Felling Fruit Trees

Devarim 20:19-20:20
כ:יט כִּי-תָצוּר אֶל-עִיר יָמִים רַבִּים לְהִלָּחֵם עָלֶיהָ לְתָפְשָׂהּ, לֹא-תַשְׁחִית אֶת-עֵצָהּ לִנְדֹּחַ עָלָיו גַּרְזֶן--כִּי מִמֶּנּוּ תֹאכֵל, וְאֹתוֹ לֹא תִכְרֹת: כִּי הָאָדָם עֵץ הַשָּׂדֶה, לָבֹא מִפָּנֶיךָ בַּמָּצוֹר.	20:19 When thou shalt besiege a city a long time, in making war against it to take it, thou shalt not destroy the trees thereof by wielding an axe against them; for thou mayest eat of them, but thou shalt not cut them down; for is the tree of the field man, that it should be besieged of thee?
כ רַק עֵץ אֲשֶׁר-תֵּדַע, כִּי-לֹא-עֵץ מַאֲכָל הוּא--אֹתוֹ תַשְׁחִית, וְכָרָתָּ; וּבָנִיתָ מָצוֹר, עַל-הָעִיר אֲשֶׁר-הִוא עֹשָׂה עִמְּךָ מִלְחָמָה--עַד רִדְתָּהּ.	20 Only the trees of which thou knowest that they are not trees for food, them thou mayest destroy and cut down, that thou mayest build bulwarks against the city that maketh war with thee, until it fall.

אמר רב, דיקלא דטען קבא אסור למקצציה. מיתיבי, כמה יהא בזית ולא יקצצו, רובע! שאני זיתים דחשיבי. אמר רבי חנינא, לא שכיב שיבחת ברי אלא דקץ תאינתא בלא זמנה! אמר רבינא, ואם היה מעולה בדמים מותר. תניא נמי הכי, רק עץ אשר תדע, זה אילן מאכל; כי לא עץ מאכל הוא, זה אילן סרק. וכי מאחר שסופו לרבות כל דבר מה תלמוד לומר כי לא עץ מאכל? להקדים סרק למאכל. יכול אפילו מעולה בדמים, תלמוד לומר רק. שמואל אייתי ליה אריסיה תמרי, אכיל, טעים בהו טעמא דחמרא. אמר ליה, מאי האי? אמר ליה, ביני גופני קיימי. אמר, מכחשי בחמרא כולי האי? למחר אייתי לי מקורייהו! רב חסדא חזא תאלי בי גופני, אמר ליה לאריסיה עקרינהו; גופני קני דקלי, דקלי לא קני גופני.	Rav: One may not cut down a date-palm that bears at least Kav of dates (per year). But an olive tree that bears [even] a quarter-Kav of olives may not be cut? The amount for olive trees is smaller, because olives are more important than dates. R. Chanina: My son Shivchas died, only because he cut a fig tree prematurely! Ravina: If the wood is worth more than the fruit, one may cut it. A Beraisa supports this: "Only a tree that you know" refers to a fruit-bearing tree (i.e., sometimes you may cut even these, when besieging a city); "... that it is not a fruit tree" refers to a barren tree. If we may cut even fruit trees, why does the verse mention a barren tree? We may cut fruit trees only if there are no barren trees available. Perhaps one may not cut a [fruit] tree even if its wood is worth more than its fruit (if barren trees are around)? The word "only" excludes this. Shmuel's sharecropper brought him dates. Shmuel tasted wine therein. He asked why this was so, and the sharecropper replied that the trees stand among grape-vines. Shmuel: They are weakening the vines so much?! Uproot them! Rav Chisda saw date-palms among his vines. He told his sharecropper to uproot them, because [investment in vines] can purchase date-palms, whereas investment in palms cannot purchase vines.
