A RENTED HOUSE THAT FELL DOWN (Yerushalmi Halachah 9 Daf 31b)

משנה המשכיר בית לחבירו ונפל חייב להעמיד לו בית

(a)

(Mishnah): If one rented out a house to his friend and it fell down, he must replace it.

היה קטן לא יעשנו גדול גדול לא יעשנו קטן אחד לא יעשנו שנים שנים לא יעשנו אחד לא יפחות מן החלונות ולא יוסיף עליהן אלא מדעת שניהן:

If it was small, he should not rebuild it large and vice-versa. If there was one, he should not build two and vice-versa. He should not reduce the number of windows nor increase them unless they both agree to it.

גמרא ריש לקיש אמר במעמידו על גביו.

(Gemara) - Raish Lakish: (When the Mishnah taught that no changes may be made, it is when) he rebuilds in the same location. (However, in another location, he may make changes).

[דף ל עמוד ב (עוז והדר)] ר' יוחנן אמר באומר לו בית כזה אני משכיר לך.

R. Yochanan: When he said, "I am renting to you a house like this''.

אלא המשכיר בית לחבירו וביקש למוכרו.

Question: If one rented out a house to his friend and now wishes to sell the house...

א''ר אמי לא על דעת שזה ימות ברעב.

Answer #1 - R. Ami: It did not include if he was dying of starvation. (The rental could not have precluded the possibility that if the owner needs to sell the house in order to have sustenance, that he would be able to do so.)

רבי זירא ור' הילא תריהון מרין מכל מקום קני לו. אלא דו א''ל שיבקיה דשרי עד ימלא אנקלווסים דידיה.

(g)

R. Zeira/R. Hila: The owner may sell the house, but it is as if the owner told the buyer that he must allow the rental contract to be completed.

אתא עובדא קומי רבי ניסי ולא קביל.

Such a case came before R. Nisi and he did not accept (this opinion and he said that the buyer can force the renter to leave).

EXPECTATIONS FROM A SHARECROPPER (Yerushalmi Halachah 1 Daf 32a)

(a)

(Mishnah): If a sharecropper (who receives a field in Arisus, meaning that he takes a percentage of the earnings of the field for that year) received a field (to cultivate)...

In a place where the custom is to harvest, he must harvest; to rake, he must rake; to plough after harvesting, he must plough after harvesting; everything follows the custom of that locality.

כשם שחולקין בתבואה כך חולקין בתבן ובקש כשם שחולקין ביין כך חולקין בזמורות ובקנים ושניהן מספקין את הקנים:

Just as they (the owner and the sharecropper) divide the produce, they also divide the straw and stubble. Just as they divide the wine, they also divide the vine twigs and sticks, and they must both supply the sticks.

(Gemara): In a place where the custom is to harvest and he detached (which involves an even greater effort than harvesting)...

In a place where the custom was to detach and the sharecropper harvested...

The field owner can say to the sharecropper, "Leave and take with you the compost that you have left in my field''.

Tosefta: A sharecropper who received a field is required to harvest, bundle, thresh, winnow and select the produce.

החופר והכייל והסנטר שומרי העיר והאיקונומוס נוטלין שכרן מן האמצע

(g)

One who digs around fields, one who measures fields, one who supervises the borders of fields, city guards and the king's scribe (who records the tax obligations of the city's residents); since their payment is taken from the field, the owner and sharecropper pay half each.

הבייר והבלן והספר בזמן שבאין מכח האריס נוטלין מכח האריס מכח בעל הבית נוטלין מכח בעל הבית. אין משנין על מנהג מדינה:

The city digger, the bathhouse superviser and the city barber - when they are invited by the sharecropper, the sharecropper pays; when they are invited by the owner, the owner pays. The custom of the placeis always followed.

IRRIGATED AND RAIN-WATER FIELDS (Yerushalmi Halachah 2 Daf 32b)

משנה המקבל שדה מחבירו והיא בית שלחין או בית האילן יבש המעיין ונקצץ האילן אינו מנכה לו מחכירו

(a)

(Mishnah): A sharecropper who received a field from his friend and it is a Beis Shelachin (a field that contains a spring as rain water is not sufficient) or a Beis Ha'ilan (field of trees); if the spring dried up or the trees were chopped down, the sharecropper cannot reduce the quantity of produce that he must give them owner (since he did not make a stipulation).

[דף לא עמוד א (עוז והדר)] אם אמר לו השכר לי בית שלחין זו או שדה בית האילן זו יבש המעיין ונקצץ האילן מנכה לו מחכירו:

(b)

But if he said, "Rent me this Beis Shelachin or this Beis Ha'Ilan'' and the spring dried up or the trees were chopped down, he can reduce the amount that he gives to the owner.

גמרא א''ר יצחק בשיבש כל המעיין ברם אין הוה עמוק תרתין קומין ואת עביד שלשה קומין עמוק. יכלין מימר ליה לעי ביה והוא סגי:

(Gemara) - R. Yitzchak: (He can only reduce) if the entire spring dried up; but if instead of it being two storeys down it became three storeys down, the owner can tell him, "Just work harder and bring it''.

The Mishnah taught: If the trees were chopped down.

א''ר יצחק בשנקצץ כל האילן אבל אם נשתייר בו ממטע עשרה לבית סאה. יכיל מימר ליה בקדמיתא הוו דחשין ולא הוו עבדין סגין. ברם כדון הינון דלילין ועבדין סגין:

R. Yitzchak: (He can only reduce) if all of the trees were chopped down, but if there were still 10 trees in a 'Beis Seah' area, the owner can tell him, "(On the contrary!) Beforehand, the trees could not grow well, as they were too densely planted; now, they can produce better fruit.''
