DAF DISCUSSIONS - ERUVIN 46

Moshe asks:

My general understanding is that hakol kdivrei meikilin beruv is something that was a rule for chazal, but that contemporary poskim follow the regular rules for paak (basar rov, etc).

Can you shed some light on whether this is true and why it works this way.

Thank you so much!

Best Regards,

Moshe

The Kollel replies:

As far as I can see the poskim adopt this ruling even when it is a minority opinion. For example, Beis Yosef OH 366:9 explains the Rif , Rosh and Tur as holding like the minority opinion of Rabbi Shimon regarding this point. In 371:1 the Beis Yosef brings a number of authorities who pasken like Rabbi Yehuda against Rabbi Yosi even though we usually favor Rabbi Yosi in such dispute. The Beis Yosef cites the Rif (Eruvin 46) who explicitly says that this leniency applies even against the majority.
