AN ANIMAL THAT DAMAGED THROUGH FIRE (Yerushalmi Perek 2 Halachah 5 Daf 10a)

(a)

(Mishnah): If a dog or kid jumped from the roof and broke Kelim, it pays full damage, because it is Mu'ad.

If a dog took a cake (with a coal inside) to a pile of grain, and ate the cake and burned the grain, it pays full damage for the cake and half-damage for the grain.

(Gemara): Some teach [in our Mishnah] 'jumped', and some teach 'fell'.

(R. Yochanan): Our Mishnah says 'jumped'. If it fell, we would not say [that it is liable].

(Reish Lakish): The case is, [the dog] set fire to every ear [of grain. If not, the owner would not be liable, for it was not his coal.]

(R. Yochanan): (We need not say so. One is liable for fire, like for an arrow that one shoots.) It is as if it shot an arrow from place to place.

Support #1 (for R. Yochanan - R. Yitzchak bar Tavlai - Mishnah): [If Reuven lit a stack of grain and] there was a goat tied to it and a slave nearby, and they burned with it, Reuven is liable. If there was a slave tied to it and a goat nearby, and they burned, he is exempt;

If you will say that [one who burns] is not like one who shoots an arrow from place to place [rather, he is liable because his property damaged], for the first ear [to which the slave was tied] he is Chayav Misah. From this and onwards, he must pay! (MAHARA FULDA - there is no Chiyuv Misah for what his property damaged, therefore Kam Lei bid'Rabah Minei does not apply.)

Support (for R. Yochanan - R. Yosi - Mishnah): [If Reuven's ox burned a stack on Shabbos, he is liable. If he burned a stack on Shabbos, he is exempt [from payment].

If you will say that [one who burns] is not like one who shoots an arrow from place to place, he should be like one who [after he is Chayav Misah for Chilul Shabbos], became liable to pay [for what his property damaged]. From now and onwards, he should be liable to pay!

A person took out bread in an oven [to Reshus ha'Rabim]. A donkey came and broke it. The case came in front of R. Yitzchak bar Tavlai;

R. Yitzchak bar Tavlai: He does not owe anything to you [the owner of the oven]. Not only this, but if [the donkey] was damaged, you are liable for the damage!
