BURNING KODSHIM ON SHABBOS AND YOM TOV (Yerushalmi Halachah 1 Daf 15a)

ולא בשמן שריפה.

(a)

(Mishnah): And not with Shemen Sereifah.

אמר רב חסדא זאת אומרת שאסור להצית את האור במדורת קדשים והיא דליקה והולכת בשבת.

Inference (Rav Chisda): One may not light [on Erev Shabbos] a fire to burn [Pasul] Kodshim, and it will burn on Shabbos.

והא תנינן ומאחיזין את האור במדורת בית המוקד ובגבולים כדי שיצת האור ברובן.

Question (Mishnah): We light the fire in Beis ha'Mokad, and outside the Mikdash, the majority must catch fire. (Presumably, we are lenient in Beis ha'Mokad because Kohanim are zealous. If so, we should be lenient also for Shemen Sereifah (Tamei Terumah), for Kohanim burn it! We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)

א''ר יוסה בשבת כתיב [שמות כ י] לא תעשה כל מלאכה. נעשית היא מאיליה. ברם הכא התורה אמרה אין שורפין את הקדשים ביום טוב. ואין צריך לומר בשבת.

Answer (R. Yosah): It says about Shabbos "Lo Sa'aseh Kol Melachah'', but Melachah may occur by itself. However, here the Torah said that we do not burn Kodshim on Yom Tov, and all the more so on Shabbos!

Question: What is the source to say so (that we do not burn Kodshim on Yom Tov)?

לא תותירו ממנו עד בוקר והנותר ממנו עד בוקר באש תשרפו אחר שני בקרים. א' בוקרו של ט''ו ואחד בוקרו של י''ו.

Answer: "Lo Sosiru Mimenu Ad Boker veha'Nosar Mimenu Ad Boker ba'Esh Tisrofu'' - [it mentions morning twice to teach that we burn Nosar of Pesach] after two mornings [came] - the morning of the 15th and the morning of the 16th;

וכתיב [ויקרא ז יז] והנותר מבשר הזבח ביום השלישי באש ישרף.

Support: And it says "veha'Nosar mi'Besar Zevach ba'Yom ha'Shelishi ba'Esh Yisaref.'' (Also Nosar of Shelamim is burned on the third day.)

Question: May one light Chametz [on Erev Yom Tov, to burn on Yom Tov or Shabbos]?

מאן דיליף לה מנותר אסור. ומאן דלא יליף לה מנותר מותר.

Answer: The one who learns [that Bi'ur Chametz is through burning] from Nosar, he forbids [just like Nosar]. The one who does not learn from Nosar, he permits.

רב אחא בשם רב חסדא זאת אומרת שמותר להצית את האור במדורת קדשים. והיא דליקה והולכת בשבת.

(Rav Acha citing Rav Chisda): [The Mishnayos] teach that one may light [on Erev Shabbos] a fire to burn [Pasul] Kodshim, and it will burn on Shabbos. (This is unlike we brought above from Rav Chisda. He explains the source);

והא תנינן אין מדליקין בשמן שריפה ביום טוב

Implied question: [Our Mishnah forbids using Shemen Sereifah for Ner Shabbos. Why do we need] another Mishnah "one may not burn Shemen Sereifah on Yom Tov''? (We learn the Isur to burn on Shabbos from a verse that forbids on Yom Tov!)

מפני יום טוב שחל להיות בע''ש.

Answer: [The other Mishnah teaches that our Mishnah forbids] due to Yom Tov that falls on Erev Shabbos [but when Erev Shabbos is a Yom Chol, it is permitted. We explained this like MEICHAL HA'MAYIM.]

מעתה אין מדליקין בשמן שריפה בלילה על שם שאין שורפין את הקדשים בלילה.

Question: If so, we should say that we may not light Shemen Sereifah at night, for we do not burn Kodshim at night!

[דף יט עמוד א (עוז והדר)] א''ר יוחנן ירדו לה בשיטת רבי ישמעאל. כמה דר' ישמעאל אמר תינוק שעבר זמנו נימול בין ביום בין בלילה. כך עבר זמנה נשרפת בין ביום בין בלילה.

Answer (R. Yochanan): This is like R. Yishmael. Just like R. Yishmael says, a baby whose time passed is circumcised during the day or at night, so [Kodshim] whose time passed are burned during the day or at night.

ומה אית לך שמן שרפה שעבר זמנה.

Question: Can you say that Shemen Sereifah, its time passed?! (Since you cannot, it should always be burned during the day!)

ר' יודה בר פזי מכיון שניטמאה כמי שעבר זמנה.

Answer (R. Yudah bar Pazi): Since it became Tamei, it is as if its time passed.

(תני רבי יוסי קומי רבי יוחנן מניין לכל הנימולים שלא יהו נימולים אלא ביום תלמוד לומר [שם יב ג] וביום - גליוני הש''ס מוחקו מכאן וגורסו לקמן] א''ל רבי יוחנן ויש (כאן) [שצ''ל כעין, ע''פ שערי תורת ארץ ישראל] זו. כל מחוייבי טבילות טובלין כדרכן ביום חוץ מנידה ויולדת שאינה טובלת אלא בלילה. נידה שעבר זמנה טובלת בין ביום בין בלילה.

Support (R. Yochanan): We find like this - anyone obligated to immerse, he immerses normally during the day, except for a Nidah or Yoledes, who immerses only at night. A Nidah whose time passed immerses during the day or at night!

(R. Yosi, in front of R. Yochanan): What is the source for all who are circumcised, that they are circumcised only during the day? It says "uv'Yom''. (The prefix Vov includes Milah after day eight. We explained this like GILYONEI HA'SHAS.]

There (in Bavel) they say that even if the time passed [she immerses only at night] due to her mother-in-law and daughter-in-law.

Note: The Bavli is concerned lest her daughter think that she immerses on the seventh day, and she herself will come to do so. SHIREI KORBAN learns from here that the concern is not limited to her daughter. OHR SOMAYACH (Isurei Bi'ah 4:8) says that a mother-in-law and daughter-in-law are prone to hate each other; we are concerned lest one publicize that the other immersed on day seven.

אשה אחת משל רבותינו ראו אותה טובלת כדרכה ביום. נאמר מעוברת זמן היתה.

One wife of Raboseinu, they saw her immerse normally during the day. We must say that her time had passed. (This shows that she was not concerned for the stringency of Chachmei Bavel - ALEI TAMAR.)

נידה שנאנסה וטבלה שמי בשם רב טהורה לביתה וטמאה לטהרות.

If a Nidah immersed unwillingly, Shamai says in the name of Rav that she is Tehorah for her husband, and Tamei for Taharos;

רבי לעזר בשם רבי חנינא טמאה בין לביתה בין לטהרות.

(R. Lazar citing R. Chanina): She is Temei'ah both for her husband and for Taharos.

ומאי טעמא [ויקרא יג נח] וכובס שנית וטהר. מה הראשונה לדעת אף השנייה לדעת.

What is the source? "V'Chuvas Shenis v'Taher'' - just like the first [Tevilah] was intentional, also the second.
