BAVA BASRA 2-8 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to Rav Weiner -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

TOSFOS DH La Shalit Lemirmei Aleihom

תוספות ד"ה לא שליט למרמא עליהם

(SUMMARY: Tosfos explains how we learn from there.)

לפי שהיו עסוקים במלאכת שמים בבנין בית המקדש ה"נ אין להטיל מס על לומדי תורה.

Explanation: Because they engaged in work of Shamayim, i.e. building the Beis ha'Mikdash (one may not tax them). Similarly, one may not tax those who learn Torah.

Explanation #1 (Rashi): This is a tithe of animals and grain.

(b)

Explanation #2 (R. Chananel): This is a gift of a meal to the ruler who passes from place to place. Every city gives to him a meal;

Explanation (R. Chananel): The words connote grace from Hash-m. "Ifra" is like "we will spread an Apiryon (canopy) for R. Shimon (Bava Metzi'a 119a);

הורמיז שם שכינה כי ההיא דס"פ אחד דיני ממונות (סנהדרין דף לט. ושם ד"ה דהורמיז) מפלגא דידך ולעיל דהורמיז בזיי"ן מפלגא ולתחת דהורמין בנו"ן כמו הורמין בר לילתא לקמן (דף עג.).

"Hormiz" is the name of the Shechinah, like it says in Sanhedrin (39a, that a witch told Ameimar) the upper half of your body belongs to Hormiz spelled with a Zayin, and the lower half of your body belongs to Hormin spelled with a Nun (a Shed (demon)), like Hormin bar Lilasa (below, 73a).

TOSFOS DH k'Kelev uch'Orev

Explanation: This is like Rashi explained, i.e. like it says "Nosen li'Vhemah Lachmah li'Vnei Orev..." - the Gematriya of "Behemah" equals that of Kelev (dog).

TOSFOS DH Yasiv Rav Yosef v'Ka Me'ayen Bah

Question: Doesn't [Rav Yosef] hold that "bi'Vosh Ketzirah Tishavarna" (when the king's merits are used up, he will fall), like we say below (10b)? This is why R. Ami did not accept money that Shevor Malka's mother sent to give to Tzedakah!)

וי"ל דקבל' משום שלום מלכות כדעבד רבא לקמן (שם)

(b)

Answer #: [Rav Yosef] accepted for the sake of Shalom with the king, like Rava did below (10b);

וכי היכי דפלגינהו רבא לעניי עובדי כוכבים ה"נ פדה בהו רב יוסף שבויי עובדי כוכבים

Just like Rava gave it to poor Nochrim, Rav Yosef used it to redeem Nochri captives.

ומיהו לא צריכי להכי אלא כדפירש הקונט' דרב יוסף (הגהת הב"ח, מהרש"א) דקבלה משום שלום מלכות

Answer #2: We need not say so. We can say like Rashi explained, that Rav Yosef accepted it for the sake of Shalom with the king;

וכיון שאמרה (הגהת בארות המים) לו ליתן למצוה רבה לא היה אפשר לחלקם לעניי עובדי כוכבים דאסור לגנוב דעת הבריות ואפי' דעתו של עובד כוכבים (חולין צד.)

Since she told him to give it for a great Mitzvah, he could not give it to poor Nochrim, for one may not deceive people, even a Nochri (Chulin 94a).

אבל מעות המתחלקים לעניים אין כאן גניבת דעת דאינהו נמי ידע שישראל רגילין לפרנסם

However, money that is divided among the poor, there is no deception, for also they know that Yisrael normally finance [poor Nochrim. Therefore, Rava was able to give it to poor Nochrim];

כדאמר בהנזקין (גיטין דף סא.) מפרנסים עניי עכו"ם עם עניי ישראל מפני דרכי שלום

This is like it says in Gitin (61a), that we finance poor Nochrim with poor Yisraelim, for Darchei Shalom.

והא דקבל מההוא טייעא דנדב שרגא לבי כנישתא בפ"ק דערכין (דף ו: ושם ד"ה עד) אף על גב דהתם לא היה שלום מלכות

(d)

Implied question: Why did they accept a lamp that a Nochri merchant donated to [Rav Yehudah's] Beis ha'Keneses? There, Shalom Malchus did not apply!

התם טעמא משום דהוו כמו קרבן ואמרינן (נזיר סב.) איש איש לרבות נכרים שנודרים נדרים ונדבות כישראל.

Answer: There, it is because it was like a Korban, and we say (Nazir 62a) that "Ish Ish" includes Nochrim. They may volunteer Nedarim and Nedavos (voluntary Korbanos) like Yisraelim may.

TOSFOS DH Pidyon Shevuyim Mitzvah Rabah

(SUMMARY: Tosfos explains why this was not taught regarding selling a Sefer Torah.)

והא דאמר בפרק בני העיר (מגילה דף כז.) אין מוכרין ס"ת אלא ללמוד תורה ולישא אשה ולא קתני פדיון שבוים

Implied question: It says in Megilah (27a) that we sell a Sefer Torah only to learn Torah or marry a woman. It does not mention redeeming captives!

שמא מילתא דפשיטא היא ולא איצטריך למיתני.

(b)

Answer: Perhaps it is obvious [that this is permitted]. There was no need to teach it.

TOSFOS DH u'Mischalekes b'Gimel Mipnei she'Hi k'Dinei Mamonos

TOSFOS DH v'Lishnosah l'Chol Mah she'Yirtzu

Assertion (R. Tam): They can change it even to a matter of Reshus (not a Mitzvah).

אף על גב דאמרינן בערכין בפ"ק (דף ו: ושם) האי מאן דנדב שרגא לבי כנשתא אסור לשנותה לדבר הרשות

(b)

Implied question #1: It says in Erchin (6b) that if one donated a lamp to a Beis ha'Keneses, one may not change it to a matter of Reshus!

ואמר נמי התם האומר פרוטה זו לצדקה עד שלא באה ליד הגבאי מותר לשנותה משבאה ליד הגבאי אסור לשנותה לדבר הרשות

(c)

Implied question #2: It says there also that if one said "this coin is for Tzedakah," one may change it before the Gabai (overseer of Tzedakah) received it, but after the Gabai received it, one may not change it to a matter of Reshus!

הכא שבני העיר משנים אותה שאני לפיכך מותר לשנותה אפילו לדבר הרשות ואפילו באה ליד הגבאי

(d)

Answer: Here that the people of the city change it, it is different. Therefore, one may change it even to a matter of Reshus, even after the Gabai received it.

וכן היה ר"ת נוהג לתת מעות הקופה לשומרי העיר לפי שעל דעת בני העיר נותנים אותם.

(e)

Remark: R. Tam used to give coins of the [Tzedakah] box to the guards of the city, since people give [the Tzedakah] with intent for the people of the city [to use it like they deem proper].

TOSFOS DH Ki Ha d'Rava Achpei

(SUMMARY: Tosfos points out that Rava did not do so alone.)

אחר היה עמו דאין עושין שררה על הצבור פחות מב' ולא חשיב ליה מפני כבודו של רבא.

Explanation: Another person was with Rava, for we may not coerce the Tzibur with less than two. The other's name was not mentioned, due to Rava's honor. (Mentioning him would connote that he was of similar importance. Pnei Shlomo points out that if Rava decided that he must give 400, like the Ramban says, we must say that there were two others with him!)

TOSFOS DH Achpei l'Rav Nasan

(SUMMARY: Tosfos justifies why he was able to force him.)

וא"ת והא בפרק כל הבשר (חולין דף קי: ושם ד"ה כל) אמר כל מ"ע שמתן שכרה [כתובה] בצדה אין ב"ד של מטה מוזהרים עליה

Question: In Chulin (110b), it says that any Mitzvas Aseh for which the reward is written next to it (in the Torah), Beis Din below is not warned [to force people to fulfill it];

וגבי צדקה כתיב כי פתוח תפתח את ידך לו וכתיב כי בגלל הדבר הזה יברכך (דברים טו)

Regarding Tzedakah, it says "Ki Paso'ach Tiftach Es Yadecha", and "Ki Biglal ha'Davar ha'Zeh Yevarechecha"!

Answer #1 (R. Tam): [Rava] forced him verbally, like "[Rav Papa verbally] forced [Yehudah ber Mereimar], and he entered."

Answer #2 (R. Tam): Here, they accepted on themselves that the Gabai may force them.

Answer #3 (Ri): We may force for Tzedakah, since there is also a Lav (against not giving) "Lo Se'ametz Es Levavcha v'Lo Sikpotz..."

Answer #4 (Ritzva): Beis Din is not warned about a Mitzvas Aseh for which the reward is written next to it (in the Torah), i.e. they are not punished for it (but they may force people to fulfill it).

Support: The Yerushalmi in Bava Basra connotes like this.

וההיא דכל הבשר (שם) דלא הוה מוקיר אבוה וכפתוהו ואמר להו שבקוהו

Implied question: In Chulin (110b), it says a man was not honoring his father, and [Beis Din] forced him. [Rami bar Tamri] said "leave him" (since Beis Din is not warned about this Mitzvah)!

(h)

Answer: He meant that you are not warned to force like for other Mitzvos Aseh;

דאם א"ל עשה סוכה ולולב ואינו עושה מכין אותו עד שתצא נפשו כדאמר בהכותב (כתובות דף פו: ושם) [וע"ע תוס' כתובות מט: ד"ה אכפייה ותוס' חולין קי: ד"ה כל].

If they told him to make a Sukah or [take] a Lulav, and he does not fulfill, we lash him until he dies, like it says in Kesuvos (86b). (See also Tosfos Kesuvos 49b, Chulin 110b. In Kesuvos, he gives another answer, that in the city they fixed how much people must give.)

TOSFOS DH Din Emes l'Amito

תוספות ד"ה דין אמת לאמתו

(SUMMARY: Tosfos explains what this excludes.)

אמת לאפוקי דין מרומה אף על גב שהעדים מעידין אותו [אין מחתכים אותו] כיון שיודעים שמשקרים

(a)

Explanation: "Emes" excludes a fraudulent case. Even if the witnesses testify, one may not give the verdict, since he knows that they are lying.

כדדרשינן (בסנהדרין דף ז.) [צ"ל בשבועות ל:] לאמתו שלא יטו את הדין [וע"ע תוס' מגילה טו: ד"ה זה].

This is like we expound in Shevuos (30b) "l'Amito" - they may not tilt the law. (See also Tosfos Megilah 15b, who says that in a fraudulent case, one must investigate the witnesses until the truth is clarified, and then he judges it.)

TOSFOS DH u'Matzdikei ha'Rabim v'Gomer Elu Melamdei Tinokos

Observation (Ri): We must say that the sky is more radiant than the stars, for in Pesachim (49b) it connotes that Gabai Tzedakah have precedence over teachers of children!

דאמר לא מצא בת תלמיד חכם ישא בת גבאי צדקה לא מצא בת גבאי צדקה ישא בת מלמדי תינוקות

Citation (49b): If one cannot find a Chacham's daughter [to marry her], he should marry the daughter of a Gabai Tzedakah. If one cannot find a Gabai Tzedakah's daughter, he should marry the daughter of a teacher of children.

ואריב"א כי מצא בפרקי דרבי אליעזר דרקיע דהאי קרא דהמשכילים יזהירו כזוהר הרקיע היינו רקיע שעל ראשי החיות שמזהירין מכוכבים שאורו כאור החמה

(b)

Remark (Riva): It says in Pirkei d'R. Eliezer (4) that in this verse "[ve]ha'Maskilim Yazhiru k'Zohar ha'Raki'a", "Raki'a" is what is above the [angels called] Chayos. It is more radiant than the stars. Its light is like the sun.

והאי דקאמר ורבנן מאי אמר רבינא ואוהביו כצאת השמש

(c)

Implied question: We say [what will be the radiance of] Rabanan? Ravina said "v'Ohavav k'Tzeis ha'Shemesh." (This connotes that it is not the same as for Gabai Tzedakah!)

היינו שמש של עתיד לבא דהוא שבעתים כאור שבעת הימים ואור שבעת ימי בראשית היה שבעתים מאור חמה של עכשיו כדמפרש תרגום של רני ושמחי (זכריה ב).

(d)

Answer: This refers to the sun in the future, which is seven times as great as the light of the seven days [of creation], and the light of the sun nowadays, like is explicit in the Targum of "Rani v'Simchi."
