DAF DISCUSSIONS - NIDAH 11

Michael Rubin asked:

R Yochanan says that if a woman has a cycle where it is 30, 30 , 25 , then agian on teh 3oth day (5 days after the 25th day), then eve nthough generally he woul dlook at teh 25the day on its ow, that is only where it is a ma'yan sasum. here he would attach teh 25th day to the thirtieth day and it would be as if sh bled on 3 consecutive times on the thirtieth day. my question is if on the next to consecutive months she bled on the sam eday of the month as the 25th day...could the first tiem she bled on tehat day be used to be oker a vest...but according to R' Yochonon he attached it to the thirtieth day...also...it we see ove rthe next three months that really that bleding on the 25ht day was a real flow (vha ra'yah teh next two), but if R' Yochonnon made it as if she bled on the 30th day 3 times that she would have a vest and would be dayah sha'atah when should have been mees le'es..... so what is the status of that 25th day in a mayan pasuach???

The Kollel replies:

This is a complicated Sugya. I will offer you the approach that is closest to the accepted Halachah (it is the generally accepted approach, althjough the CHAVOS DA'AS argues).

First, most Acharonim say that one can only be Kovea a Veses with a Ma'ayan Pasu'ach if it was a Veses li'Yemei ha'Chodesh. Only then can we say that the extra days (25-30) were a Tosefes Damim, but the Veses still stands. However, if the Veses was a Veses l'Haflagos, then there is no day 30, for 30 days did not pass without Dam. In your case, if it was a Veses l'Yamim, then she would be Kove'a a Veses b'Toch Veses , which means that she would be Choshesh for both days until she actually is Oker day 30 by not seeing Dam on that day. The Taz (YD 189) writes that although we allow for a possibility that 25 is merely Tosefes Damim and therefore she can be Kove'a day 30, still we regard day 25 as the Ikar Re'iyah, the primary sighting of Dam, and she is Kove'a a Veses for day 25.

Once again, there are many other Shitos. This is more or less the generally accepted approach.
