guf, and not Tum'as Basar.

Answer #3 (R. Chiya): Kodshim are said in the plural, and Tum'ah in the singular ("El ha'Kodoshim... v'Tum'aso Alav" - SHIREI KORBAN). We must say that Tum'aso refers to Tum'as ha'Guf, and not Tum'as Basar.

Answer #4 (R. Meir): It discusses only one whose Tum'ah separates from him [through Tevilah]. This excludes meat, for its Tum'ah does not leave it.

ATONEMENTS THAT COME THROUGH YOM KIPUR

א"כ מה הועיל לו יום הכיפורים

Question: [If Yom Kipur did not atone for his Chiyuv Chatas and Asham,] how did Yom Kipur help for him?

א"ר יוסי בי ר' בון נעשית לו י"ה כאשם תלוי מת לפני יום הכיפורים עונה בה אחר יום הכיפורים כבר כיפר.

Answer (R. Yosi bei R. Bun): Yom Kipur became for him like Asham Taluy. If he died after Yom Kipur (before bringing his Korban), he already atoned.

[שם טז טז] וכפר על הקודש מטומאות בני ישראל וגו' יש לי בעניין זה שלש טמאות טומאת ע"ז שנאמר [שם כ ג] למען טמא את מקדשי גילוי עריות שנאמר [שם יח ל] לבלתי עשות מחוקות התועבות שפיכות דמים שנאמר [במדבר לה לד] ולא תטמאו את הארץ.

Suggestion: "V'Chiper Al ha'Kodesh mi'Tum'os Bnei Yisrael" - there are three other [Aveiros called] Tum'os that I could include. Idolatry is called Tum'ah - "Lema'an Tamei Es Mikdashi." It says about Arayos "l'Vilti Asos mi'Chukos ha'To'evos... [v'Lo Sitam'u]". It says about murder "v'Lo Setama Es ha'Aretz";

Perhaps this goat [offered in the Kodesh ha'Kodoshim on Yom Kipur] atones for all of these Tum'os!

(d)

Rejection: [It atones] "mi'Tum'os", but not all Tum'os.

מה מצינו שחלק הכתוב בטומאת מקדש וקדשיו אף כאן לא נחלוק אלא בטומאת מקדש וקדשיו דברי רבי יהודה

We find that the Torah distinguished in Tum'as Mikdash and Kodoshav (to be lenient - one brings Oleh v'Yored, and not Chatas Kavu'a). Also here, we will distinguish [to be lenient that one gets Kaparah through a Korban Tzibur, and need not pay for his own Korban - KORBAN HA'EDAH] only for Tum'as Mikdash v'Kodoshav. R. Yehudah says so;

ר"ש אומר [דף ד עמוד ב] ממקומו הוא מוכרע שנאמר וכפר על הקודש מטומאות בני ישראל כל טומאה שבקודש.

(f)

R. Shimon says, it is proven from its place! It says "v'Chiper Al ha'Kodesh mi'Tum'os Bnei Yisrael" - this implies that all Tum'ah in the Kodesh.

יכול על [צ"ל כל - פני משה] טומאת מקדש וקדשיו שעיר זה יכפר

(g)

Suggestion: Perhaps this goat atones for all Tum'as Mikdash v'Kodoshav (even if here was Yedi'ah at the beginning and at the end)!

(h)

Rejection: "Umi'Pish'eihem" are sins of rebellion (for which one does not bring a Korban. It does not atone for Chayavei Korban, e.g. Shogeg in which there was Yedi'ah at the beginning and at the end);

וכן הוא אומר [מלכים ב ג ז] מלך מואב פשע בי:
