RIBIS WITH A GENTILE (Yerushalmi Halachah 5 Daf 22a)

ולווין מהן ומלוין אותן בריבית כו'.

(a)

The Mishnah taught in reference to a gentile: One may borrow from them and lend to them with ribis etc.

רבי אמר תושב האמור בעבד עברי איני יודע [דף כב עמוד ב] מה טיבו גר (צדק) [תושב] האמור בריבית איני יודע מה טיבו.

(b)

Rebbi: I do not know the nature of the 'toshav' mentioned in the pasuk about a Jewish slave (See Vayikra 25, 39/47, "If you brother will become poor with you...and he is sold to a toshav stranger''). I do not know the nature of the 'ger toshav' mentioned in the pasuk about the prohibition to charge ribis.

מלוה ישראל מעות עכו''ם מדעת העכו''ם אבל [לא] מדעת ישראל.

(c)

The Mishnah taught: One may lend a Yisrael with the money of a gentile with the gentile's agreement, but not with a Yisrael's agreement.

ישראל שלוה מעכו''ם וביקש להחזירם לו אמר לו ישראל אחר תנם לי ואני נותן כדרך שאת נותן לו אסור. ואם העמידו עם העכו''ם מותר.

(d)

If a Yisrael borrowed from a gentile and the Yisrael wishes to repay it, if another Yisrael said to him, "Give it to me and I will give it back the same way that you would'', it is prohibited. However, if the gentile took the money from the first Yisrael and gave it to the second one, it is permitted (as will be explained)...

עכו''ם שלוה מישראל וביקש להחזירם לו אמר לו ישראל אחר תנם לי ואני מעלה לו רבית מותר ואם העמידו אצל ישראל אסור.

(e)

If a gentile borrowed from a Yisrael and wishes to repay it, if another Yisrael said to him, "Give it to me and I will pay him ribis'', it is permitted. However, if the first Yisrael took it from the gentile and gave it to the second Yisrael, it is prohibited.

R. Yosi: This applies only when the first Yisrael actually did the transfer (rather than merely see it changing hands between them).

(g)

If a Yisrael borrowed from a gentile for ribis and the gentile borrowed from a Yisrael for ribis and the gentile converted; whether (the ribis) was included in the debt (and written into a document) before or after the conversion, the Yisrael may only collect the principle but not the ribis.

(אבל) עכו''ם שלווה מישראל [בין שזקפן עליו במלווה עד שלא נתגייר ובין משנתגייר גובה הקרן ואינו גובה את הריבית

(h)

If a gentile borrowed from a Yisrael )and he converted), if he included it in the debt, whether before or after the conversion, the Yisrael may collect only the principle but not the ribis.

אבל ישראל שלווה מן העכו''ם] ונתגייר אם עד שלא נתגייר זקפן עליו במלוה גובה הקרן והריבית משנתגייר גובה הקרן ולא הריבית.

But if a Yisrael borrowed from a gentile and he later converted, if he included it in the debt before the conversion, he may collect the principle and the ribis; if it was after the conversion, he may only collect the principle but not the ribis.

בר קפרא אמר גובה את הקרן ואת הריבית.

(i)

Bar Kafra: (In the first case, even if he included it in the debt before the conversion,) the Yisrael may also collect the ribis.

א''ר יעקב בר אחא טעמא דבר קפרא מכיון שאת מבריחו מן הריבית אף הוא נעשה גר שקר.

Reasoning (R. Yaakov bar Acha): If you do not allow the Yisrael to collect the ribis (after the gentile converted), the gentile will become a false convert (to avoid paying ribis).

לווה אדם מבניו בנותיו בריבית אלא שמחנכן בריבית.

(j)

Although strictly speaking a person may lend his children with ribis, the Chachamim prohibited it to prevent them from becoming accustomed to it.

אמר רב כגון אנא לרבה בר בר חנה ורבה בר בר חנה לי.

Rav: An example of this is between myself and Rabah bar bar Chanah (who were relatives, and although they seemed to give each other ribis, it was understood that it was not intended this way; rather, it was merely considered to be relatives giving gifts to each other).

לא יהא אדם לווה בשקל ומלוה בסלע אבל עכו''ם לווה בשקל ומלוה בסלע.

(k)

A person should not borrow from someone a shekel (on condition that next time) he will lend that person a selah, but with a gentile one may do so.

ישראל לוה מעכו''ם ועכו''ם מישראל וישראל נעשה לו ערב [דף כג עמוד א] ואינו חושש משום רבית.

(l)

If a Yisrael borrowed from a gentile or a gentile borrowed from a Yisrael, a Yisrael may be a guarantor on the loan and there is no concern for ribis.

ישראל שמינה עכו''ם אפוטרופא או סנטר מותר ללוות ממנו בריבית ועכו''ם שמינה ישראל אפוטרופא או סנטר אסור ללוות ממנו בריבית.

(m)

If a Yisrael appointed a gentile as his butler or guardian, one may borrow from him with ribis (and there is no concern that he is lending you a Yisrael's money). If a gentile appointed a Yisrael as his butler or guardian, one may not borrow from him with ribis.

מעות עכו''ם שהיו מופקדין אצל ישראל אסור ללוות בריבית. מעות ישראל שהיו מופקדין ביד עכו''ם מותר ללות ממנו בריבית

(n)

If a gentile's money was deposited with a Yisrael, one may not borrow from the Yisrael with ribis. If a Yisrael's money was deposited with a gentile, one may not borrow from the gentile with ribis.

זה הכלל כל שהוא באחריות ישראל אסור באחריות עכו''ם מותר

The general rule: Anytime a Yisrael is responsible for a gentile's money, one may not borrow from the Yisrael; if a gentile is responsible for a Yisrael's money, one may borrow from the gentile.
