THE ARGUMENT BETWEEN THE TANA'IM IN THE BERAISOS REGARDING A FETUS FOUND INSIDE A KORBAN CHATAS

(C)
IS EACH BERAISA DISCUSSING A CASE IN WHICH THE FETUS WAS CONCEIVED BEFORE THE MOTHER WAS MADE KADOSH, OR AFTER THE MOTHER WAS MADE KADOSH?
1 HAVAH AMINA This is what the Tana'im argue about (1) The Tana'im agree: at birth Both Beraisos: the fetus was conceived before the mother was made Kadosh
2 FIRST ANSWER It does not matter This is what the Tana'im argue about (2) Both Beraisos: the fetus was conceived after the mother was made Kadosh (3)
3 SECOND ANSWER Yes (4) The Tana'im agree: at birth (4) First Beraisa: the fetus was conceived before the mother was made Kadosh;

FOOTNOTES:

==========

(1) The first Tana maintains that one can be Makdish a fetus. The second Tana maintains that one cannot be Makdish a fetus.

(2) The first Tana maintains that the offspring of Kodshim become Kodesh in the womb. The second Tana maintains that the offspring of Kodshim become Kodesh only at birth.

(3) This is according to Rashi. The Sefas Emes comments that Rashi explains this way in order to have the Gemara conform with Rebbi Yochanan's opinion. According to Bar Pada, however, the fetus is Kadosh when it was conceived before the mother became Kadosh.

(4) This is according to Rashi. Rabeinu Gershom, however, explains in the opposite manner: according to this answer, both Tana'im agree that the offspring becomes Kadosh in the womb (and not merely at birth), and both Tana'im agree with Bar Pada that when one is Makdish the animal before it became pregnant, the offspring is not Kadosh. This also appears to be the opinion of the Rambam (Hilchos Temurah 4:3).

(5) According to this answer, the Tana'im are not arguing. Rather, each one is discussing a different case.
