TOSFOS DH HA'ISHAH NIKNEIS

(Summary: Tosfos discusses why here and in some other places, the Tana inserts a 'Heh', and in others, he doesn't.)

(a)

Introduction to Question: Here the Tana adds a 'Heh', as he does in many other places in connection with 'Ish' and 'Ishah' ...

1.

Examples: Such as 'ha'Ishah she'Halchah' (Yevamos, Daf 114b), 'ha'Ishah she'Halach Ba'alah' (Ibid., Daf 87b), 'ha'Ishah she'Nis'armelah' (Kesuvos, Daf 15b) and 'ha'Ish Mekadesh' (later, Daf 41a).

(b)

Question: Why, in the Mishnah in Kesuvos) 'Besulah Niseis', does the Tana not say 'ha'Besulah Miseis'?

(c)

Answer: Because here he refers to a Pasuk - as if to say the woman who is specified in the Pasuk, since we find a woman mentioned in the Pasuk in connection with marriage, when it writes (in ki Seitzei) "When a man takes a woman ... " ...

1.

Answer (cont.): Whereas 'Besulah' does not refer to a Pasuk seeing as we do not find Besulah mentioned anywhere in the Torah in connection with marriage.

(d)

Question: The question remains however, why later (on Daf 14b) when the Mishnah talks about 'Eved Ivri', 'Eved Cana'ani' (on Daf 22b) an 'Amah Ivriyah' (on Daf 14b), the Tana does not add a 'Heh', seeing as they are all specifically mentioned in the Pasuk?

(e)

Answer #1: Perhaps a 'Heh' is not applicable to Eved and Amah, since they are are not so clear, seeing as he would have had to explain which one - an Ivri or a Cana'ani, an Ivriyah or a Cana'anis.

1.

Proof: Because by Yevamah, he does say 'ha'Yevamah'.

(f)

Answer #2: In any event, it is not such a Kashya, because the Tana tends to use whichever Lashon falls on his tongue ...

(g)

Proof: For so we find that sometimes he puts the act before the number, such as in the current case ...

1.

Examples: And by 'Besulah Niseis le'Yom ha'Revi'i', Esrog Shaveh le'Ilan bi'Shelosh Derachim' and 've'ha'Torah Nikneis be'Arba'im u'Shemoneh Devarim' (Avos, 6:5) ...

2.

Examples (cont.): And sometimes he puts the number before the act, such as 'ba'Asarah Ma'amaros (Nivra ha'Olam' [Ibid., 5:1]), 'Or le'Arba'ah-Asar Bodkin' (Pesachim, Daf 2a), 'Shiv'ah Yamim Kodem Yom ha'Kipurim (Mafrishin [Yoma, Daf 2a]) and 'bi'Sheloshah Devarim Shavu Gitei Nashim le'Shichrurei Avadim' (Gitin, Daf 9a).

2)

TOSFOS DH BEIS SHAMAI OMRIM B'DINAR

(Summary: Tosfos cites the source Mishnah of the Machlokes and queries it.)

(a)

Source: The Mishnah in Maseches Iduyos (4:7) learns it in connection with 'The leniencies of Beis Shamai and the stringencies of Beis Hillel' ...

(b)

Implied Question: And even though in a case where she accepted Kidushin from someone else, Beis Shamai is more stringent ...

(c)

Answer: The original She'eilah was not asked in that regard ...

1.

Precedent: Like we find in Yoma (Daf 80b) - 'When the She'eilah was asked, it was in connection with Og Melech ha'Bashan'.

3)

TOSFOS DH BI'PERUTAH U'V'SHAVEH P'RUTAH

(Summary: Tosfos explains why the Tana sees fit to mention both 'Perutah' and Shaveh P'rutah, and elaborates.)

(a)

Question: The Tana ought to have only mentioned 'be'Shaveh P'rutah' ...

1.

Precedent: Like the Mishnah in 'ha'Zahav' (Bava Metzi'a, Daf 55a) 'Chamishah P'rutos hein: ha'Hoda'ah be'Shaveh P'rutah, ve'ha'Ishah Miskadeshes b'Shaveh P'rutah'?

(b)

Answer: Because he mentioned 'Kesef' here, he needed to explain which Kesef - a Dinar according o Beis Shamai, and a P'rutah according to Beis Hillel.

1.

Answer (cont.): And in order that we should not err and say that Kesef is Davka and not Shaveh Kesef, as the Gemara learns 'Kichah' 'Kichah' from S'dei Efron, where it says "Kesef", he adds 'Shaveh Kesef.

(c)

Question #1: From where do we know that 'Shaveh Kesef ke'Kesef' ...

1.

Source: Since later (on Daf 8a) the Gemara requires by Eved Ivri "Yashiv" to include 'Shaveh Kesef ke'Kesef' ...

(d)

Question #2: And with regard to Pidyon ha'Ben, where the Torah writes "Kesef", yet the Gemara relates later (Ibid.) that Rav Kahana took a Sudar (the head-gear of a Talmid-Chacham) as Pidyon ha'Ben; from where do we know that 'Shaveh Kesef ke'Kesef'?

(e)

Answer to Question #2: However the learns it from a 'K'lal u'Perat u'Chelal'.

(f)

Question #3: But regarding Erchin, by which the Torah writes "Kesef" ...

(g)

Question #4: And Hekdesh, by which the Mishnah in Erchin (Daf 27a) states, in connection with 'Someone who declares his field Hekdesh, that 'Hekdesh can be redeemed with Kesef and with Shaveh Kesef', from where do we know that 'Shaveh Kesef ke'Kesef'?

(h)

Answer to Question #4: However, by Hekdesh too, it is possible that we Darshen a 'K'lal u'Perst u'Chelal' ...

1.

Proof #1: Because Hekdesh cannot be redeemed with Karka, as the Gemara says in 'ha'Zahav' (Bava Metzi'a, Daf 54a) 'They said that Hekdesh cannot be redeemed with Karka, since the Torah writes " ... he shall give the money and it will be his" ...

2.

Proof #2: And later (on Daf 5a) too, the Gemara says that one cannot redeem Hekdesh and Ma'aser Sheini with a Sh'tar ...

(i)

Question #1 & #3 (cont): But from where do we know 'Shaveh Kesef ke'Kesef regarding Kidushin and Erchin?

(j)

Answer: We learn it from Eved Ivri.

(k)

Introduction to Question: By Nezikin the Torah also writes "Kesef Yashiv li'Be'alav, and the Gemara in the first Perek of Bava Kama (Daf 7a) Darshens "Yashiv", to include Shaveh Kesef ke'Kesef.

1.

Question: In that case, Nezikin and Eved Ivri are 'Two Pesukim which teach us the same thing, and we cannot learn from them.

(l)

Answer: Both are necessary; because if the Torah had written only Eved, we would not be able to learn Nezikin from it ...

1.

Reason #1: Since we find that the Torah is particular there regarding 'Meitav' (the best of his property), and we would therefore have thought that Kesef is Davka, but not Shaveh Kesef; Hence the Torah needs to write "Kesef Yashiv" by Nezikin.

(m)

Answer (cont.): And by Eved Ivri too, we need a Pasuk, and we cannot learn it from Nezikin ...

1.

Reason: Since we would then have thought that Eved is similar to Nezikin, and that if one acquired him with Karka, it requires Meitav - therefore both are necessary.

(n)

Reason #2: Alternatively, had the Torah written only by Eved, we would have thought that it is lenient by him, to enable him to redeem himself even with Shaveh Kesef, in order not to degenerate among the idolaters, but by Nezikin, where this aargument is not applicable, it is not.

1.

Reason #2 (cont.): Whereas had it written it only by Nezikin, we would not have learned Eved from it - to say 'Shaveh Kesef ke'Kesef' even by him ...

2.

Reason #2 (concl.): Since he caused his own sale, by dealing with Sh'mitah-produce, as Rebbi Yossi b'Rebbi Chanina explains later on (on Daf 20a), and we would therefore have thought to be stringent with him, by confining his redemption to Kesef and not Shaveh Kesef.

(o)

Implied Question: And the reason that we learn Pidyon ha'Ben and Hekdesh from a Pasuk, and not from Nezikin and Eved Ivri is ...

(p)

Answer: Because it comes to preclude Karka and Sh'taros, with which one cannot redeem Adam and Hekdesh.

4)

TOSFOS DH V'KAMAH HI P'RUTAH

(Summary: Tosfos explains why the Tana does not deem it necessary to define a Dinar.)

(a)

Implied Question: The Tana declines to explain the value of a Dinar is ...

(b)

Answer #1: Because everybody knew that a Dinar is one twenty-fourth of a golden Dinar, as the Gemara states at the beginning of 'ha'Zahav' (Bava Metzi'a, Daf 44b) ...

1.

Answer #1 (cont.): Whereas the Gemara later (on Daf 12a) cites a Machlokes as to the value of a P'rutah, which is sometimes worth less and sometimes, more.

(c)

Answer #2: Moreover, it is more important to explain the opinion of Beis Hillel, like whom we Pasken.

5)

TOSFOS DH ECHAD MI'SHEMINIS B'ISAR

(Summary: Tosfos clarifies the statement.)

(a)

Clarification: When the Isarim are stable ...

1.

Clarification (cont.): Because when the Isarim becme devalued, the P'rutah is only one sixth of an Isar, as the Gemara explains later (Ibid.)

6)

TOSFOS DH ITALKI

(Summary: Tosfos explains the word 'ha'Italki', including the extra 'Kuf'.)

(a)

Clarification: Rabeinu Tam explains 'Italki', based on Italy of the Greek Empire.)

(b)

Refuted Question: Nor need one wonder about the extra 'Kuf' ...

(c)

Precedent: Like we find in Ezra (4) "Shoshanchei", based on 'Shushan'.

7)

TOSFOS DH HA'YEVAMAH NIKNEIS ETC.

(Summary: Tosfos explains why the Tana declines to state the numbers as he did in the Reisha, and elaborates.)

(a)

Question: Why does the Tana not mention the number like it did above, and say 'Nikneis be'Derech Echad ve'Koneh es Atzmo bi'Shenei Derachim'?

(b)

Clarification: Because just as the the number above comes to preclude, as the Gemara explains, so too would the number here ...

1.

Clarification (cont.): Since the Reisha precludes Kesef and Sh'tar, as the Gemara explains later (Daf 14a) - 'Bi'ah concludes (the Kinyan) but not money or Sh'tar'

2.

Clarification (cont.): Whereas the number in the Seifa precludes too, that we should not learn a Kal va'Chomer from Ishah ...

3.

Clarification (concl.): As the Gemara explains (Ibid.) that we Darshen ' "Na'alo" (his shoe), yes, but nothing else'.

(c)

Answer: The Tana will not mention the number for only one item.

(d)

Implied Question: And even though in connection with Esrog, the Tana does state 'Esrog Shaveh le'Ilan bi'Sheloshah Derachim. u'le'Yerek be'Derech Echad' ...

1.

Answer: There the Tana explains the differences between them.

(e)

Explanation #1: And since he did not mention the number with regard to Yevamah, he does not take the trouble to mention the number by Eved Ivri and Cana'ani either.

(f)

Explanation #2: Alternatively, it is because it is not necessary to mention the number by them since there is nothing to preclude.

8)

TOSFOS DH MAI SH'NA HACHA DI'TENAN HA'ISHAH NIKBEIS

(Summary: Tosfos offers an alternative answer and refutes it.)

(a)

Alternative Answer: The Gemara could have answered 'Because he wants to presnt the Seifa "And she acquires herself ... ", where the Lashon 'Kidushin' is not appropriate.

1.

Precedent: Similar to the Gemara's answer shortly (on Amud 'Beis').

(b)

Refutation: However ha'Rav R. David points out that it could have said (in the Seifa) 've'Niteres bi'Shenei Derachim', since the Lashon 'Heter' is applicable by Kidushin.

9)

TOSFOS DH MISHUM D'KA'BA'I L'MISNI KESEF

(Summary: Tosfos clarifies the Gemara's answer, despite the fact that the Tana then seems to be learning two because of one, and elaborates.)

(a)

Implied Question: Here the Gemara could not ask 'Since when does the Tana mention two on acount of one?', as it asks further on ...

(b)

Answer #1: Since the Lashon 'Kinyan' applies to Sh'tar and Bi'ah as well.

(c)

Explaining the Gemara's Kashya: And it only queries the Lashon 'Kinyan' because later the Tana uses a Lashon 'Kidushin', and here, a Lashon 'Kinyan'.

(d)

Answer #2: Alternatively, by Sh'tar too, we find the Lashon 'Kinyan' in the Pasuk, which writes (in Yirmiyah, 32) "va'Ekach es Seifer ha'Miknah".

10)

TOSFOS DH V'KESEF MINALAN GAMAR KICHAH KICHAH MI'SEDEI EFRON

(Summary: Tosfos explains why the Gezeirah Shavah is necessary.)

(a)

Question: Why is all this necessary? All it needed to say was 'Kedef is called a Konyan, since the Torah writes "Nasati Kesef ha'Sadeh Kach mimeni"? ...

1.

Question (cont.): And "ha'Sadeh asher Kanah Avraham", or "Sados ba'Kesef Yiknu"?

(b)

Answer: That would not suffice, because granted "Kesef ha'Sadeh" is called a Kinyan; however, that does not mean that Kesef is called a Kinyan by Ishah.

1.

Answer (cont.): That is why it is necessary to bring a proof that the Kesef from which we learn Ishah is called a Kinyan.

11)

TOSFOS DH U'CHESIV HASAM NASATI KESEF HA'SADEH KACH MIMENI

(Summary: Tosfos discusses why the Tana is satisfied with the Lashon 'Kichah in spite of several probems.)

(a)

Clarification: The Gemara is only concerned with finding a Lashon of 'Kichah'

(b)

Refuted Question: Even though the cases are not similar, since the Kichah in our Sugya refers to the money of the field, whereas the 'Kichah' concerning the woman refers, not to the money of the woman, but to the woman herself.

(c)

Question: Why does the Tana not state 'ha'Ishah Nikachas', which is more similar to the Lashon of the Pasuk, which says "Ki Yikach"?

1.

Precedent: And the Mishnah in Eruvin too, states 'ha'Kol Nikach be'Kesef Ma'aser'?

(d)

Question (cont.): What's more, the Lashon 'Kichah' is appropriate even with regard to Bi'ah, as the Pasuk writes (in Vayikra 20) "ve'Ish asher Yikach es Achoso"?

(e)

Answer: It would not be applicable in the Seifa, which could not have said 've'Lokachas Atzmah b'Shenei Derachim'.

2b----------------------------------------2b

12)

TOSFOS DH I NAMI SADOS B'KESEF YIKNU

(Summary: Tosfos explains why the Gemara does not rather cite various Pesukim in the Chumash.)

(a)

Implied Question: The Gemara does not cite Kinyan that is written in the Torah "mi'Kesedf mi'Kenaso" (Vayikra 25) ...

(b)

Answer: Because it wants to cite Kinyan in connection with a field.

(c)

Question: In that case, why did it not cite "ha'Sadeh asher Kanah Avraham" (Bereishis 25)?

(d)

Answer: One cannot learn from there, since the Pasuk may well mean th field that Avraham acquired with Chazakah or with a Sh'tar, seeing as it is not written specifically that he bought it with money.

13)

TOSFOS DH D'ASAR LAH A'KULI ALMA K'HEKDESH

(Summary: Tosfos explains the ramifications of thisstatement and elaborates.)

(a)

Clarification: And 'Harei At Mekudeshes Li' means 'to be mine' - i.e. 'You are 'sanctified' forever for me'.

(b)

Support: Like the Gemara in Nedarim (Daf 48a) 'Harei hein Mekudashin la'Shamayim' - 'to belong to Hashem'.

(c)

Simple Explanation: And the simple meaning of 'Mekudeshes li' is 'singled out' and 'designated for me'.

(d)

Chidush: But if one were to say 'Talis Zu Mekudash li', it would probably be meaningless ...

(e)

Reason: Because it is specifically with regard to a woman that it mis, since, by virtue of the fact that she is designated to him, she becomes forbidden to everybody else, whereas regarding a loaf of bread or a Talis one cannot say that.

14)

TOSFOS DH I TANA KONEH HAVAH AMINA BA'AL KORCHAH

(Summary: Tosfos reconciles this with the fact that the Tana states 'ha'Ish Mekadesh' an ha'Yevamah Nikneis.)

(a)

Implied Question: And even though the Tana states 'ha'Ish Mekadesh', implying against her will ...

(b)

Answer: That is after he has already taught us here that he cannot betroth her against her will.

(c)

Question: And the reason that he says 'ha'Yevamah Nikneis', and not 'ha'Yavam Koneh', whih implies against her will, is ...

(d)

Answer: Because, since he said 'ha'Ishah Nikneis', he says in the Seifa 'ha'Yevamah Nikneis' ...

1.

Answer (cont.): Because 'Nikneis' implies both with her consent and against her will.

15)

TOSFOS DH LISNI SHELOSHAH

(Summary: Tosfos clarifies the Kashya.)

(a)

Reason: Because the whole Torah was said in the masculine.

16)

TOSFOS DH KASHU K'RA'I AHADADI

(Summary: Tosfos reconciles this with many places where words appear in both masculine and feminine form.)

(a)

Question: Even though we find many words that appear both in the masculine and in the feminine forms ...

1.

Examples #1: Such as "Yad Shelu*chah* elai ve'Hineh bo Megilas Seifer" (Yechezkel 2); "ha'Shemesh Ba'ah" (Bereishis 15) & 'ha'Shemesh Yatza" (Ibid. 19); "ha'Machaneh ha'*Achas* ve'Hika*hu*" (Ibid. 32) ...

2.

Examples #2: And in the Lashon Chachamim too, we find 'Ner she'*Kavsah*, Ein Zakuk lah' (Shabbos, Daf 44a) & 'Ner she'Kavah' (ibid., Daf 44a); 'Halchah Chamorcha Tarfon' Sanhedrin, Daf 33a) & 'ha'Socher es ha'Chamor, ve'Hivrikah ve'HOlichah ba'Har (Bava Metzi'a, Daf 78a), on the one hand, and on the other 'Lo Hispik Ba'al ha'Parah Limshoh es ha'Chamor a she'*Meis* ha'Chamor (Kesuvos, Daf 76a)' ...

3.

Examples (concl.): And there are many other similar cases.

(b)

Answer #1: Nevertheless, wherever it is possible to explain it, the Gemara does.

1.

Answer #1 (cont.): In fact, even in the Pesukim, there is some D'rashah or other.

(c)

Answer #2: Alternatively, after seeing how the Mishnahs changed the wording after citing two Pesukim, the Gemara wanted to go into the matter and explain why.

17)

TOSFOS DH HACHA D'VE'TORAH KA'I V'TORAH IKRI LASHON NEKEIVAH

(Summary: Tosfos reconciles this with Milchamah, where it seems, one could say the same thing.)

(a)

Question #1: Milchamah too, sometimes appears in the feminine, as the Torah writes (in Shmuel 1, 31) "va'Tichbad ha'Milchamah el Sha'ul" and "va'Tosef ha'Milchamah" (Ibid. 19)?

(b)

Question #2: Furthermore, just as the Gemara says 'It is the way of a man to engage in warfare, but not of a woman', so too, is it the way of a man to study Torah but not of a woman?

(c)

Answer: They are not comparable, since here, it is referring to the Torah itself, which the Pasuk calls 'Derech', and not to its students ...

1.

Answer #2: Whereas the Pasuk "Yeitz'u Eilecha" (Devarim 29) refers to the soldiers, as they are the ones whose way it is to engage in warfare.

18)

TOSFOS DH MIPNEI MAH AMRAH TORAH KI YIKACH ETC.

(Summary: Tosfos (Yeshanim) explains the Kashya.)

(a)

Clarification: Which implies against her will, rather than "ki Silakach" which implies with her consent] (Tosfos Yeshanim).

19)

TOSFOS DH ESROG SHAVEH L'ILAN BI'SHELOSHAH DERACHIM

(Summary: Tosfos discusses Rashi's explanation of the Mishnah, and queries it.)

(a)

Clarification: Rashi explains 'regarding Orlah, R'vai and Shevi'is' ...

1.

Clarification (cont.): Because regarding the fruit of Shevi'is, we go after the Chanatah (when the fruit is formed) like that of trees, and not after the Lekitah (the picking) like vegetables.

(b)

Inference: This implies that R'vai is applicable to Esrog ...

(c)

Question: In which case there is a Kashya from here on the opinion at the beginning of 'Keitzad Mevorchin' (B'rachos, Daf 35a) that states 'Kerem R'vai' ...

1.

Question (cont.): Implying that R'vai does not apply to other trees?

(d)

Answer #1: What the Tana there means is that Wherever he can, he learns 'Kerem R'vai', but there where one can't, he does not argue on it, since they do not argue there to say that no Tana holds of 'Neta R'vai' ...

1.

Answer #1 (cont.): Because it may be that, aside from the case of Esrog, there is a Machlokes Tana'im somewhere, and they are only arguing there with regard to establishing the Mishnahs at the end of Ma'aser Sheini and in other places ...

2.

Answer #1 (concl.): Whether they go according to the opinion that holds (in B'rachos, Daf 35a) 'Neta R'vai', or like the opinion that holds there 'Kerem R'vai - to know like whom is the Halachah.

(e)

Answer #2: There are others however, who explain that the opinion that holds Kerem R'vai, concedes that it applies to other trees mi'de'Rabbanan, and that the current Sugya is speaking mi'de'Rabbanan.

(f)

Ramifications: And the matter has ramifications ...

1.

Opinion #1: Because if they argue to the effect that the one who holds Kerem R'vai is Davka, but that by other plants there is no R'vai at all, even mi'de'Rabbanan ...

2.

Opinion #1 (cont.): The Gemara states in Shabbos (Daf 139a) that 'The Halachah in Chutz la'Aretz is like the opinion that is lenient in Eretz Yisrael', in which case nowadays in Chutz la'Aretz, the Din of R'vai will not apply to other trees ...

3.

Opinion #2: Whereas if if both opinions agree that R'vai applies to other trees mi'de'Rabbanan, it will also apply in Chutz la'Aretz mi'de'Rabbanan.

(g)

Introduction to Question: And when Rashi says 'Regarding Shevi'is, we go after the Chanatah, and not after the Lekitah, like vegetables', this implies that by vegetables we go after the Lekitah with regard to Shevi'is.

(h)

Mishnah in Shevi'is: He was not careful however, as in Maseches Shevi'is (9:1) the Mishnah writes 'All Sefichim (plants that grow wild) are permitted with the exception of Sefichim of cabbages'.

(i)

Question: And Rabeinu Nisim queries this from the Sugya in Pesachim, where the Tana says the opposite?

(j)

Answer: And he answers that the Mishnah in Shevi'is which permits all Sefichim with the exception of Sefichim of cabbages is speaking about Sefichim of Erev Shevi'is which entered the Sh'mitah year ...

1.

Reason: Consequently, since most of them grew in the sixth year, they are considered sixth-year produce, and are permitted even to do business with ...

2.

Answer (cont.): Except for Sefichim of cabbages, with which one is forbidden to do business with - like the Din of Sh'mitah, or after the time of Biy'ur, even to eat ...

(k)

Reason: As the Yerushalmi explains - 'All vegetables one is able to distinguish between the new produce and the old, but not cabbages, which tend to grow in layers, and which therefore contain leaves that grew in the Sh'mitah ...

1.

Reason (cont.): And he may take from those forbidden leaves and claim that he took from the sixth-year leaves ...

(l)

Answer cont.): Whereas the Sugya in 'Makom she'Nahagu', which states that 'All Sefichim are forbidden' is speaking about Sefichim that grew in the Sh'mitah, according to Rebbi Akiva ... (cont. on the following Amud).
