HASH-M PUNISHES MIDAH K'NEGED MIDAH (Yerushalmi Perek 1 Halachah 7 Daf 6b)

מתני' במידה שאדם מודד בה מודדין לו היא קישטה את עצמה לעביר' והמקום ניוולה

(a)

(Mishnah): Hash-m repays a person according to how he acted. She adorned herself to sin, so Hash-m makes her disgusting;

היא גילתה את עצמה והמקום גילה עליה

She revealed herself to sin, so Hash-m reveals her;

הירך התחילה בעבירה תחילה ואח"כ הבטן לפיכך ילקה הירך תחילה ואחר כך הבטן ושאר כל הגוף לא פלט:

She first sinned with the thigh, then with her stomach. Therefore her thigh is stricken first, and then her stomach, and the rest of the body is not spared.

גמ' תני בשם רבי מאיר במדה שאדם מודד בה מודדין לו.

(Gemara - Beraisa - in the name of R. Meir): The Midah (measure) that a person metes out (how he acts), so [Shamayim] does to him.

מאי טעמא [ישעי' כז ח] בסאסאה בסאה סאה

What is the source? "B'Sase'ah" - for a Se'ah (a large measure, i.e. of sin, one is punished) a Se'ah (the same measure).

אין לי אלא סאה מניין לרבות תרקב וחצי תרקב וקב וחצי קב ורובע ותומן וחצי תומן ואוכלא.

Question: This teaches only about a Se'ah. What is the source for a Tarkav (half-Se'ah), half-Tarkav, Kav, half-Kav, Rova, Tuman, half-Tuman and Uchla (smaller sins)?

תלמוד לומר [שם ט ד] כי כל סאון סואן ברעש. ריבה כאן סאות הרבה.

Answer: "Ki Kol Se'on So'en b'Ra'ash" includes many Sa'os (measures).

אין לי אלא דבר שהוא של מידה. מניין לפרוטות קטנות שהן מצטרפות לחשבון מרובה

Question: This teaches only about measures. What is the source that small Perutos (miniscule sins) join to a big calculation [of liability]?

תלמוד לומר [קהלת ז כז] אח' לאחת למצוא חשבון.

Answer: "Achas l'Achas Limtzo Cheshbon";

בנוהג שבעולם אדם נכשל בעבירה שחייבין עליו מיתה בידי שמים. מת שורו אבדו תרנגולתו. נשברה צליחותו. נכשל באצבעו והחשבון מתמצה.

The way of the world is, if one stumbled in an Aveirah for which one is liable Chayav Misah bi'Ydei Shamayim, his ox dies, his hen is lost, his flask breaks and he stubs his finger, and the calculation is exhausted (these are in place of death).

דבר אחר אחת מתארעה לאחת והחשבון מתמצה וכמה הוא מיצוי חשבון עד אחת

ii.

Another Perush - one breakage for one Aveirah, and the calculation is decreased. How much is the deduction? It is until one (there is punishment for every Aveirah, and there is no punishment without an Aveirah. We explained this like YEFEI MAR'EH.)

. תני בשם רבי מאיר כשם שיש דיעות במאכל ובמשתה כך יש דיעות באנשים.

(Beraisa - in the name of R. Meir): Just like people have different natures regarding food and drink, also there are natures in men (about tolerating immodesty in their wives);

יש לך אדם זבוב נופל לתוך כוסו והוא נוטלו וזורקו ושותהו זה כשאר כל אדם שהוא רואה את אשתו מדברת עם שכיניה ועם קרוביה.

One kind of person, if a fly fell in his cup, he removes [the fly], casts it away and drinks [the cup]. This is like a typical man, who sees his wife speaking with her neighbors and relatives [and is not upset];

או יש לך אדם שפורח זבוב על גבי כוסו והוא נוטלו ושופכו ואינו טעמו זה הוא חלק רע באנשים שנתן עיניו בה לגרשה.

Or, there is a man that if a fly flew above his cup, he takes it and spills it out and does not taste it. This is a bad temperament in men. He sought to divorce his wife (and seeks a pretext).

ויש לך אדם זבוב שוכן על כוסו (והיא) [והוא] נוטלו ומניחו כמות שהוא זה פפוס בן יהודה שנעל את הדלת בפני אשתו.

There is a man that if a fly rests on his cup, he takes it and leaves it like it is (guards it lest another fly come). This is like Papus ben Yehudah. He locked the door in front of his wife.

אמרין לית נהיגין הוון אבהתך עבדין כן.

[Chachamim]: Your ancestors did not do so!

יש לך אדם זבוב מת לתוך כוסו והוא נוטלו ומוצצו ושותיהו. זה הרשע שהוא רואה את אשתו לבה גס בעבדי' ליבה גס בשפחותיה

There is a man that if a fly died in his cup, he takes it and sucks [the wine on] it and drinks [the cup]. This [corresponds to] a Rasha, who sees that his wife is informal with her male slaves [like she is informal] with her female slaves (CHASDEI DAVID on Tosefta; the Gra deletes the words "Libah Gas b'Shifchoseha.")

והוא מצוה עליה לגרשה שנאמר [דברים כד ב] ויצאה מביתו והלכה והיתה לאיש אחר. הכתוב קראה אחר שאינו בן זוג של ראשון

He is commanded to divorce her - "[Ki Matza Bah Ervas Davar...] v'Yatz'ah mi'Beiso v'Halchah v'Haysah l'Ish Acher" - the Torah calls her next husband "different", for he is unlike the man who divorced her;

שהוא הוציא את אשתו משום ערוה והלה נכשל בה. אם זכה הוא לשמים הרי הוא מגרשה. ואם לאו סוף שהיא קוברתו שנאמר [שם ג] או כי ימות האיש האחרון. ראוי היה זה למיתה שהאשה הזאת הכניס לתוך ביתו.

The former expelled his wife due to Ervah, and the latter stumbled with her! If [the latter] merits [according] to Shamayim, he will divorce her. If not, she will bury him (he will die in her lifetime) - "Oh Ki Yamus ha'Ish ha'Acharon." He deserves to die, for he entered this woman into his house.

שמואל אמר [דף ז עמוד א] פורשים מן המזנה. ואין פורשין מבתה.

(f)

(Shmuel): We separate from (do not marry) a woman who is [suspected to be] Mezanah. We do not separate from her daughter (we are not concerned lest she is a Mamzeres conceived through the Isur of Eshes Ish).

ואתייא כיי דמר רבי יוחנן אשת איש שזינתה הוולדות לבעל מפני שרוב בעילות מן הבעל.

This is like R. Yochanan taught, that [even] if a woman was Mezanah, the children are [attributed] to the husband, for most Bi'os are from the husband.

כתוב אחד אומר [במדבר ה כב] לצבות בטן ולנפיל ירך. וכתוב אחר אומר [שם כז] וצבתה בטנה ונפלה יריכה וכתוב אחר אומר [שם כא] בתת י"י את ירכך נופלת ואת בטנך צבה. מקרא אחד מכריע שני מקראות.

Question: One verse says "Latzvos Beten v'Lanpil Yarech", and one verse says "v'Tzavsah Bitnah v'Naflah Yerechah", and one verse says "Es Yerechech Nofeles v'Es Bitnech Tzavah." Does one verse override two verses?! (Our Mishnah says that her thigh is stricken first, unlike the two verses that put her stomach first.)

אמר רבי מנא כאן למעשה וכאן לתנאין.

Answer #1 (R. Mana): This (the two verses) is in practice (her stomach swells first), and this (our Mishnah and the third verse) is the stipulation (the Kohen's warning - he first mentions the thigh falling off).

אמר רבי אבין ואפילו תימר כאן וכאן למעשה כאן וכאן לתנאין.

Answer #2 (R. Avin): You can even say that both of these are in practice (sometimes the stomach swells first, and sometimes the thigh falls first, therefore) both of these [orders] are in the stipulation (verses 5:21 and 22).

לצבות בטן ולנפיל ירך לבועל. וצבתה בטנה ונפלה ירכה לאשה.

"Latzvos Beten v'Lanpil Yarech" refers to the Bo'el (therefore it does not say "her" thigh or "your" thigh). "V'Tzavsah Bitnah v'Naflah Yerechah" refers to the woman.

הדעת מכרעת ירך התחילה בעבירה תחלה ואחר כך הבטן לפיכך תלקה הירך תחלה ואחר כך הבטן ושאר כל הגוף לא פלט.

(We cannot expound which is first.) Reasoning dictates that the thigh began the Aveirah, and afterwards the stomach. Therefore, the thigh is stricken first, and afterwards the stomach, and the rest of the body is not spared.

רבי אבא בריה דרבי פפי עבד לה אפטרה מה אם מידת הפורענות מעוטה אבר אחד לוקה ושאר כל האיברים מרגישין. מדת הטובה המרובה על אחת כמה וכמה:

R. Aba brei d'R. Papi made a closing for a Drashah from here. The Midah of punishment is small (one part in 500 of Midas ha'Tov - Tosefta 4:1), and one limb is stricken, and the rest of the limbs feel [pain]. Midas ha'Tov, which is greater, all the more so!
