ROSH HASHANAH 25 (4 Sivan) - Dedicated by Rabbi Kornfeld's father, Mr. David Kornfeld, in memory of the members of his family who perished at the hands of the Nazi murderers in the Holocaust, Hashem Yikom Damam: His mother (Mirel bas Yakov Mordechai), brothers (Shraga Feivel, Aryeh Leib and Yisachar Dov sons of Mordechai), grandfather (Reb Yakov Mordechai ben Reb David Shpira) and aunt (Charne bas Yakov Mordechai, the wife of Reb Moshe Aryeh Cohen zt'l). Their Yahrzeit is observed on 4 Sivan.

THE PICTURES OF RABBAN GAMLIEL (Yerushalmi Halachah 6 Daf 13b)

משנה דמות צורות לבנה היו לו לרבן גמליאל בעלייתו בטבלה ובכותל שבהן מראה את ההדיוטות ואומר כזה ראית או כזה ראית

(a)

(Mishnah): Rabban Gamliel had pictures of the moon in his attic, on a board and on the wall. He used them to show the unlearned and ask them - did you see the moon like this or this?

מעשה שבאו שנים ואמרו ראינוהו שחרית במזרח וערבית במערב

(b)

There were once two witnesses who came and said that they saw the moon in east in the morning and in the west in the evening.

אמר רבי יוחנן עידי שקר הן וכשבאו ליבנה קיבלן ר''ג

(c)

R. Yochanan (ben Nuri) said that they were false witnesses, but when they came to Yavneh, Rabban Gamliel accepted them.

ועוד באו שנים ואמרו ראינו בזמנו ובלילה בעיבורו לא נראה [דף יד עמוד א] וקיבלן רבן גמליאל.

(d)

Another two witnesses came and said that they saw the moon on the 30th night but they did not see it the following night; Rabban Gamliel accepted them.

אמר רבי דוסה בן ארכינס עידי שקר הן האיך מעידין על האשה שילדה והרי כריסה בן שיניה

R. Dosa ben Arkinas (Hurkenus): They are false witnesses - how could they testify about a woman who gave birth if she is still visibly carrying a child?!

R. Yehoshua to R. Dosa: I agree with you (that it should be a 30 day month).

(Gemara - R. Simlai): The reasoning of R. Yochanan B''N is that in any month the new moon is not visible within its first 6 hours, nor can the eye see the old moon within the last six hours before the new moon.

ותני כן נראה ישן בשחרית לא נראה חדש בין הערבים נראה חדש בין הערבים לא נראה ישן בשחרית

Support (Beraisa): If the old moon appeared in the morning, the new moon will not appear in the afternoon. If the new moon appears in the afternoon, the old moon does not appear in the morning.

R. Chiya bar Abba: Why did Rabban Gamliel accept them? He had a tradition that sometimes the moon moves in a short path and sometimes it moves in a long path.

RABBAN GAMLIEL SUMMONS R. YEHOSHUA (Yerushalmi Halachah 7 Daf 14a)

משנה שלח לו ר''ג גוזר אני עליך שתבא אצלי במקלך ובמעותיך ביום שחל יה''כ להיות בחשבונך הלך ומצאו ר''ע מיצר

(a)

(Mishnah): Rabban Gamliel sent a message to him - I decree upon you that you should come to me with your cane and your money on the day that you calculated to be Yom Kippur. R. Akiva went and found him distraught.

[דף יז עמוד א (עוז והדר)] אמר לו ויש לי ללמד שכל מה שעשה ר''ג עשוי שנאמר (ויקרא כג) אלה מועדי ה' מקראי קדש אשר תקראו אותם בין בזמנן בין שלא בזמנן אין לי מועדות אלא אלו

R. Akiva: I can expound that whatever Rabban Gamliel rules becomes established (as law), as the Pasuk states (Vayikra 23, 4,) "These are the festivals of Hash-m, holy convocations that you shall declare'' - whether [you establish them] at their time or not at their time, I only have these festivals.

(b)

(Gemara - question): To whom did Rabban Gamliel send the message (to R. Yehoshua or to R. Yochanan ben Nuri)?

מן מה דתני א''ר יהושע נוח היה לי מוטל על המטה ולא שלח ר''ג הדבר הזה הדא אמרה אצל ר' יהושע שילח.

Answer (Beraisa): R. Yehoshua said - 'It would have been better for me to die rather than have had Rabban Gamliel send me this message'. This shows that he sent the message to R. Yehoshua.

ביד מי שילח.

(c)

Question: With whom did R''G send the message?

מן מה דתני כלשון זה אמר לו ניחמתני עקיבה הדא אמרה ביד ר''ע שילח

Answer (Beraisa): He said to him - 'You have comforted me Akiva'. This shows that it was R. Akiva who brought the message.

מה היה לו ללמד.

(d)

Question: What was it that R. Akiva taught (R. Yehoshua that he did not already know)?

א''ר יוסה יודעין היינו שאם קידשוהו שלא בעדים שהוא מקודש ומה בא להעיד שאם קדשוהו ואחר כך נמצאו העדים זוממין הרי זה מקודש

(e)

Answer (R. Yosa): We know that if Beis Din would sanctify without witnesses, it would be valid. However, if witnesses gave testimony and were later found to be false, one would think that the sanctification is invalid; nevertheless, the sanctification is valid.

והא תנינן מעשה שעברו יותר מארבעים זוג ועיכבן ר''ע בלוד.

(f)

Question (Mishnah): It once happened that more than 40 pairs of witnesses passed through (on their way to Yerushalayim) and R. Akiva stopped them in Lod. (He assumed that amongst 40 pairs of witnesses, there was at least one who was not testifying accurately, thereby possibly confusing the Beis Din. Why was this a concern if the sanctification is valid even when the Beis Din are mistaken?) (Note: This entry and the next one follow the understanding of the Pnei Moshe.)

על ידי שהיו ארבעים זוג אבל אם היה זוג אחד לא היה מעכבו

(g)

Answer: That was not the reason. Rather, he prevented them because there were so many witnesses coming unnecessarily one after another. (If they would have all come at the same time, he would not have prevented them.)

R. YEHOSHUA COMES TO R. DOSA (Yerushalmi Halachah 8 Daf 14a)

משנה בא לו אצל ר' דוסא בן ארכינס אמר לו אם באים אנו לדון אחר בית דינו של ר''ג צריכין אנו לדון אחר כל ב''ד וב''ד שעמד מימות משה ועד עכשיו שנאמר (שמות כד) ויעל משה ואהרן נדב ואביהוא ושבעים מזקני ישראל

(a)

(Mishnah): R. Yehoshua came to R. Dosa ben Arkinus and said to him - if we are questioning the ruling of Rabban Gamliel's Beis Din, we must question every Beis Din since the time of Moshe, as the Pasuk states (Shemos 24, 9), "Moshe, Aharon and the seventy elders went up.''

ולמה לא נתפרשו שמותן של זקנים אלא ללמדך שכל שלשה ושלשה שעמדו ב''ד על ישראל הרי הן כבית דינו של משה

(b)

Question: Why were we not told the names so of the elders? To teach us that each and every set of three [Dayanim] who have stood as a Beis Din over Yisrael are considered like the Beis Din of Moshe.

R. Yehoshua took his cane and money and went to Yavneh to Rabban Gamliel on the day that was Yom Kippur according to his own calculation.

עמד ר''ג ונשקו על ראשו ואמר לו בוא בשלום רבי ותלמידי רב בחכמה ותלמידי שקיבלת עליך את דבריי

Rabban Gamliel stood up and kissed R. Yehoshua on his head and said to him, "Come in peace my teacher and my student. You are my teacher in wisdom and my student in your acceptance of my words.''

גמרא כתיב (שמואל א יב) ה' אשר עשה את משה ואת אהרן ואשר העלה וגו' (שם) וישלח ה' את ירבעל ואת בדן ואת יפתח ואת שמואל. ירבעל גדעון בדן שמשון יפתח זה יפתח הגלעדי

(Gemara): The Pasuk states (Shmuel 1, 12, 6), "It is Hash-m who made Moshe and Aharon and who brought up [your forefathers from the land of Egypt].'' And the Pasuk states (Shmuel 1 ,12, 11), "And Hash-m sent Yerubavel, Badan, Yiftach and Shmuel.'' Yerubavel is Gidon; Badan is Shimshon (a descendant of Dan); Yiftach is Yiftach of Gilad.

הקיש שלשה קלי עולם לשלשה אבירי עולם ללמדך שבית דינו של גדעון ושל יפתח ושל שמשון שקולין כנגד משה ואהרן ושמואל ולא עוד שסמך הגדולים מיכן ומיכן והקטנים באמצע:

The Pasuk compares these three later lesser Sages with the three great early Sages (Moshe, Aharon and Shmuel) to teach that the Beis Din of Gidon, Yiftach and Shimshon was equal to that of Moshe, Aharon and Shmuel. Furthermore, the Pasuk wrote their names before Shmuel, even though he was greater.

עמד ר''ג ונשקו על ראשו ואמר לו בוא בשלום רבי ותלמידי רבי בחכמה ותלמידי שכל מה שאני גוזר עליו הוא מקיים כתיב (תהילים קמד) אלופינו מסבלים וגו'.

The Mishnah had taught: Rabban Gamliel stood up etc. (see (d) above). The Pasuk states (Tehilim 144, 14) "Our oxen are laden etc.''...

ר' יוחנן ורשב''ל ר' יוחנן אמר אלפים מסבלים אין כתיב כאן אלא אלופינו מסבלים בשעה שהגדולים סובלין את הקטנים (שם) אין פרץ ואין יוצאת ואין צוחה ברחבתינו

R. Yochanan and R. Shimon ben Lakish disagreed - R''Y said - the Pasuk does not say "Alafim Mesubalim'' - "the oxen are laden''; rather it says "Alufeinu Mesubalim'' - meaning that our great ones accept (the words of) the lesser ones...(ibid), "there is no breach nor outburst, and no crying in our streets.

רבן שמעון בן לקיש מסרס הדין קרייא אלופים מסובלים אין כתיב כאן אלא אלופינו מסובלים בשעה שהקטנים סובלין את הגדולים אין פרץ ואין יוצאת ואין צוחה ברחבתינו.

R''SBL rearranged the order of this Pasuk - it does not say "Alufim Mesubalim''; rather, it says Alufeinu Mesubalim - meaning that at a time when the lesser ones accept (the words of) the great ones...(ibid), "there is no breach nor outburst, and no crying in our streets.

ר' שילה דכפר תמרתה בשם ר' (תהילים קז) עשה ירח למועדים שמש ידע מבואו [דף יד עמוד ב] [דף יז עמוד ב (עוז והדר)] משמש ידע מבואו עשה ירח למועדים.

(h)

R. Shila of Kfar Tamrata quoting Rebbi: The Pasuk states (Tehillim 104, 19), "He made the moon for the festivals, the sun knows its coming'' - after the sun comes in (sets), the moon is for the festivals. (This means that even if the new moon is visible on the 29th day of the month, we count it retroactively from the previous sunset - so it is a partnership between the moon and the sun.)

אמר ר' ברכיה כתיב (במדבר לג) ויסעו מרעמסס בחדש הראשון וגו'. כד יטמע בלילי מועדא ארבע עשר מטמיעין אית בה הוי משקיעת החמה את מונה ללבנה.

(i)

Proof (R. Berachiya): The Pasuk states (Bamidbar 33, 3), "They travelled from Ra'amses in the first month [on the 15th of the first month on the day after the Pesach offering] etc.'' If you would not include the first sunset, it would have only been the 14th day of the month. This proves that we count retroactively from the previous sunset.

א''ר סימון והיו על ידי זה וע''י זה. א''ר יוחנן (בראשית א) ויהי ערב ויהי בקר יום אחד.

(j)

R. Simon: "And they will be'' - we count through this (the sun) and through this (moon). R. Yochanan said - the Pasuk states (Bereishis 1, 5), "And it was evening and it was morning, one day.''

(k)

R''SBL: The Pasuk states, "the month'' - all of the day must be from the new month - this shows that we count retroactively from the night before.

אשכחת אמר מה דאר''י צריכה לרשב''ל ומה דאמר רשב''ל צריכה לר' יוחנן

(l)

Ultimately, we need the Pesukim of both R. Yochanan and R''SBL.

אילו א''ר יוחנן ולא אמר רשב''ל הוינן אמרין לא אמר אלא אפילו כולו מן החדש. הוי צורכה להיא דאמר רשב''ל.

If only R. Yochanan would have cited his Pasuk, we would say that even all of it is in the new month; therefore, R''SBL needed to cite his Pasuk.

או אילו ארשב''ל ולא א''ר יוחנן הוינן אמרין לא אמר אלא יום הא לילה לא. הוי צורכה להיא דאמר ר' יוחנן וצורכה להיא דאמר רשב''ל

On the other hand, if only R''SBL would have cited his Pasuk, we would say that it is only in the day but not the night; therefore, R. Yochanan needed to say his Pasuk.
