Suggestion: She is Mekudeshes because he was Mekadesh her on condition that she pardon him, and she pardoned him, but her pardon was invalid.

Rejection: A Beraisa (Nazir 11a) says that if one said "I am a Nazir on condition that I may drink wine and become Tamei", he is a Nazir, and he is forbidden all Isurim of Nezirus, because he stipulated against what is written in the Torah;

Answer (Ri): Had we not learned from Tenai Bnei Gad u'Vnei Reuven (the stipulation that they will receive Eretz Gil'ad only if they fight in Eretz Kena'an), we would have thought that no Tenai can be Mevatel an act. Even if the stipulation was not fulfilled, the act takes effect;

Question: A Mishnah (Menachos 109a) says that if one said "I am a Nazir on condition that I will shave [and bring Korbanos Nazir] in Beis Chonyo (a place in Mitzrayim where people offered Korbanos), he must shave in the Beis ha'Mikdash. If he shaved in Beis Chonyo, he was Yotzei;

He says (means) "if it suffices in Beis Chonyo, I will toil." I.e. therefore if he wants to shave in the Mikdash, Nezirus takes effect on him;

If he cannot, or he does not want to toil, he never vowed with intent for this. It is revealed retroactively that he was not a Nazir.

"He was Yotzei" means that Nezirus did not take effect on him.

והשתא אמאי והא מתנה על מה שכתוב בתורה הוא דאין גילוח אלא במקדש

Summation of question: Why [didn't Nezirus take effect on him?] He stipulated against what is written in the Torah. Shaving is only in the Mikdash!

Question: Since stipulating against what is written in the Torah applies even to money, one should never be able to pardon his debt through a Tenai!

If he says "work with me today, and your dent is pardoned", this is stipulating against what is written in the Torah!

Proof: Even according to the opinion (Kidushin 13b) that a loan written in the Torah is like one written in a document [and one may collect it from sold property...]

That refers only to matters such as damages, Erchin and Pidyon ha'Ben. From reasoning, we would not obligate these, had the Torah not obligated them explicitly;

However, all agree that a loan [without a document] is not collected from sold property. It is not due to the Torah. It is logical that one must pay what he borrowed from him!

Also here, regarding She'er, Kesus v'Onah, only when he said "on condition that you have no claim from me for She'er, Kesus v'Onah", it is considered stipulating against what is written in the Torah;

However, if he says "on condition that you exempt me from She'er...", he is exempt.

Similarly, "on condition that you do not have Ona'ah" (rights to compensation for overcharging, is considered stipulating against what is written in the Torah only if he said) "you have no claim of Ona'ah against me." The same applies to "on condition that Shemitah not cancel my loan."

Answer #2: Damages are unlike Kidushin. Here, the reason is because there is not partial Kidushin. There is no Kidushin in which she does not have a claim against him for She'er, Kesus and Onah;

The Gemara concludes that according to Rav, a husband inherits mid'Rabanan, and Chachamim strengthened their words like Torah law.

This is because he can benefit from [the Metaltelin]. She will not be particular if he uses them for any business.
