NEDARIM 80 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ואלא דאמרה הנאת רחיצה עלי לעולם אם ארחץ

(a)

Gemara: Rather, she said 'the pleasure of bathing is forbidden to me if I bathe.'

וכיון דקאמרה הכי רחיצה ראשונה שריא לה אבל מההיא רחיצה ואילך מתסרא ברחיצה לעולם.

Explanation: Since she said so, the first bathing is permitted to her, but from that bathing and onwards, she is forever forbidden to bathe.

ר"ן ד"ה לא תרחץ אית לה ניוול

(b)

Gemara: If she will not bathe, she will become repulsive!

דס"ל השתא דברחיצה איכא ענוי נפש

Explanation: We are now thinking that in [not] bathing, there is affliction.

וכי תימא אי הכי אמאי נקט תנא דתליא נדרה באם ליתני קונם רחיצה עלי

Question: If so, why did the Tana discuss when she made her vow [dependent on] 'if...'? He should teach 'Konam, bathing is forbidden to me'!

איכא למימר דרבותא אשמעינן לתנא קמא דאע"ג דרחיצה קמייתא שריא לה אפילו הכי יפר מהשתא.

Answer: He teaches a Chidush in the first Tana. Even though the first bathing is permitted, even so he can annul from now.

RAN DH v'R. Yosi Savar... [TRANSLATION: R. Yosi holds that it is possible not to bathe. We are not concerned for becoming repulsive.]

ר"ן ד"ה ורבי יוסי סבר אפשר דלא רחצה ולניוול לא חיישינן

(SUMMARY: The Ran explains that our Sugya is like Rabanan who argue with R. Noson.)

דס"ל לרבי יוסי דברחיצה לעולם ליכא עינוי נפש

Explanation: R. Yosi holds that there is never Inuy Nefesh in [not] bathing.

והקשה הרב ר' יונה דמשמע ודאי דסוגיין אתיא דלא כרבי נתן דס"ל דאין הבעל מפר אלא א"כ חל הנדר

Question (R. Yonah): It connotes that surely, our Sugya is unlike R. Noson, who holds that the husband cannot annul unless the vow took effect;

אלא כרבנן דפליגי בשילהי פירקין בנטולה אני מן היהודים אם משמשתו דרבי נתן אמר לא יפר וחכ"א יפר

Rather, it is like Rabanan, who argue below (89b) about 'I am forbidden [to have Bi'ah with] any Yisrael if I have Bi'ah with him (my husband).' R. Noson says that he cannot annul. Chachamim say, he can annul;

דאי כר' נתן התם נמי נימא היכי תעביד תשמש מתסרא הנאת תשמיש עלה לא תשמש הוו להו דברים שבינו לבינה כדאמרינן הכא

If it were like R. Noson, also there he should say 'how will she do? If she will have relations, Hana'ah of Bi'ah is forbidden to her! If she will not have relations, this is matters between him and her', like we say here!

אלא ודאי סוגיין דהכא דלא כר' נתן

Rather, surely our Sugya here is unlike R. Noson.

וכיון שכן מאי קמקשה בריש סוגיין למה לה הפרה לא תרחוץ ולא ליתסרו פירות עולם עלה

Summation of question: If so, what was the question at the beginning of our Sugya "why is there Hafarah for her? She should not bathe, and not be forbidden all Peros!"?

דהא לרבנן מפר אע"פ שלא חל הנדר

Behold, Rabanan hold that he can annul even though the vow did not yet take effect!

וי"ל דאין הכי נמי דתנא דמתניתין כרבנן ס"ל אלא מיהו כי אמרי רבנן דמפר אע"פ שלא חל הנדר

Answer: Indeed, the Tana of our Mishnah holds like Rabanan. However, when Rabanan said that he can annul even though the Neder did not take effect...

ה"מ היכא שאי אפשר לה להנצל אפי' כי מזדהרא בתנאה מענוי נפש או מדברים שבינו לבינה

This is only when she cannot be saved from Inuy Nefesh even if she is careful about her Tenai, or matters between him and her;

כגון נטולה אני מן היהודים אם משמשתו שאינה יכולה לינצל מדברים שבינו לבינה

E.g. [If she said] "I am forbidden to all Yisre'elim if I have Bi'ah with him," she cannot be saved from matters between him and her.

אי נמי כגון שתלתה תנאה בדבר שהיא עשויה לעבור עליו כגון שאני נהנית לך אם עושה אני על פי אבא או ע"פ אביך

Alternatively, if she made her [vow contingent on a] Tenai about something that she is prone to transgress, e.g. "what I benefit you [is forbidden] if I do something for the mouth of my father or your father (they will benefit from it)";

דטריחא לה מילתא להזהר שלא לעשות על פיהם

It is burdensome for her to be careful not to do something according to their words;

אבל היכא שתלתה נדרה בדבר שאינו לא מענוי נפש ולא מדברים שבינו לבינה והוא דבר שאפשר לה לעמוד בו

Distinction: However, when she made her Neder dependent on something that is not Inuy Nefesh or matters between him and her, and it is something that she can fulfill...

E.g. [she made a Neder dependent on not] bathing, like we thought at the beginning of our Sugya that such a case is not Inuy, even Rabanan say that he cannot annul.

ואי קשיא דהא תניא לקמן /נדרים/ (פט) אשת איש שאמרה הריני נזירה לכשאתגרש ר"ע אומר יפר משום דס"ל דבעל מיפר אע"פ שלא חל הנדר

Question: A Beraisa below (89a) says that if a married woman said "I will be a Nazir after I am divorced", R. Akiva says that he can annul, for he holds that a husband can annul even though the Neder did not [yet] take effect;

ואמאי הא התם אכתי לית לה לא צער ענוי נפש ולית בה נמי משום דברים שבינו לבינה

What is the reason? There, she does not yet have any pain of Inuy Nefesh, and it is not matters between him and her!

לאו קושיא היא דהתם לאו בדידה קאי להנצל מענוי נפש דדלמא מגרש לה בעלה

Answer: This is not difficult. There, it is not in her ability to be saved Inuy Nefesh. Perhaps her husband will divorce her!

אבל היכא דתליא נדרה ברחיצה לפום מאי דקס"ד בריש סוגיין דרחיצה לית בה ענוי נפש בדידה קאי.

However, when she made her Neder dependent on bathing, like we thought at the beginning of our Sugya that there is no Inuy in [not] bathing, it is within her power [to avoid Inuy Nefesh].

RAN DH Iy Hachi Lisni... [TRANSLATION: If so, R. Yosi should say 'this is not a stipulation of affliction!']

Explanation (R. Yonah): Now that it taught "these are not Nidrei Inuy Nefesh", this connotes that because the vow is not Inuy Nefesh, he cannot annul. However, if she vowed about something with Inuy Nefesh, he could annul.

וליתא דכיון דבתנאה ליכא ענוי נפש אפי' נדרה בפירות עולם לא יפר

[The Gemara objects that] this is wrong. Since there is no Inuy Nefesh in the Tenai, even if she vowed [to forbid] all Peros, he cannot annul.

וכדאמרינן בריש סוגיין למה לה הפרה לא תרחץ ולא ליתסרו פירות עולם עלה.

Source: We said at the beginning of our Sugya "why is there Hafarah for her? She will not bathe, and all Peros will not be forbidden to her!"

Gemara: Rather, she said 'the pleasure of bathing is permanently forbidden to me if I bathe today.'

דלתנא קמא ניוול דחד יומא שמיה ניוול ומש"ה יפר דהיכי תעביד וכדכתיבנא לעיל.

Explanation: According to the first Tana, repulsion of one day is called repulsion. Therefore, he can annul, for 'what can she do?"', like we wrote above.

RAN DH v'R. Yosi Savar... [TRANSLATION: And R. Yosi holds that repulsion of one day is not called repulsion.]

ר"ן ד"ה ור' יוסי סבר ניוול דחד יומא לא שמיה ניוול

(SUMMARY: The Ran discusses R. Yosi's opinion about never bathing.)

Explanation: Therefore, he cannot annul, for she can refrain from bathing for one day, and afterwards it is not forbidden to her.

וליכא לאקשויי הכא כדמקשינן לעיל אי הכי ליתני ר' יוסי אומר תנאי זה אין בו ענוי נפש

Implied question: We could ask like we asked above, "if so, let it teach 'R. Yosi says, there is no Inuy Nefesh in this Tenai'"!

Answer: Had he taught so, it would connote that there is no Inuy Nefesh, but it is matters between him and her, for this expression connotes like this, like is proven explicitly below (81a);

וניוול דחד יומא לר' יוסי אפילו מדברים שבינו לבינה לא הוי כך פי' הרב ר' יונה ז"ל

[However,] repulsiveness of one day, according to R. Yosi, it is not even matters between him and her. R. Yonah explained like this.

וכ"ת אכתי קשיא דכיון דר' יוסי לא פליג אלא אניוול דחד יומא אבל ניוול דלעולם מודי ביה דהוי ענוי נפש היכי א"ר יוסי אין אלו נדרי ענוי נפש

Question: Still, it is difficult! Since R. Yosi argues only about repulsiveness of one day, but he agrees that permanent repulsiveness is Inuy Nefesh, how did R. Yosi say "these are not vows of Inuy Nefesh"?

דהא בעיקר הנדר ענוי נפש יש בו וכדמקשינן בריש שמעתין

The vow itself is Inuy Nefesh, like we asked at the beginning of our Sugya!

תירץ הרב ר' אליעזר דליתא דר' יוסי ארחיצה דלעולם נמי פליג

Answer #1 (R. Eliezer): This is wrong. R. Yosi argues also about [not] bathing forever;

והכי קאמרינן ר' יוסי סבר ניוול דחד יומא לא שמיה ניוול ולא חש תנא לאשמועי' בהא (הגהת ר' בצלאל אשכנזי) מידי

So we say. R. Yosi holds that repulsiveness of one day is not called repulsiveness. The Tana was not concerned to teach us anything about this!

אלא גדולה מזו קאמר שאין אלו נדרי ענוי נפש כלומר דרחיצה גופה לית בה ענוי נפש כלל

Rather, he taught greater than this. These are not Nidrei Inuy Nefesh, i.e. there is no Inuy Nefesh at all in [not] bathing.

ולפירוש של הרב ר' יונה ז"ל אתי ליה שפיר טפי דבניוול דחד יומא פליג דאפילו משום דברים שבינו לבינה לית ביה

Answer #2: This is better according to R. Yonah. He [explains that R. Yosi] argues about repulsiveness of one day. It is not even matters between him and her;

וברחיצה דלעולם פליג דאין אלו נדרי ענוי נפש מיהו דברים שבינו לבינה הוויין

Regarding a permanent [Isur of] bathing, he argues, for these are not Nidrei Inuy Nefesh. However, they are matters between him and her;

ומכללא משמע דכיון דאפילו ברחיצה דלעולם ליכא ענוי נפש ממילא דחד יומא אפילו דברים שבינו לבינה נמי לא הוי זה נ"ל

We infer that since even in never bathing, there is no Inuy Nefesh, automatically in [refraining from bathing] for one day, it is not even matters between him and her. So it seems to me.

וסוגיין לקמן נמי מוכחא דלר' יוסי אפילו ברחיצה דלעולם נמי ליכא ענוי דמקשינן דר' יוסי אדר' יוסי

Proof: The Sugya below (80b) proves that R. Yosi holds that even in never bathing, there is no Inuy, for we ask a contradiction in R. Yosi;

מדקאמר דכביסתם קודמת אלמא דס"ל דרבי יוסי במתניתין אכולה רחיצה פליג דליכא ענוי דאי לא מאי קושיא.

i.

Since he said that (the inhabitants of the city,) their laundering takes precedence [over the life of others], this shows that [the Gemara] holds that in our Mishnah, R. Yosi argues about all bathing, that there is no Inuy in it. If not, what was the question?

Gemara: 'If I will bathe' - what is the case?

מה תלתה בענין זה.

Explanation: What did she make contingent on this?

ר"ן ד"ה אם לא ארחץ במימי משרה

Gemara: 'If I will not bathe today in Mei Mishreh.'

מים ששורין בהן פשתן שהן סרוחין ביותר דהיכי תעביד תרחץ במי משרה איכא ענוי לא תרחץ מתסרא הנאת רחיצה עלה.

Explanation: Water in which flax was soaked. It is excessively putrid. What will she do? If she bathes in Mei Mishreh [today], there is affliction. If she will not bathe, pleasure of bathing is permanently forbidden to her!

ר"ן ד"ה דכוותיה דקתני אם לא אתקשט בנפט לכלוך הוא

(d)

Gemara: Similarly, it taught 'if I will not adorn myself [i.e.] with kerosene.' That is filth!

שהוא מטונף ומסריח ולישנא בעלמא קשיא ליה היכי קרא ליה קישוט דאדרבה לכלוך הוא.

Explanation: It is filthy and putrid. The wording of the Mishnah is difficult to [the Makshan]. How is this called adornment?!

RAN DH Ela d'Amrah Hana'as... [TRANSLATION: Rather, she said 'the pleasure of bathing is permanently forbidden to me if I bathe today.]

והשתא לא צריכי לאוקמה באומרת אם ארחץ היום אלא באומרת אם ארחץ סתמא דלעולם משמע

Explanation: Now, we need not establish that she said "if I bathe today", rather, "if I bathe" Stam, which connotes forever;

דת"ק סבר דיש בה ענוי נפש ורבי יוסי סבר דלית בה ענוי נפש

The first Tana holds that there is Inuy Nefesh in this. R. Yosi holds that there is no Inuy Nefesh in it.

Implied question: We should ask now like we asked [above, Amud A], that it should teach "R. Yosi says, there is no Inuy Nefesh in this Tenai"!

Answer: It could not teach so, for it taught "and a Shevu'ah that I will not bathe", which has no Tenai, so it is not appropriate to say "this Tenai."

Implied question: Why did the Tana teach these two cases?

לאשמועינן רבותא דרבנן ודרבי יוסי

Answer: He teaches a Chidush in Rabanan, and in R. Yosi;

דרבנן דאף על פי שלא חל הנדר לגמרי מפר ומשום רבותא דרבנן נקט מילתיה בתנאי

According to Rabanan, even though the Neder did not yet take effect totally (i.e. she may bathe once - PF), he can annul. Due to this Chidush of Rabanan, he taught a case with a Tenai;

ומשום רבות' דרבי יוסי נקט שבועה שלא ארחץ בלא תנאי

For a Chidush of R. Yosi, he taught a Shevu'ah "I will not bathe" without a Tenai;

ואע"ג דחיילא מהשתא לא מצי מפר דברחיצה לרבי יוסי ליכא ענוי כלל.

Even though it takes effect immediately, he cannot annul, because R. Yosi holds that there is no Inuy at all in [not] bathing.

THE RAN EXPLAINS THE GEMARA

Gemara: There is Kares only for one who eats or drinks.

דכתיב כל הנפש אשר לא תעונה והאבדתי איזה ענוי שיש בו אבוד נפש הוי אומר זו אכילה ושתיה

Explanation: For it is written "any Nefesh that will not afflict himself, it is will make him perish." Which affliction [can] entail death? This is [not] eating and drinking;

ועל העושה בו מלאכה דכתיב בה כרת.

And [there is Kares] for doing Melachah, about which Kares is written.

RAN DH Ki Rachitz Leichayav Kares [TRANSLATION: When he bathes, he should be Chayav Kares!]

Explanation: [He should be Chayav Kares] because he did not afflict himself [regarding bathing].

ובדין הוא דמצי לשנויי ליה דנהי דרחיצה מיקריא ענוי אין חייבין עליה כרת דהא בעינן ענוי נפש שיש בו אבוד נפש ובענוי רחיצה ליתא

Implied question: We could have answered that granted, [not] bathing is called Inuy, but one is not Chayav Kares for [bathing], since we require mortal Inuy, and this does not apply to bathing!

אלא דרבא פרקה אפי' אליבא דהנהו תנאי דלית להו הך דרשא כדאיתא פ' יום הכפורים.

(c)

Answer: Rava answered even according to those Tana'im who argue with this Drashah [that requires mortal Inuy], like it says in Yoma (74b).

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה מילתא דידע (הגהות ישנות) עינויא השתא

(a)

Gemara: A matter in which the affliction is known (felt) now.

דהיינו אכילה דבאותו יום מינכר עינויא ורחמנא לא קפיד ביום הכיפורים אלא בענוי דמינכר בההוא יומא.

Explanation: This is eating, for on that day, the affliction is recognized. The Torah was adamant about Yom Kipur only for an affliction recognized on that day.

ר"ן ד"ה גבי נדרים דכתיב כל נדר וכל שבועת איסר לענות נפש מילתא דאתיא ביה לידי ענוי

(b)

Gemara: Regarding vows, it says "every vow and every Shevu'ah to afflict the soul" - something that comes to affliction.

דקרא הכי משמע דכיון שנדרה מביאתה לענות נפש מיפר.

Explanation: The verse implies that since her vow will bring her to affliction, he can annul.

RAN DH v'Rami d'R. Yosi ad'R. Yosi [TRANSLATION: And he asks a contradiction in R. Yosi.]

(SUMMARY: The Ran explains why it is a contradiction only in R. Yosi.)

Explanation: However, there is no contradiction in Rabanan. Granted, refraining from bathing the body is Inuy. However, there is not so much pain in [not laundering] clothes;

ועוד דאפילו תמצא לומר דאיכא צערא בכביסה כברחיצה אפילו הכי מצו אמרי רבנן דחיי אחרים קודמין

And further, even if you will say that there is pain in [not] laundering, just like in [not] bathing, even so, Rabanan could say that the life of others has precedence.

אבל דרבי יוסי אדרבי יוסי קשיא דאי כביסה לדידיה אית בה צערא כולי האי עד שהיא קודמת (הגהות ישנות) לחיי אחרים כל שכן דסבירא ליה דברחיצת הגוף איכא ענוי נפש זה נ"ל.

However, R. Yosi contradicts himself. If he holds that there is so much pain in [not] laundering, that it has precedence over others' lives, all the more so he holds that in [not] bathing, there is Inuy Nefesh! So it seems to me.

(a)

Gemara: A spring of people of the city.

היוצא בעיר

Explanation: It goes out (its source) is in the city.

ר"ן ד"ה חייהן וחיי אחרים חייהן קודמין לחיי אחרים

Gemara: Their lives and others' lives - their lives have precedence over others' lives.

שאם אינו מספיק לשתיית כולן שתייתן קודמת דחייהן קודמין כדדרשינן בריש פרק איזהו נשך (ב"מ סב) מדכתיב וחי אחיך עמך.

Explanation: If there is not enough for everyone to drink, their drinking comes first, like we expound in Bava Metzi'a (62a), since it says "v'Chei Achicha Imach."

(c)

Gemara: Their animals and others' animals - their animals have precedence.

אם אינו מספיק לבהמת כולן.

Explanation: If there is not enough for all of their animals.

Gemara: Their laundry and others' laundry.

Gemara: R. Yosi says, laundry of that city has precedence over drinking of people of another city.
