"u'Re'ei Vaa'asei be'Savnisam ? ". Why did Hashem say to Moshe " ? be'Savnisam", and not 'ke'Savnisam"?

R. Bachye: Because it was impossible for Moshe to make an exact replica of what he saw on Har Sinai, since he saw a spiritual version of what he was now being asked to produce in physical form. 1 And, as opposed to 'ke'Savnisam', "be'Savnisam" implies similar only in certain regards only. 2

What is "asher Atah Mar'eh ba'Har" referring to?

Rashi and Rashbam: It is referring to the shape of the Menorah with all its details, which Moshe had difficulty in understanding. 1

Menachos, 29a: It is referring to the Aron of fire, the Shulchan of fire and the Menorah of fire which came down from Heaven and which Moshe ultimately copied. 2

Oznayim la'Torah: Since the Torah writes (not 'ke'Savnisam' or 'es Tavnisam', but) "be'Savnisam", Hashem was instructing Moshe to study the various forms that He was showing him again and again, until he mastered them. 3

This explains the Midrash Rabah, which relates how, after Moshe descended Har Sinai, he forgot what Hashem had shown him, so he turned back and asked Hashem to show him again - and how this happened a number of times.
