Explanation: The Mishnah (10b) "l'Chulin she'Ochel Lecha" is called the Reisha.

ונראה בעיני דה"פ בשלמא אי כר"מ מתוקמא לא תקשי לן היינו רישא

It seems that the Gemara asks as follows. Granted, if we establish it like R. Meir, it is not difficult that this is like the Reisha;

משום דההיא דלעיל אוקימנא כרבי יהודה והכי קתני שרבי יהודה אומר האומר ירושלים וכו'

We established the above Mishnah [entirely] like R. Yehudah, and it teaches "for R. Yehudah says, one who says Yerushalayim..."

והכא סתם לן תנא דאפילו לר"מ דלית ליה מכלל לאו אתה שומע הן בהא מודה משום דכיון דאמר לא חולין על כרחין קרבן הוי

And here, the Tana taught Stam. It is even like R. Meir, who does not infer the positive from the negative. Here he agrees, for since he said Lo Chulin, you are forced to say that it is a Korban.

אבל קאמר הש"ס דלא אפשר לאוקמא אליביה דכיון דלית ליה מכלל לאו אתה שומע הן אפילו בכי האי גוונא אית ליה למישרי.

However, the Gemara says that we cannot establish it like him. Since he does not infer the positive from the negative, even in such a case, he should permit.

Gemara: Since it taught 'like pork...'

כלומר הא דקתני חולין שאוכל לך לאו לגופיה איצטריך ולאו לדיוקא אלא אגב גררא דשארא פתח ביה הכי.

Explanation: This that it taught 'Chulin is what I will eat from you' is not needed for it itself, and not for an inference. Rather, Agav (along with the others, the Tana) began with it.

Gemara: So it teaches. These are permitted like Chulin.

כלומר כאומר חולין שאוכל לך שיהא מותר לגמרי ולא בעי שאלה.

Explanation: It seems to me that it means that as follows. The Gemara holds that we do not need a verse to teach that Matfis in Davar ha'Nadur forbids;

דכיון דאמר ככר זה עלי אסור הוי נדר כי אמר נמי כקרבן ככר זה עלי בקרבן (הגהות ישנות) קאמר ולא גרע מידות

Since he said Kikar Zeh Alai Asur, this is a Neder. Also when he said k'Korban, he means "this loaf is Alai with (the Isur of) a Korban." It is no worse than a Yad;

אלא ודאי קרא דכי ידור נדר לאו לדבר הנדור אתא אלא למעוטי דבר האסור

Rather, surely, the verse Ki Yidor Neder does not comes to teach about Davar ha'Nadur. Rather, it excludes Davar ha'Asur.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ופרכינן אי הכי אפילו בדבר האסור נמי דהא כתיב לאסור איסר

Gemara: We ask, if so, even [Hatfasah] in Davar ha'Asur [should forbid], for it says "Lesor Isar"!

כלומר דעל כרחך כל חד לגופיה איצטריך ולאו למעוטא

Explanation: I.e. you are forced to say that each is needed for itself, and not to exclude.

אלא (הגהת הב"ח) כי היכי דלא תיסק אדעתין דמתפיס לא הוי נדר כתב רחמנא הני תרי קראי לאשמועינן דמתפיס (הגהת ר' בצלאל אשכנזי) בדבר הנדור ומתפיס בדבר האסור הוי נדר

Rather, lest you think that Matfis is not a Neder, the Torah wrote these two verses, to teach that Matfis in Davar ha'Nadur and Matfis in Davar ha'Asur are Nedarim;

וכל חד מינייהו חייל דאי לא לאסור איסר למאי מוקמת ליה

Each of them takes effect. If not, how will you establish "Lesor Isar"?

Gemara: We answer that we need "Lesor Isar" like the Beraisa, which is the Isar...

Explanation: I.e. since it is possible to establish it for this Drashah, we establish it for this, since it is logical that Matfis in Davar ha'Asur does not take effect;

Granted, one can be Matfis in Davar ha'Nadur, and say this loaf is Alai with a Neder or a Korban that was forbidden through a Neder;

אבל כי מתפיס בדבר האסור לא כלום קאמר דהיכי לימא ככר זה עלי כבשר חזיר לא אפשר דבשר חזיר אסריה רחמנא והוא לא אסריה.

However, Hatfasah in Davar ha'Asur, his words have no effect. How can he say "this loaf is Alai like pork? This cannot be. The Torah forbade pork. He did not forbid it! (Shalmei Yerucham - why can he not forbid it to himself, just like pork is forbidden?)

לאשמועינן דאע"ג דתלי נדרו בדבר (גירסת כתב יד) שלא נאסר אלא לו לבדו דהיינו יום שמת בו אביו חייל נדרא

Explanation: This teaches that even though he made his Neder dependent on something forbidden only to him, i.e. the day that his father died, the Neder takes effect;

דאי לאו האי קרא הוה אמינא כי ידור נדר עד שידור בדבר שהוא נדור (הגהות ישנות) לגמרי שנאסר לכל (הגהת בארות המים) מחמת אותו נדר קמ"ל קרא דלאסור איסר

If not for this verse, I would have thought that Ki Yidor Neder [teaches Hatfasah] only in something that is totally Nadur, i.e. it is forbidden to everyone due to the vow. Lesor Isar teaches unlike this.

וא"ת א"כ היכי מקשינן התם בריש פרק שבועות שתים בתרא כיום שמת בו אביו פשיטא והא טובא קמ"ל וכדכתיבנא

Question: If so, how could we ask there (Shevu'os 20b) "like the day that his father died? This is obvious!"? This teaches a lot, like I wrote (it was forbidden only to him)!

נראה בעיני דמדלא נקט תנא בנדר על ככר ומתפיס על ככר אחר בו משמע דאגב אורחיה מילתא אחריתי אתא לאשמועינן

Answer: Since the Tana did not mention a Neder about a loaf, and he is Matfis in another loaf, this implies that by the way, he teaches another matter;

דמתפיס בימים שאפילו בלא נדר לא היה אוכל בהם בשר כיון דמ"מ משום נדר ג"כ הם נאסרים עליו כי מתפיס בהו חייל נדרא

If one is Matfis in days that even without a Neder, he would not have eaten meat, since in any case they are forbidden also due to his vow, when he is Matfis in them, his Neder takes effect.

והיינו יום שמת בו אביו ויום שמת בו רבו דאפילו בלא נדר משום צעריה לא הוה אכיל בהו בשרא ושתי חמרא

These are the day his father died, and the day his Rebbi died. Even without a Neder, due to pain, he would not have eaten meat or drank wine on these days.

This is why the Gemara asked "the day his father died? This is obvious!", for the entire Isur is due to his vow.

Ruling: Matfis in Davar ha'Asur is not a Neder. It does not require She'eilah at all, even for an Am ha'Aretz;

אלא במדיר אשתו בלבד ומהאי טעמא דכתיבנא במתני'

Only regarding his wife [it requires She'eilah], for the reason I wrote in our Mishnah [because it is common to forbid her when he is upset. Perhaps he will permit even when he is Matfis in Davar ha'Nadur.]

אבל מתפיס בדבר הנדור ואפי' בדבר שאינו נדור אלא לו בלבד חייל

(b)

Distinction: However, if one is Matfis in Davar ha'Nadur, even if the vow forbids it only to himself, it takes effect.

וה"מ מתפיס בנדר אבל מתפיס בשבועה לא מהני דקי"ל בפרק שבועות שתים בתרא דמתפיס בשבועה לאו כמוציא שבועה מפיו דמי

Opinion #1: This is only for one who is Matfis in a Neder. Matfis in a Shevu'ah does not help. We hold in Shevu'os (20a) that Matfis in a Shevu'ah is not like one who says a Shevu'ah with his mouth.

דהיינו טעמא משום דנדר חל על החפץ שאסר את החפץ עליו בנדר ולפיכך כשהוא מתפיס חפץ בחפץ ראוי הוא שיחול

Explanation: This is because a Neder takes effect on the object. He forbids the object to himself through a Neder. Therefore, when he is Matfis an object in another object, it is proper that it take effect;

אבל שבועה הוא אוסר עצמו מן החפץ אבל גוף החפץ אין עליו נדר וקדושה כלל הילכך אי אמר זה כזה לא אמר כלום

However, a Shevu'ah forbids himself to the object. There is no Neder or Kedushah on the object at all. Therefore, when he says "this is like this", his words have no effect.

וכן נמי אם אמר שלא אוכל בשר כיום שמת בו אביו והוא היה מושבע על אותו יום לא אמר כלום דהא באותו יום מתפיס ואותו יום ליכא בגופיה נדרא כלל

Similarly, if he said that [he] will not eat meat like the day that his father died, and he had sworn about that day, his words have no effect, for he is Matfis in the day, and there is no Neder in the day at all.

ואיכא מ"ד דנהי דמתפיס בשבועה לאו כמוציא שבועה מפיו דמי ה"מ לענין קרבן ומלקות אבל איסורא מיהא איכא

Opinion #2: Some say that granted, Matfis in a Shevu'ah is not like one who says a Shevu'ah with his mouth, i.e. regarding Korban and lashes, but there is an Isur.

Explanation: If an Am ha'Aretz vowed "b'Torah", he needs She'eilah, whereas one who was Matfis in Davar ha'Asur, we derived from our Mishnah that he does not need She'eilah at all, except for vows to forbid his wife, like it says above.

Gemara: One who vows in the Torah.

כלומר שנשבע בתורה דקרי ליה תנא לנשבע נודר וכדכתיבנא לעיל

Explanation #1: He swore in the Torah. The Tana calls swearing 'Noder', like I wrote above (8a DH veha'Lo Muishba. The Ran gives another Perush below, in DH Hachi Garsinan.)

ומיירי שהיתה תורה מונחת לפניו ואמר בזו התורה שלא אעשה או שאעשה דבר פלוני לא אמר כלום דדעתיה אגוילין כדאמרינן בסמוך.

The case is, the Torah was resting in front of him, and he said 'by this Torah, I will not do' or 'I will do matter Ploni.' It has no effect, for his intent is for the parchments, like we say below.

Since it is on the ground. we say that he intended for the parchments. He means "on what the Torah is written", i.e. the parchments;

(SUMMARY: The Ran explains why now, we hold that in the entire Beraisa, it is on the ground.)

Explanation: The entire Beraisa is when it is on the ground. Even so, when he says "in what is written in it" his words are fulfilled.

In the Seifa, it teaches "in it, and in what is written in it", his words are fulfilled. We do not need this for itself, rather, to teach about the Reisha, that it is on the ground.

Surely in the Seifa, since he said "in it, and in what is written in it", even if it is on the ground it helps;

Inference: When he said only "in what is written in it", even if it is on the ground, it helps. According to this Ukimta, we hold that it is unreasonable to establish the [clauses of the] Beraisa in two ways.

RAN DH Hachi Garsinan v'Iy Bo'is... [TRANSLATION: And if you want, you can say that the Seifa teaches that since he holds it in his hand, even though he said only 'in it', he is like one who said 'in what is written in it.']

Explanation #3: The Rambam brought this law regarding one who swore and one who vowed;

שסובר הרב ז"ל דשמעתין בנשבע עסקינן מדאמרינן דעתיה אהזכרות שבה ובירושלמי עסקינן במתפיס בנדר ושניהם אמת.

He holds that our Sugya discusses one who swore, since we say that he intended for the Azkaros. The Yerushalmi discusses Hatfasah in a Neder. Both of them are true.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. קונם שאני ישן

(a)

Mishnah: Konam that I will sleep.

בכולהו גרסינן שאני בלא יו"ד

Remark: In all of them, the text says 'she'Ani', without a Yud (and not 'she'Eini').

ובשבועות גרסינן שאיני ביו"ד

Distinction: In (the next Mishnah (15b, which discusses) Shevu'os, the text says 'she'Eini', with a Yud.

דמשום דנדרים אוסר (כן נראה להגיה) חפצא אנפשיה תני להו בלשון שאני כלומר מה שאני

Explanation: Because in Nedarim, one forbids the item to himself, it teaches 'she'Ani', i.e. what I [will sleep, speak...];

ומשום דבשבועות אסר נפשיה תני להו בלשון שאיני ביו"ד

And because in Shevu'os, one forbids himself, it teaches 'she'Eini' (that I will not...)

והאי דתנא בנדרים הרי זה בבל יחל דברו ובשבועות קתני אסור

אבל באיסורו כיון שהוא עיקר האיסור אף על פי שאינו אסור מצד עצמו אלא בצרופו של יום ראשון אפילו הכי מזדהר.

Distinction: However, the Isur, since it is the primary Isur, even though it is not forbidden by itself, rather, only together with [what he did on] the first day, even so, he is careful.

Explanation: [If he said Konam] "what I will sleep", is this a Neder?!

נראה בעיני דהכי פירושו דאילו מצינן למימר דהכי קתני לא תיקשי מתני' לרב יהודה

It seems to me that it means that as follows. If we could say that so it taught, our Mishnah would not be difficult for Rav Yehudah;

דמצינן למימר דמתניתין לאו בתנאה ואיסורא עסקינן אלא בנודר שאני ישן לחוד

We could say that our Mishnah does not discuss a stipulation and Isur, rather, he vowed only [Konam] "what I will sleep."

וקמ"ל דאע"ג דליכא הכא חפצא חייל נדרא

The Chidush would be that even though there is no object, the Neder takes effect.

אבל לא מצינן למימר הכי דהתניא דכי האי גוונא לא חייל.

However, we cannot say so, because a Beraisa teaches that in such a case, it does not take effect!

Gemara: Rather, he said 'Konam are my eyes in sleep.'

כלומר וקא משמע לן דנהי דאי אפשר בלא שינה אפילו הכי אי ישן שלא מתוך האונס הרי זה בלא יחל

Explanation: I.e. the Chidush is that granted, it is impossible without sleep, even so, if he sleeps not amidst Ones, Lo Yachel applies.

Gemara: I.e. in such a case, does the Neder take effect at all, since he cannot fulfill it at the end?

ונקט לישנא דמי שבקינן ליה משום דבעי לאתויי עלה הא דרבי יוחנן שהיא בשבועה ובשבועה שייך האי לישנא

It used the expression "do we let him?!" because we want to bring R. Yochanan's teaching, which discusses a Shevu'ah, and this expression applies to a Shevu'ah.

כלומר דלא שבקינן מלהלקותו עד דעבר איסור בל יחל אלא לאלתר מלקין אותו משום שבועת שוא

I.e. we do not refrain from lashing him until he transgresses Bal Yachel. Rather, we lash him immediately for a vain oath.

ואף על גב דבנדר לא שייך הכי דנדר שוא לא אשכחן דאסור

Implied question: This does not apply to a Neder. We do not find an Isur of a vain Neder!
