YEARLY AND MONTHLY RENTAL FEES (Yerushalmi Halachah 8 Daf 31b)

משנה המשכיר בית לחבירו לשנה ונתעברה השנה נתעברה לשוכר

(a)

(Mishnah): If one rents out his house to a friend for a year (priced for the entire year) and it becomes a leap year (meaning that there is a second month of Adar), the extra month is included (in the price) for the renter.

השכיר לו לחדשים נתעברה השנה נתעברה למשכיר

(b)

If he charged per month and it became a leap year, the owner gains the (payment for the) extra month.

מעשה בציפורין באחד ששכר מרחץ מחבירו בשנים עשר זהב לשנה מדינר זהב לחדש ובא מעשה לפני רשב''ג ולפני רבי יוסי ואמרו יחלקו את חדש העיבור:

There was a case in Tzipori that a person rented a bathhouse from his friend for '12 gold dinars for a year, one gold dinar per month'. Rabban Shimon ben Gamliel and R. Yosi both ruled that the renter should pay half for the extra month.

גמרא והיכי. אם בשבא עליו בסוף החדש גביי ליה כולה ואם בשבא עליו בראש חדש א''ל פוק לך.

(d)

(Gemara): What was the case in Tzipori? If the landlord came to him at the renter at the end of the month, he can collect payment from the renter for the whole month. If he comes to him at the beginning of the month, he can tell him the renter to leave!

שמואל אמר כיני מתניתא בשבא עליו באמצע החדש.

(e)

Shmuel: Our Mishnah refers to when he came in the middle of the month.

רב אמר דינא דגר.

Rav: The landlord is correct.

R. Ila: Rav's words are understood according to the opinion of Ben Nanas who said that the latter phrase negates the first phrase (meaning that he should pay for the extra month as in the latter phrase, he charged him per month.)
