Rebuttal: There is no proof from here. He did not ask from our Mishnah, because since it taught [Chata'os and Ashamos] with Kinei Zavim, automatically it is proven that "Chata'os and Ashamos" are of a Metzora;

However, the Beraisa taught Stam "he throws the blood of his Chatas and Asham." This implies all Chata'os;

Gemara: Kohanim who were Mefagel (offered a Korban with improper intent, e.g. to eat it after the allowed time) in the Mikdash... it is fine if they are Hash-m's Sheluchim. Therefore, what they made Pigul is Pigul (disqualified).

Question (Tosfos): A Mishnah, brought in Kidushin 55a, says that if an animal was found [no further than] from Yerushalayim to Migdal Eder, males are Olos. I.e. they are offered. This shows that Da'as [of the owner] is not needed! (Even though the Gemara concludes that the finder waits for the animal to get a Mum, and he redeems it onto another animal and offers the latter, also this is for the sake of the owner, and without his Da'as. Also, in the Havah Amina that he offers the found animal, we did not ask that we need Da'as - PF.)

Answer (Tosfos): There is different. Since it was lost, the owner's Da'as is that any Kohen who wants to offer it, may offer it.

Gemara: If so, one may bring a Chatas Chelev for someone else. Why did R. Elazar say that [if one separated a Chatas Chelev for someone else], this has no effect?

משום דאין דנין אפשר משאי אפשר.

Explanation: This is because we do not learn possible (one who has Da'as can offer a Korban for himself) from impossible (one who has no Da'as).

Gemara: His lunatic wife - what is the case?

Clarification: R. Yehudah taught that a man brings for his insane wife - he did not refer to Chatas Chelev, rather, Korban Yoledes;

Chatas Chelev is not possible. In which case [would one bring it]? ... Since she is exempt, it is impossible that her husband will bring for her.

Gemara: 'I will slaughter the Pesach for the first of you to ascend to Yerushalayim.'

אמר לבניו הריני עולה לירושלים ולאחר שאהיה שם אשחוט את הפסח על מי שיעלה מכם ראשון.

Explanation: He told his children, 'I will ascend to Yerushalayim, and after I will be there, I will slaughter the Pesach for the first of you to ascend.'

Gemara: It is on meat.

Explanation #2: If 'he acquires for one of them' refers to the son who will ascend first, how does he acquire for his brothers?

Opinion #1: Our Mishnah is like Chanan. It cannot be Rabanan, for this is not less than paying his debt, which Rabanan forbid. The Rashba said so.

Source: We say in Kesuvos (70b) "whoever hears my voice should feed [my wife]" is Shelichus. We derive this from the Mishnah in Gitin (66a);

Regarding Get, it helps if he said "whoever hears my voice should write a Get for my wife." Therefore, it is permitted only when he says "whoever wants can come and take Terumah", for this is not full Shelichus.

Distinction: When we say that for Terumah it helps, this is only when he said it in this expression. This is an intermediate expression. Therefore, regarding Mudar it is not considered Shelichus, but it helps for Terumah;

However, if he said "whoever takes Terumah will not lose", perhaps even for Terumah this does not help, for it is not as good an expression as "[anyone who wants,] come and take Terumah."

Proof: If one says "whoever feeds [my wife] will not lose", he is not obligated [to pay one who fed her], for he did not make him a Shali'ach at all.

Gemara: If one is Torem from his produce to exempt another's, who has Tovas Hana'ah?

Explanation: Who has the right to give this Terumah [to whichever Kohen he wants] - the Torem, or the owner of the stack?

Gemara: The one who made an object Hekdesh adds a fifth.

Explanation: The one who was Makdish an animal for a Korban for someone else, and it got a Mum, and he wants to redeem it, the Makdish is called the owner regarding adding a Chomesh;

Gemara: The Tovas Hana'ah is his.
