WHEN IT PAYS THE DAMAGE, AND WHEN IT PAYS THE BENEFIT (Yerushalmi Perek 2 Halachah 4 Daf 9b)

(a)

(Mishnah): What is the case in which [the owner] pays the benefit? It is if it ate from Rechavah (a public area or square). If it ate from the side of the Rechavah, he pays the damage.

îôúç äçðåú îùìí îä ùðäðéú îúåê äçðåú îùìí îä ùäæé÷ä:

(b)

If it ate from the entrance to a store, he pays what it benefited. If it ate from inside the store, he pays the damage.

(Gemara - Rav): If it bent its neck and ate, he pays what it damaged.

(d)

Question (Mishnah): If it ate from the entrance to a store, he pays what it benefited. (Surely this was through bending its neck!) If it ate from inside the store, he pays the damage.

Question: How can we answer this?

(f)

Answer (R. Yosi bei R. Bun): [In our Mishnah,] a donkey was carrying kids [facing to the side]. When they passed by, [the kids] stretched their necks (straight, without bending them) and ate from the entrance to a store. He pays what it benefited. From inside the store, he pays the damage.

(Rav): If it ate barley, he pays [the amount it would have eaten of] straw.

(h)

Question (Tosefta of R. Chiyah): How does he pay what it benefited? We estimate how much a man wants [to pay] to feed his animal something proper for it. Therefore, if it ate wheat, which is not proper for it, he is exempt. (This implies that if it ate barley, which is proper for it, he pays the value of barley! We explained this like MAHARA FULDA. This question is not answered.)

Question: What does it mean "if it deviated and ate, he pays full damage''? (Any proper Shinuy is a Toldah of Keren, which pays only half damage!)

If a long bundle of grain was in the entrance to a store, half was inside and half outside, and a cow stretched its mouth and ate from it, he pays full damage.
