NEDARIM 81 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה גוף כולו לית בה צער

(a)

Gemara: In the entire body, is there not pain?!

רחיצה דהויא בכוליה גופא מי (הגהות ישנות) לית בה צער

Explanation: Bathing, which is in (affects) the entire body, is there not pain?!

אלא (הגהות ישנות) ודאי רחיצה לר' יוסי הויא ניוול.

Rather, surely according to R. Yosi, there is repulsion in [not] bathing.

Gemara: Laundering is stronger according to R. Yosi.

Explanation: When he does not comb his head constantly, and amidst this, there is filth in his head.

Gemara: Leads to blindness.

Explanation: It causes his eyes to be blinded. The filth of his head weakens the sight of his eyes.

Gemara: [Filth] of his clothes leads to derangement.

Explanation: When there is filth of grime of his clothes, that they are not laundered constantly, and he wears them when they are filthy, leads to confusion and bewilderment.

Gemara: Filth of the body.

כשגופו מזוהם שאינו רוחץ תמיד מביאו לידי שיחנא וכיבי אבעבועות המכאיבות ולאלו יש רפואות אבל שעמום קשה מהן

Explanation: When his body is filthy, that he does not bathe constantly, it brings to painful boils and blisters; there is a cure for these. Derangement is harsher than them.

אלמא כביסה אלימא מרחיצה.

Inference: [The need for] laundering is greater than [that for] bathing.

Gemara: Beware of filth.

כלומר הזהרו בתכבוסת וברחיצה.

Explanation: The beginning of their engagement each day - '[Baruch Atah Hash-m... Asher Kideshanu b'Mitzvosav v'Tzivanu] La'asok b'Divrei Torah, v'Ha'arev Na and 'Asher Bachar.'

Explanation: "Va'Yomer Hash-m Al Azvam Es Torasi" implies that no one knew to give a reason, except for Hash-m.

ומצאתי במגילת סתרים של ה"ר יונה ז"ל דקרא הכי דייק דעל שלא ברכו בתורה תחילה אבדה הארץ

I found in a hidden scroll of R. Yonah that we infer from the verse as follows. Since they did not bless on Torah beforehand, the land was lost;

דאם איתא על עזבם את תורתי כפשטא משמע שעזבו את התורה ולא היו עוסקין בה כשנשאל לחכמים ולנביאים למה לא פרשוהו והלא דבר גלוי היה וקל לפרש

i.

If it were because they abandoned Torah, like the simple reading of the verse, this implies that they abandoned Torah and did not engage in it, when they asked Chachamim and Nevi'im, why didn't they explain it? It was exposed, and easy to explain!

אלא ודאי עוסקין היו בתורה תמיד ולפיכך היו חכמים ונביאים תמהים על מה אבדה הארץ עד שפרשו הקב"ה בעצמו

Rather, surely they engaged in Torah constantly. Therefore, Chachamim and Nevi'im were astounded why the land was lost, until Hash-m Himself explained it;

שהוא יודע מעמקי הלב שלא היו מברכין בתורה תחלה כלומר שלא היתה התורה חשובה בעיניהם כ"כ שיהא ראוי לברך עליה

i.

He knows the depths of the heart, that they did not bless on Torah beforehand, i.e. the Torah was not so important in their eyes that it is worthy to bless on it;

שלא היו עוסקים בה לשמה ומתוך כך היו מזלזלין בברכתה והיינו לא הלכו בה כלומר בכונתה ולשמה

ii.

They were not engaging in it Lishmah, and amidst this they belittled its Berachah. This is "they did not go in it", i.e. with its intent and Lishmah.

אלו דברי הרב החסיד ז"ל והם נאים וראויין למי שאמרם.

These are the Chasid's (R. Yonah's) words, and they are nice and appropriate for the one who said them.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה טעמא דאבוך לא ידענא

(a)

Gemara: I do not know your father's reason.

דאמר כביסתן קודמת לחיי אחרים והא מסברא ליתא ולהכי בעי קרא מנלן.

Explanation: That he said that their laundering has precedence over others' lives. Based on reasoning, this is not so! This is why he asked, where does a verse teach this?

RAN DH Ela Lav Kevisah [TRANSLATION: Rather, it is laundering.]

(SUMMARY: The Ran rules like Rabanan, but also mentions that the Rambam does not.)

וקרי ליה חייתם,

Explanation: And this (laundering) is called Chayasam (their needs of living).

ולענין הלכה קי"ל כרבנן דרחיצה וקישוט נדרי עינוי נפש הם ומפר בין לעצמו בין לאחרים

Opinion #1 - Ruling: We hold like Rabanan, that bathing and adorning are Nidrei Inuy Nefesh, and [a husband] can annul both for himself and for others.

Source #1: When an individual argues with a Rabim, the Halachah follows the Rabim.

Explanation: [Does R. Yosi say that he can annul due to matters between him and her regarding vows] about bathing and anointing, about which he argues with Rabanan?

מי אמר דדוקא משום עינוי נפש הוא דפליג עלייהו דלא מפר אבל משום דברים שבינו לבינה מודה ר' יוסי דמפר

Did he say that he argues with them only to say that due to Inuy Nefesh he cannot annul, but due to matters between him and her, R. Yosi agrees that he can annul?

ונ"מ דלרבנן דאמרי עינוי נפש הוי מפר בין לעצמו בין לאחרים ולר' יוסי דוקא לעצמו מפר אבל (גירסת כתב יד) לאחרים אינו מפר

[If he agrees that he can annul, and he argues only about the reason,] it affects the following law. According to Rabanan, who say that it is Inuy Nefesh, he annuls both for himself and for others, and according to R. Yosi [who says that it is matters between him and her], he annuls only for himself, but not for others;

This is the difference between Inuy Nefesh and matters between him and her, like it says at the beginning of our Perek.

Gemara: Come and learn. R. Yosi says, these are not Nidrei Inuy Nefesh.

ואם איתא דלר' יוסי אפי' משום דברים שבינו לבינה אינו מפר ה"ל למימר לא יפר

Explanation: If it is true that according to R. Yosi, he cannot annul even due to matters between him and her, he should have said "he cannot annul';

מדקאמר אין אלו נדרי עינוי נפש משמע אבל דברים שבינו לבינה הויין.

Inference: Since he said 'these are not Nidrei Inuy Nefesh', this implies 'but they are matters between him and her.'

Gemara: Rav Ada bar Ahavah said, he can annul.

Explanation: The husband is adamant about this.

Explanation: In the earth [of the cavity] that it dug, in which it lives constantly. Because it is used to it, it does not stumble in the earth of that pit.

כך זה מתוך שהוא רגיל אינו חושש שמא תקשר לו נימא אם לא תרחץ.

So this [husband], because he is regularly [intimate with his wife], he is not concerned lest a hair get tied for him (which can castrate a man - Sanhedrin 21a) if she does not bathe.

ר"ן ד"ה תניא כוותיה דרב אדא בר אהבה וכו'

(d)

Gemara: A Beraisa supports Rav Ada bar Ahavah.

מפר בין בינו לבינה כגון דאמרה קונם פירות בעלה עליה ובין בינה לבין אחרים שאסרה פירות אחרים עליה.

Explanation: He can annul both [matters] between him and her, e.g. she said that Peros of her husband are Konam to her, and also [matters] between her and others, e.g. she forbade others' Peros to herself.

Gemara: Konam that I will do according to father's mouth (request)...

מפרש ואזיל דברים שאין בהם עינוי נפש ובינה לבין אחרים

Explanation: The Gemara explains matters that do not have Inuy Nefesh and are between her and others.

ומפרש לה מקמי בינו לבינה

Implied question: Why does it explain this before matters between him and her?

משום דבבינו לבינה איכא פלוגתא דזימנין מפר וזמנין אין צריך להפר.

3.

Answer: It is because in matters between him and her, there is a distinction - sometimes he [can] annul, and sometimes he need not annul.

RAN DH she'Lo Eten Teven... [TRANSLATION: 'I will not put straw in front of your animal or in front of your cattle', he cannot annul.]

(SUMMARY: The Ran explains that this is when she brought in four Shifchos.)

Explanation: This is because she has no Shibud to him [for this].

Implied question: In Kesuvos (61b), we conclude that he forces her to give straw in front of his animal!

Answer: Here we discuss when she brought to him four Shifchos. We hold that [then] she sits in an easy chair and she need not do these matters for him;

Even so, if she vowed 'I will not set your bed for you [or mix your drink or wash your face, hands and feet]', he need not annul;

This is because we hold that even if she brought to him many Shifchos, she is obligated, for these matters lead to affection.

Gemara: R. Gamliel says, he annuls.

אף על גב דלא חייל נדרה אפ"ה צריך להפר מדרבנן שלא תקל בנדרים ותעבור על בל יחל והא אסמכתא בעלמא הוא.

Explanation: Even though her vow did not take effect, he needs to annul mid'Rabanan, lest she be lenient about vows and transgress Bal Yachel. The verse is a mere Asmachta (even without Hafarah, she does not transgress for this vow).

RAN DH Devar Acher Lo Yachel Devaro... [TRANSLATION: Another matter - he will not profane his word.]

ר"ן ד"ה דבר אחר לא יחל דברו מכאן לחכם שאין מתיר נדרי עצמו

(SUMMARY: The Ran explains how he derives both laws from the same verse.)

וכדדרשינן הוא אינו מוחל אבל אחרים מוחלין לו

Explanation: This is like we expound "he cannot profane, but others can profane for him."

וקשה בעיני מאי ד"א דהא ר"ג דאמר יפר משום לתא דבל יחל קאמר ולא מדרשא דקרא ומאי דבר אחר

Question: Why does it say "another matter"? R. Gamliel says "he can annul", due to [concern for] Bal Yachel, and not due to a Drashah of the verse ["Devaro"]! Why does it say "another matter" [which implies that we expound both of these from the verse]?

ונראה בעיני דר"ג דאמר יפר דברו קדריש דאפי' מידי דלא מיקרי נדר אלא דבר בעלמא אמר קרא דלא יחל

Answer: R. Gamliel, who says that he annuls, expounds "Devaro". Even something that is not called a vow, rather, a mere Davar (word, e.g. her vow not to set his bed), the verse says that one may not profane it;

דנהי דלא לקי עליה אפ"ה כיון דאפשר בהפרה בלא הפרה לא יחל

Granted, one is not lashed for it. Even so, since it is possible through Hafarah, one may not profane it without Hafarah.

והיינו דקאמר דבר אחר דההוא דברו גופיה דדריש ר"ג להכי למידי אחרינא מדריש דחכם אינו מתיר נדרי עצמו ומדברו הוא דמשמע לן הכי.

This is why he said "another matter." That word "Devaro" itself, R. Gamliel expounds for something else, that a Chacham cannot annul his own vow. We infer this from "Devaro" (his own word).

Gemara: Whom did we hear, that he says that 'I will not color my eyes or Efkos' is matters between him and her? It is R. Yosi.

Inference (R. Yehudah ha'Kohen): If one conducted not to eat meat and drink wine at a particular time, and later he wants to drink wine or eat meat at that time, he needs a Heter.

מתני' בנגעים (פ"ב מ"ה) כל הנגעים אדם רואה חוץ מנגעי עצמו ר' יהודה אומר אף לא נגעי קרוביו

Citation (Nega'im 2:5 - Mishnah): One (a Kohen) may see (rule about) any Tzara'as, except for his own. R. Yehudah says, he may not see even his relatives' Nega'im;

Citation: 'Konam, benefit from me is forbidden to people of my city' - he cannot ask a Chacham there to permit it (for it affects the Chacham; via the Heter, he may benefit from the Noder);

Citation: 'Benefit from people of my city is forbidden to me', he can ask a Chacham there to permit it.

Explanation: If it is true that [abstention from] Bi'ah is Inuy Nefesh, his Hafarah should help both for himself and for others!

Gemara: According to Rabanan, you can ask (we cannot determine their opinion).

משום דנטולה אני מן היהודים ר' יוסי קתני לה ולדידיה ודאי לא הוי ענוי נפש וכדתניא בברייתא דלעיל.
