THE SOURCE FOR KINUYIM (Yerushalmi Perek 1 Halachah 1 Daf 1a)

[דף א עמוד א] מתני' כל כינויי נדרים כנדרים חרמים כחרמים שבוע[ו]ת כשבועות נזירות כנזירות

(a)

(Mishnah): Every Kinuy (substitute name) for Nedarim (vows, one who says them) is like [one who says] Nedarim, all Kinuyim of Cherem (making something somewhat or totally like Hekdesh) are like Cherem, all Kinuyim of Shevu'os are like Shevu'os, and all Kinuyim of Nezirus are like Nezirus.

האומר לחבירו מודר אני ממך מופרש אני ממך מרוחק אני ממך שאיני אוכל לך שאיני טועם לך אסור

(b)

If one said to his friend 'I am Mudar (forbidden by a vow) from you', 'I am separated from you', 'I am distanced from you', 'that I will eat Lecha (from you)', or 'that I will taste Lecha (from you)', he is forbidden [to benefit from him].

מנודה אני לך ר' עקיבא היה חוכך בזה להחמיר

(c)

If one said 'I am Menudeh to you', R. Akiva was inclined to be stringent about this.

כנדרי רשעים נדר בנזיר בקרבן ובשבועה

(d)

If one said "like the vows of Resha'im..." (and he vowed)", his vow of Nezirus, Korban or Shevu'ah takes effect (this will be explained);

כנדרי כשרים לא אמר כלום

(e)

If he said "like Nedarim of Kesherim" it has no effect.

כנדבותם נדר בנזיר ובקרבן:

(f)

If he said "like their Nedavos (Hekdesh of an animal in which one takes no responsibility to compensate if it will be lost, stolen or blemished)", his vow of Nezirus or a Korban takes effect.

גמ' כתיב [במדבר ל ג] איש כי ידר. מה ת"ל נדר.

(Gemara) Question: It says "Ish Ki Yidor Neder" - why does it say Neder? (It already says Yidor!)

אלא מיכן שכינוי נדרים כנדרים.

(h)

Answer: This teaches that Kinuyim for Nedarim are like Nedarim.

[במדבר ל ג] או השבע מה ת"ל שבועה.

Question: It says "Oh Hishava Shevu'ah" - why does it say "Shevu'ah"?

אלא מיכן שכינויי שבועות כשבועות.

Answer: This teaches that Kinuyim for Shevu'os are like Shevu'os.

[ויקרא כז כח] אך כל חרם מה ת"ל יחרים.

Question: It says "Ach Kol Cherem" - why does it say "Yacharim"?

אלא מיכן שכינויי חרמים כחרמים.

Answer: This teaches that Kinuyim for Charamim are like Charamim.

[במדבר ו ב] נדר נזיר. מה ת"ל להזיר.

Question: It says "Neder Nazir" - why does it say Lehazir?

אלא מיכן שכינויי נזירות כנזירות.

Answer: This teaches that Kinuyim for Nezirus are like Nezirus.

עד כדון כר' עקיבא דאמר לשונות ריבויין הן.

Question: This is according to R. Akiva, who says that [doubled expressions] are inclusions;

כר' ישמעאל דאמר לשונות כפולין הן והתורה דיברה כדרכה. [בראשית לא ל] הלוך הלכת [בראשית לא ל] נכסף נכספת [שם מ טו] גונב גונבתי מנלן

According to R. Yishmael, who says that they are doubled expressions, and the Torah spoke in it its way, e.g. "Haloch Halachta [Ki] Nichsaf Nichsafta", "Gunav Gunavti" [so we do not expound them], what is the source?

איש כי ידר נדר ליי' או השבע שבועה לאסור אסר על נפשו לא יחל דברו. מה ת"ל ככל היוצא מפיו יעשה.

Answer - Question: It says "Ish Ki Yidor Neder la'Shem Oh Hishava Shevu'ah Le'esor Isar Al Nafsho Lo Yachel Devaro" - why does it say "k'Chol ha'Yotzei mi'Piv Ya'aseh"?

אלא מיכן שכינויי נדרים כנדרים. וכינויי שבועה כשבועה.

Answer: This teaches that Kinuyim for Nedarim are like Nedarim, and Kinuyim for Shevu'ah are like a Shevu'ah.

ומניין שכינויי חרמים כחרמים.

Question: What is the source that Kinuyim for Charamim are like Charamim?

נדר נדר מה נדר שנאמר (להלן) [צ"ל כאן - קרבן העדה] כינויי נדרים כנדרים וכינויי שבועה כשבועה אף נדר שנאמר (כאן) [צ"ל להלן - קרבן העדה] כינויי חרמין כחרמין.

Answer: [We learn from a Gezeirah Shavah] "Neder-Neder." Just like Neder said here (regarding Nedarim), Kinuyei Nedarim are like Nedarim, and Kinuyei Shevu'ah are like a Shevu'ah, also Neder said there (regarding Cherem), Kinuyei Charamim are like Charamim.

Question: What is the source that Kinuyim for Nezirus are like Nezirus?

נדר נדר. מה נדר שנאמר (להלן כינויי) [צ"ל כאן כינויי נדרים כנדרים וכינויי - קרבן העדה] שבועה כשבועה אף נדר שנאמר (כאן) [צ"ל להלן - קרבן העדה] כינוי נזירות כנזירות.

Answer: [We learn from a Gezeirah Shavah] "Neder-Neder." Just like Neder said here (regarding Nedarim), Kinuyei Nedarim are like Nedarim, and Kinuyei Shevu'ah are like a Shevu'ah, also Neder said there (regarding Nezirus), Kinuyei Nezirus are like Nezirus.

מה מקיים ר' עקיבה [במדבר ל ג] ככל היוצא מפיו יעשה

Question: What does R. Akiva learn from "k'Chol ha'Yotzei mi'Piv Ya'aseh"?

מיכן לנדר שבטל מקצתו בטל כולו.

Answer: This teaches that a Neder that is partially Batel is totally Batel.

ולית ליה לר' ישמעאל כן

Question: Does R. Yishmael not hold like this?! (He used this to teach that Kinuyim for Nedarim and Shevu'os are like Nedarim and Shevu'os.)

כולה מן תמן אית ליה מיכן שכינויי נדרים כנדרים וכינויי שבועות כשבועות. אית ליה מיכן לנדר שבטל מקצתו בטל כולו.

Answer: He learns all of them from there. This teaches that Kinuyei Nedarim are like Nedarim, and Kinuyei Shevu'os are like Shevu'os, and this teaches that a Neder that is partially Batel is totally Batel (for it could have said 'Kol' [ha'Yotzei mi'Piv...], and rather, it says "k'Chol". RAN (3b) - he can learn both, for the verse connotes both of them.)

מה מקיים ר' ישמעאל נדר נזיר להזיר.

Question: What does R. Yishmael learn from "Neder Nazir Lehazir"?

מיכן שאדם קובע עליו נזירות בתוך נזירותו.

Answer: This teaches that one can accept on himself Nezirus during his days of Nezirus. (Do not say that it is like a Shevu'ah, and a second Shevu'ah does not take effect on a Shevu'ah.)

Question: Does R. Akiva not hold like this?! (He used this to teach that Kinuyei Nezirus are like Nezirus.)

אית ליה כולה מתמן אית ליה. מיכן שאדם קובע עליו נזירות בתוך נזירותו.

Answer: He learns all (both) of them from there (for it could have said 'Lizor', and rather, it says "Lehazir"). This teaches that [Kinuyei Nezirus are like Nezirus, and] one can accept on himself Nezirus during his days of Nezirus.
