1)

What does the La'av of "Lo Yachbol ... " entail?

1.

Rashi: If (following the debtor's failure to pay on time) the creditor claims a sMashkon (a security) via Beis-Din, he is not permitted to claim a utensil that is used to prepare food.

2.

Targum Yonasan: [The Pasuk forbids a. ... taking as security a utensil that is used to prepare food, and b. ... using witchcraft to restrain a Chasan and Kalah [from intimacy]. 1

Perush Yonason. See also Na'ar Yonasan.

2)

What is the difference between "Rechayim" and "Rechev"?

1.

Rashi: "Rehayim" is the lower mill-stone, and "Rachev", the upper mill-stone 1 - and someone who takes both as a Mashkon transgresses two La'avin. 2

1

See Torah Temmah, note 96.

2

And the same will apply to any other K'li made of two parts in similar fashion (Bava Metzi'a, 116a).

3)

What is the meaning of "Ki Nefesh hu Choveil"? Why does the Torah see fit to insert it?

1.

Rashi: It means "Because he is taking as a security his means of Ochel Nefesh (preparation of food" 1 And the Torah inserts it to extend the Isur to any utensils that are used for preparing food - Bava Metzi'a, 115a).

2.

Targum Yonasan: Refer to 24:6:1:2. It means that he is causing damage (preventing from being born) to the soul whom they would otherwise bear.

1

Though the La'av extends to all forms of livelihood - See Torah Temimah, note 99.

4)

What is the significance of the juxtaposition of "Lo Yachbol ... " to "ve'Simach es Ishto"?

1.

Moshav Zekenim (in Pasuk 5, based on Targum Yerushalmi): "Chovel" has connotations of tying with ropes, and "Rechayim va'Rechev" hints at intimacy of a Chasan and Kalah. Do not inhibit them; exempt them from army service. 1

2.

Ha'amek Davar #1: Refer to 24:6:1:2..

3.

Ha'amek Davar #2: There is a lien on a borrower's property to his creditor, but givcing a not on his life, so one cannot take a security for what is needed for one's livelihood. Likewise, a man is obligated to the king [to serve in his army], but his wife is not, so he is exempt when he is needed for her life. 2

4.

Oznayim la'Torah: It hints that the Chasan should not give a mill-stone as a Mashkon, even if it is with the intention of being Mesame'ach his new wife during their first year of marriage. 3

1

Targum Yerushalmi does not explain how one inhibits them. He concludes that one who does so denies the world to come! Perhaps he is discussing stopping them via witchcraft, like Targum Yonason. However, this is not like the Moshav Zekenim (PF).

2

In other words, it is essential that her husband makes her happy in the first year (PF).

3

See Oznayim la'Torah, who elaborates.
