FOR HOW LONG MUST ONE ANNOUNCE? (Yerushalmi Halachah 6 Daf 8b)

משנה עד אימתי חייב להכריז עד כדי שידעו בו שכנים דברי ר''מ

(a)

(Mishnah): How long must one announce a lost item? R. Meir - in order that the loser's neighbors will know about it.

רבי יהודה אומר שלשה רגלים ואחר רגל האחרון שבעת ימים כדי שילך לביתו שלשה ויחזור שלשה ויכריז יום א':

R. Yehudah: 3 festivals and then another 7 days after the last festival, so that the loser will have 3 days to go home (and discover that he lost it), 3 days to return and one day to announce (that he lost) it.

גמרא תני בראשונה היו מכריזין שלשה רגלים ואחר רגל האחרון שבעת ימים כדי שילך שלשה ויחזור שלשה ויכריז יום אחד.

(Gemara - Beraisa): Originally, they would announce for 3 festivals and another 7 days etc...

משחרב בית המקדש התקינו שיהו מכריזין שלשה ימים מן הסכנה ואילך התקינו שיהא מודיע לקרוביו ולשכיניו ודייו:

After the Temple was destroyed, they decreed that they should announce for 3 days. When it became dangerous (as the authorities required all lost items to be given to the king), they decreed that he must merely inform his relatives and neighbors.

CONDITIONS TO RETURN A LOST ITEM (Yerushalmi Halachah 7 Daf 8b)

משנה אמר את האבידה ולא אמר את סימניה הרי זה לא יתן

(a)

(Mishnah): If the loser mentioned the (type of) item and had not mentioned the identifying marks, the finder should not give it back.

הרמאי אע''פ שאמר את סימניה הרי זה לא יתן לו שנאמר עד דרוש אחיך אותו עד שתדרוש את אחיך אם רמאי הוא ואם אינו רמאי:

A swindler - even if he gave the identifying marks, he should not give it back (without him bringing witnesses). The reason one does not return a lost item without the loser giving identifying marks is because the pasuk states (Devarim 22, 2), "until your brother requests it'' - until you examine if you brother is a swindler or not.

(c)

(Gemara - question): What is the definition of a swindler?

עבד גרמיה מחזר מציאן ועבד חדא רבה וטבא.

(d)

Answer: He seems to return lost items, but he actually becomes wealthy through this.

היך הוא עביד רבה וטבא

Question: How does he become wealthy?

חמי ליה בירייתא מחזר מציאן ומפקידין גביה והוא נסיב כולא ואזיל ליה.

(f)

Answer: He becomes known as a trustworthy person and people deposit valuables with him. He then takes everything and leaves. (We learn from here that if someone is conspicuously returning lost items, perhaps he is a swindler who is trying to win the trust of people.)

ואית דמרין אזיל לכנישתא ושמע סימנין ואז לכנישתא חורי ואמר סימנא ונסב ליה:

Some explain that he goes to one synagogue and hears identifying marks and then goes to another synagogue and gives those marks and receives the object.

PRESERVING THE VALUE OF A LOST ITEM (Yerushalmi Halachah 8 Daf 8b)

משנה כל דבר שהוא עושה ואוכל יעשה ויאכל ודבר שאינו עושה ואוכל ימכור שנאמר והשבותו לו. ראה היאך תשיבנו לו

(a)

(Mishnah): If the lost item can work and eat (e.g. a donkey or an ox), it should work and be fed. If it cannot, it should be sold, as the pasuk states (ibid), "...and you return it to him'' - ensure that you are able to return it to him without his money being consumed.

מה יהא בדמים

(b)

Question: (If he sold it) what should be done with the money?

רבי טרפון אומר ישתמש בהן לפיכך אם אבדו חייב באחריותן

(c)

R. Tarfon: He may use them. Therefore, he is responsible for them if they became lost.

רבי עקיבה אומר לא ישתמש בהן לפיכך אם אבדו אינו חייב באחריותן:

(d)

R. Akiva: He may not use them. Therefore, he is not responsible if they became lost.

גמרא תני שלא יאכל עגל לעגלים וסייח לסייחין ותרנגול לתרנגולין.

(e)

(Gemara - Beraisa): ("You shall return it to him'')...that he should not have to consume (i.e. sell) one calf for the sake of the other calves, or one young horse for the other horses or one chicken for the other chickens.

עובדא הוה בחד בר נש דאשכח חמשה עגלין והוה מזבין ומוכלינון עד דקמון על חד.

(f)

There was once a case of a person who found five calves and he sold some of them in order to be able to feed the others, until eventually only one calf remained.
