OFFERING KORBANOS NOT NEEDED FOR NEZIRUS (Yerushalmi Perek 4 Halachah 4 Daf 18a)

úðé àéï èòåðéï ìà ìçí åìà æøåò

(a)

(Beraisa): [The Shelamim] does not need bread or [Tenufah of the] Zero'a.

ø' áåï áø çééä áøéä ãøáé ùîòåï áòé ùìîéí áàéï ìàçø îéúä îäå ùéèòðå ìçí

(b)

Question (R. Bun bar Chiyah brei d'R. Shimon): [A Nazir's] Shelamim is brought after death. Does it need bread?

çæø åîø åëï áçééí ìà òì äáèìä äï áàéï àú àîø èòåðéï ìçí åëà èòåðéï ìçí

(c)

Answer (R. Bun bar Chiyah): Also in his lifetime - does it not come l'Vatalah (not for Kaparah, e.g. he lost it, separated another and offered it, and then found the first), and you say that it needs bread? Also here, it needs bread!

à"ø éåñä ôùéèä ìøáé áåï áø çééä áùìîéí äáàéï ìàçø äôøä ùàéï èòåðéï ìçí îä áéï îéúä îä áéï äôøä

(d)

Question (R. Yosah): It is clear to R. Bun bar Chiyah that Shelamim brought after Hafarah does not need bread (like our Mishnah says, but he did not settle his question from here). What is the difference between death and Hafarah? (We explained this like PNEI MOSHE.)

îéúä ëáø ðøàå ìäéèòï ìçí äôøä ìà ðøàå ìäèòï ìçí

(e)

Answer: [After] death, [the Korban] was already proper to [be offered and] require bread. [After] Hafarah, it was not proper to require bread.

úðé àùí ìàçø äôøä àéï àùí ìàçø îéúä îúä àéï àùîä ÷øá äéôø ìä àùîä ÷øá

(f)

(Beraisa): Asham [Nazir Tamei is brought] after Hafarah. [Asham] is not brought after death. If she died, her Asham is not offered. If he annulled her, her Asham is offered.

îúä àéï àùîä ÷øá ùàéï ìê àùí ÷øá ìàçø îéúä äéôø ìä àùîä ÷øá ùàéï ìê àùí áà òì äáèìä ëæä

(g)

If she died, her Asham is not offered, for Asham is offered after death. If he annulled her, her Asham is offered, for you do not have an Asham offered l'Vatalah (e.g. after Kaparah) like this (this is the only case in which it is offered, even though it is not Mechaper - PNEI MOSHE).

úîï úðéðï îåúø ðæéøéí ìðæéøéí îåúø ðæéø ìðãáä

(h)

(Mishnah): Mosar (excess money Hukdash for Korbanos of) Nezirim is for [Korbanos of other] Nezirim. Extra Mosar Nazir goes to Nedavah;

àîø øá çñãà åäåà ù÷øáä çèàúå áñåó åàí ÷øáå ùìîéå áñåó îåúøå ùìîéí

(i)

Opinion #1 (Rav Chisda): This is if he offered the Chatas at the end (so the extra money is Mosar Chatas, which goes to Nedavah), but if he offered the Shelamim at the end, the Mosar is [Mosar Shelamim, which is offered for] Shelamim.

àîø øáé æòéøà àôéìå ÷øáå ùìîéå ìáñåó äìëä àçú äéà áðæéø ùúäà îåúøå ðãáä

(j)

Opinion #2 (R. Ze'ira): It is even if he offered the Shelamim at the end. It is one [uniform] Halachah (tradition from Sinai) about a Nazir, that the Mosar is Nedavah.

îúðéúà îñééò ìãéï åîúðéúà îñééò ìãéï

(k)

A Beraisa supports this one, and a Beraisa supports this one.

(l)

Support (for R. Ze'ira - Beraisa): These are Ma'os Stumim - any case in which Demei Chata'os ha'Mesos are mixed in. And even if [the owner had] separated the Demei Chatas from it, it is Ma'os Stumim.

(m)

Support (for Rav Chisda - Beraisa): [If one said] 'these [coins] are for my Chatas, and the rest are for [the rest of] my Nezirus', and he died, Me'ilah applies to (i.e. if one used) all of them, and Me'ilah does not apply to part of them;

åìà àîø åàí îú éôìå áðãáä

1.

Observation: [The Beraisa] did not say that if he died, they fall to Nedavah!

àîø øá çñãà îåúø ìçí ðæéø éø÷á

(n)

(Rav Chisda): Mosar of Lechem Nazir is left to rot.

àîø øáé éåñé åéàåú ìä÷øéáå áô"ò àé àúä éëåì ùàéï ìê ìçí ÷øá áô"ò

(o)

Support (R. Yosi): This is proper! You cannot offer it by itself, for bread is not offered by itself;

ìä÷øéáå òí ðæéøåú àçøú àéï àú éëåì ùàéï ìê ðæéøåú áàä áìà ìçí

1.

You cannot offer it with another's [Korbanos] Nezirus, for there is no Nezirus without bread. (When the other accepted Nezirus, he already obligated himself to bring bread.)

i.

Note: SHIREI KORBAN questions this, for there is no Nezirus without Korbanos, yet one can shave on another's Korbanos! Also, the bread becomes Kadosh only through Shechitah. Beforehand it can be redeemed!

ìôåí ëï öøéê ìåîø îåúø ìçí ðæéø éø÷á

2.

Conclusion: Therefore, you must say that Mosar Lechem Nazir is left to rot.

Assumption: His Mosar Lechem and his Mosar Nechasim have the same law.

Rebuttal (R. Yosi bei R. Bun): His Mosar Nechasim are Kodshei Kodoshim. They go to Nedavah.

(r)

According to R. Yosi bei R. Bun, Shmuel, Rav Chisda and R. Elazar, the three of them said the same matter;

øá çñãà ääï ãäëà

1.

'Rav Chisda' refers to his teaching here (Mosar Nechasim go to Nedavah, for they are Kodshei Kodoshim);

ùîåàì ãîø øáé éåñé òã ãàðà úîï ùîòéú ÷ì øá éäåãä ùàì ìøáé ùîåàì äôøéù ù÷ìå åîú à"ì éôìå ìðãáä

2.

'Shmuel' refers to what R. Yosi said - when I was there (in Bavel), I heard Rav Yehudah ask R. Shmuel, if one separated his [half-]Shekel (that every man gives every year for Korbanos Tzibur, which are Kodshei Kodoshim) and he died [what is the law]? Shmuel told him, it goes to Nedavah.

3.

'R. Lazar' - Mosar Asiris ha'Eifah of a Kohen Gadol (his daily Minchah offering) - R. Yochanan says, it goes to Yam ha'Melach. R. Lazar says, it goes to Nedavah.
