(Mishnah): Some things can create a chazakah and some things cannot...

If a person stood an animal, an oven, a stove, millstones, breed chickens or put manure in a courtyard, it does not create a chazakah. (Since people are not particular about these things, the owner would not have protested.)

But if he made a partition ten tefachim tall for his animal, or his oven, or his stove, or his millstones; or he brought chickens into the house, or he made a place for manure three tefachim deep or three tefachim tall, it does create a chazakah.

(Gemara) - R. Elazar: Partners are accustomed to allow each other to breed chickens (so doing so does not create a chazakah).

Question (R. Yosi): The Mishnah (in Maseches Nedarim) does not say this...(If partners vowed that they cannot benefit each other) both of them may not stand millstones or an oven or breed chickens. (The Gemara does not resolve this question.)

R. Elazar: If a person bred chickens in another person's courtyard, it creates a chazakah.

R. Yosi: This is correct, as either way, if he has permission to do so, he is doing so; if not and he nevertheless did it and the owner did not protest, this creates a chazakah.
