FINDING AN ITEM IN THE DOORFRAME, A WALL OR AN INN (Yerushalmi Halachah 4 Daf 7b)

תני מצא בין פסים לפסים מן האגף ולפנים כלפנים מן האגף ולחוץ כלחוץ.

(a)

Beraisa: If he found it between the doorframes, from the threshold inwards is considered inside (and belongs to the house owner), from the threshold outwards is considered outside (and the finder may keep it).

(b)

(Concerning the Mishnah's case of finding an item inside a new wall) if the hole only opens inwards, even from the middle outwards, the items belong to the wall owner.

אם היה מפולש לחוץ אפילו מחציו ולפנים הרי אילו של מוצאיהן.

If the hole only opens outwards, even from the middle inwards, the items belong to the finder.

היה משכירן לאחרים אפילו מצא בתוך הבית הרי אילו שלו.

(c)

The Mishnah taught: If the owner rents it to others, even if he found it inside the house, he may keep it.

א''ר ירמיה בפונדק איתפלגון אבל בחצר כל עמא מודו שחייב להכריז.

R. Yirmiyah: We find a dispute between R. Shimon ben Elazar and Rabbanan when he rented out his house to a number of people (like an inn). (According to R. Shimon ben Elazar, since a number of people used the house, even though they were all Jews, the owner of the item will give up hope of ever retrieving it as he will assume that it was taken by a dishonest person.) However, in the courtyard of the inn, where people are just passing through, all agree that he must announce it.

R. Yosi: They disagree over a courtyard, but all agree that if it was found inside the inn, he may keep it.

FINDING AN ITEM IN A STORE (Yerushalmi Halachah 5 Daf 7b)

משנה מצא בחנות הרי אילו שלו

(a)

(Mishnah): If he found it in a store, he may keep it.

בין התיבה לחנוני הרי הוא של חנוני

(b)

If it was between the table and the shopkeeper, it belongs to the shopkeeper.

לפני השולחני הרי הוא שלו

(c)

If he found money in front of (i.e. in the space of the customers) the money changer, he may keep it.

בין הכסא ולשולחני הרי הוא של שולחני

(d)

If it was between the chair and the money changer, it belongs to the money changer.

לקח פירות מחבירו או ששולח לו חבירו פירות ומצא בתוכו מעות הרי אילו שלו

(e)

If a person bought produce from his friend or his friend sent him produce and he found money inside it, he may keep it.

ואם היו צרורין נוטל ומכריז

(f)

If the money was wrapped, he must take it and announce it (as the knot or quantity of produce is an identifying mark).

אף השמלה היתה בכלל כל אילו ולמה יצאת להקיש אליה אלא מה השמלה מיוחדת שיש בה סימנין ויש לה תובעין אף כל דבר שיש לו סימנין ויש לו תובעין חייב להכריז

The case of 'a dress' in the pasuk (Devarim 22, 3) was also part of the general rule, so why did the pasuk mention it separately? To compare other things to it - just as a dress has identifying marks and an owner, so too any item that has identifying marks and the owner wishes to retrieve it must be announced.

[דף ח עמוד א] גמרא אמר רבי לעזר כיני מתניתא על גבי כסא שלו ע''ג תיבה שלו.

(Gemara - R. Elazar): We can understand from the Mishnah that if it was found on top of a chair or on the table, he may keep it.
