HONAYAH IN COINS (Yerushalmi Halachah 4 Daf 17a)

משנה וכמה תהא הסלע חסירה ולא יהא בה הונייה

(a)

(Mishnah) - question: How much of the weight of a deficient sela coin must be lacking for it to be a prohibition of honayah?

רבי מאיר אומר ארבעה איסורות מאיסר לדינר

(b)

R. Meir: 4 issars when there is 1 issar per dinar (i.e. which is 1/24th of a selah).

ר' יהודה אומר ארבעה פונדיונות מפונדיון לדינר

(c)

R. Yehudah: 4 pundions when there is 1 pundion per dinar (which is 1/12th of the selah).

רבי שמעון אומר שמונה פונדיונות משני פונדיונין לדינר:

R. Shimon: 8 pundions when there are 2 pundions per dinar (which is 1/6th of the selah).

גמרא תני יותר מיכן מוציאה בשוה

(e)

(Gemara) - Beraisa: If its deficiency is more than those amounts (i.e. the deficiency has passed the threshold of the prohibition of honayah), one may spend it according to its actual weight (and one is not required to discard it). (For how much of a weight deficiency is this true?)

סלע עד שקל. דינר עד רובע. פחות מיכן אפילו הוא כאיסר אין יכול להוציאה.

(f)

For a selah, until it only weighs a shekel (i.e. half a selah weight); for a dinar, until it weighs a rovah (i.e. half a dinar). Beyond this deficiency, even if it was only an issar more, he may not spend it as a dinar (like the opinion of R. Meir).

היתה יוצא על אסימון בסלע ועל המטבע בשקל. על אסימון בשקל ועל המטבע בסלע אין לו אלא צורת המטבע.

(g)

A token (a coin that is not embossed with a value) but it was used as a selah, but as a coin it was worth a shekel (half a selah) or it was used as a shekel but as a coin it was worth a selah, one must use it according to its value as a coin.

לא יתנה לא לחרם ולא להרג מפני שמרמין בה את אחרים אלא נוקבה ותולה בצואר בנו.

(h)

One may not give it to a thief not a murderer (as a bribe) as they will use it to deceive others. Rather, one can only pierce a hole in it and give it to one's son as a necklace.

במה דברים אמורים בדינרין ובסלעין אבל בדינר זהב ובמטביעות כסף מוציאין בשוייהן.

(i)

For what is this the case? For dinars and selahs, but for golden dinars and silver coins, one may spend them according to their worth.

כשם שמוציאין לחולין כך מוציאין למעשר שני ובלבד שלא יתכוין להוציאן:

Just as one may spend a deficient coin for Chulin (non-consecrated) purposes, so too one may spend it for redeeming Maaser Sheni, as long as he does not save them to be used for this purpose.

RETURNING A DEFICIENT COIN AND CASES OF FIVES (Yerushalmi Halachah 5 Daf 17a)

[דף טו עמוד ב (עוז והדר)] משנה עד אימתי מותר להחזיר

(a)

Question: Until when may he return a deficient selah coin?

בכרכין עד כדי שיראה לשולחני ובכפרין עד ערבי שבתות

(b)

Answer: In the city (where there are experts who can decide if it is still usable), until he can bring it to a moneychanger; in the villages (where there are no experts), until Erev Shabbos (when he will go to the city to buy his Shabbos supplies and will be able to show it to a moneychanger).

אם היה מכירה אפילו לאחר שנים עשר חדש מקבלה ממנו [דף יז עמוד ב] ואין לו עליו אלא תרעומת

(c)

If the one who gave it knew it was deficient, even 12 months later he may return it to him and all he can do is complain.

ונותנה למעשר שני ואינו חושש שאינה אלא נפש רעה.

(d)

It is fine for him to use it to redeem Maaser Sheni produce and one who refuses to accept it later (when he brings the coin to Yerushalayim) is just being stingy.

(e)

The Mishnah taught: A prohibition applies to overcharging four ma'ah for the sale of a selah (which is 24 ma'ah), which is 1/6th of the sale price.

חמש פרוטות הן ההודייה שוה פרוטה והאשה מתקדשת בשוה פרוטה הנהנה שוה פרוטה מן ההקדש מעל המוצא שוה פרוטה חייב להכריז הגוזל את חבירו שוה פרוטה ונשבע לו יוליכנו אחריו אפילו למדי.

There are five cases that require a minimum value of a peruta - a) Admission (as above), b) betrothal of a woman, c) transgression of the prohibition of Me'ilah by benefitting from Hekdesh, d) returning a lost article, e) if a person stole and made a false oath he must follow the victim even to Madai to return it.

חמשה חומשין הן האוכל תרומה ותרומת מעשר ותרומת מעשר של דמאי החלה וביכורין מוסיף חומש הפודה נטע רבעי ומעשר שני שלו מוסיף חומש הפודה הקדישו מוסיף חומש והנהנה בשוה פרוטה מן ההקדש מוסיף חומש והגוזל את חבירו שוה פרוטה ונשבע לו מוסיף חומש:

There are five cases where a fifth is also paid - a) One who eats Terumah,Terumas Maaser, Terumas Maaser of Demai, Chalah or Bikurim, b) One who redeems fruits of the fourth year of a sapling and its Maaser Sheni, c) One who redeems something that he had made Hekdesh, d) One who benefitted from Hekdesh, e) One who stole and made a false oath.

גמרא חזקיה אמר לצורפה בירושלם מצרפה ביפה. בא לחללה בגבולין מחללה ברעה.

(h)

(Gemara) - Chizkiyah: (If a person has a deficient selah of Maaser Sheni that he wishes) to exchange in Yerushalayim (in order to buy food, according to the laws of Maaser Sheni), he may exchange it as if it is a good coin. If he wishes to collect all of his Maaser Sheni coins and transfer the sanctity onto one (more portable) coin, he may do this even onto a deficient coin.

והתנינן בורר היפה שבהן ומחללן עליה. ויבור הרעה ויעשה אותה.

(i)

Question: The Mishnah teaches (in Maseches Maaser Sheni Perek 2) that one should choose the better one of them and redeem upon it. Why does the Mishnah here allow him to do this even with an inferior one?

אמר שנייא היא הכא שכבר הוכח בו מעשר שני.

(j)

Answer: Here, since one of them is confirmed to be Maaser Sheni but it is unknown which one, he must choose the better of them to redeem upon it.

[דף טז עמוד א (עוז והדר)] נותנה למעשר שני ואינו חושש שאינה אלא נפש רעה.

The Mishnah also taught: It is fine for him to use it to redeem Maaser Sheni produce and one who refuses to accept it later (when he brings the coin to Yerushalayim) is just being stingy.
