WHAT ARE THE TWO THAT ARE FOUR? (Yerushalmi Halachah 1 Daf 1a)

והתני דלתות היכל שתים שהן ארבע. אית מימר לחיוב (ולא) [צ"ל או - הגהות ר' יוסף דיננער] לפטור.

(a)

Rebuttal: It was taught "there are two doors of the Heichal, which are four." Can you say that they are for Chiyuv or Petur?! (R. Yosi's conclusion is unfounded. We explained this like HAGAHOS R. DINAR.)

[דף א עמוד ב] ניתני שנים עשר פטור.

(b)

Question: [The Mishnah in Shabbos] should teach 12 cases of Petur! (There are four Akiros in which the other person did the Hanachah - in every case, both of them are exempt - and in the four cases when one person did the entire Melachah and is liable, the other person was totally passive, and he is exempt.)

לא אתינן מיתני אלא פטור שהוא כנגד חיוב.

Answer #1: It teaches only exemption similar to the cases of Chiyuv (he brought something in or out, but he is exempt because he did not do the Akirah or Hanachah).

א"ר חייה בר אדא מהו אהן פטור דתנינן הכא מותר.

Answer #2 (R. Chiya bar Rav Ada bar Ahavah): What are the cases of exemption taught? When it is permitted (he was totally passive, and the other person did the entire Melachah. There are four such cases. It is permitted regarding Shabbos; it is forbidden due to Lifnei Iver.)

(R. Yosi): Oni and Ashir are the same (both are liable when they do the entire Hotza'ah or Hachnasah), and Chachamim counted them like two (because Hotza'ah is an inferior Melachah, we would not have learned one from the other);

הכנסה והוצאה שנים הן ומנום חכמים אחד.

Hachnasah and Hotza'ah are two [Melachos], and Chachamim counted them like one.

Source #1: [The Mishnah taught] Yetzi'os of Shabbos - is Hachnasah not included?! (Surely it is!) [The Mishnah that lists the Melachos taught] "one who is Motzi from Reshus to Reshus" - is Machnis not included?!

ועוד מהדא דמר ר' יסא בשם ר' יוחנן הכניס חצי גרוגרת והוציא חצי גרוגרת חייב.

Source #2: R. Yosah taught in the name of R. Yochanan "one who entered half a Grogeres (the Shi'ur of food for which one is liable) and took out half a Grogeres is liable.

Question: What is the source that Hotza'ah is called a Melachah?

ר' שמואל בשם ר' יוחנן [שמות לו ו] ויצו משה ויעבירו קול במחנה וגו' נמנעו העם מלהוציא מבתיהן לתת לגיזברין ומלהוציא מידן להכניס ללישכה.

Answer #1 (R. Shmuel citing R. Yochanan): "Va'Ytzav Moshe va'Ya'aviru Kol b'Machaneh..." - people refrained from taking from their houses (tents) to give to Gizbarim (who were accepting donations for the Mishkan), and [the Gizbarim] refrained from taking from their hands and entering them to the chamber.

ר' חזקיה בשם ר' אחא שמע לה מן הדא [ירמי' יז כב] ולא תוציאו משא מבתיכם ביום השבת וכל מלאכה לא תעשו.

LIABILITY FOR TUM'AS MIKDASH (Yerushalmi Halachah 1 Daf 1b)

ר' מנא אמר לה סתם. ר' אבין בשם ר' יוחנן

(a)

R. Mana said [the following teaching] Stam, and R. Avin said it in the name of R. Yochanan.

תנינן תרתי כללין ולא דמיין דין לדין. שבועות שתים שהן ארבע מביא ארבע קרבנות.

Question: Two general rules were taught, and they do not resemble each other [they are like different Tana'im]! There are two oaths that are four - he brings four Korbanos. (This is like R. Akiva, who obligates for Shevuos in the positive and negative, both for the future and the past (I will, I will not, I did, or I did not);

(מראות נגעים) [צ"ל ידיעות הטומאה - פני משה] שנים שהן ארבע מביא ב' קרבנות.

(c)

There are two [primary] Yedi'os of Tum'ah, which are four [in all. However, R. Akiva holds that] he brings [only] two Korbanos (for forgetting the Tum'ah and entering the Mikdash or eating Kodshim, but not for remembering the Tum'ah and forgetting the Mikdash or Kodshim! And R. Yishmael, who obligates for all four of these, obligates only for two Shevuos!)

Answer #1 (R. Elazar citing R. Avin): Different Tana'im taught them. There are two oaths that are four - R. Akiva says so. There are two Yedi'os of Tum'ah, which are four - R. Yishmael [taught this].

. ר' חגיי בעא קומי ר' יוסי [דף ב עמוד א] ולמה לי כר' ישמעאל ואפילו כר' עקיבה אתיא היא ידיעה והעלם על טומאת מקדש. ידיעה והעלם על טומאת הקדש.

Question (R. Chagai, to R. Yosi): Why must [R. Avin establish the Seifa only] like R. Yishmael? It is even like R. Akiva, e.g. he knew and forgot about Tum'ah and the Mikdash, or he knew and forgot about Tum'ah and the Kodshim! (He exempts only when he remembers the Tum'ah and forgot about the Kodshim or Mikdash.)

א"ל מאן אית ליה העלם טומאה והעלם מקדש לאו רבי ישמעאל ונן בעיי כר' עקיבה.

Answer (R. Yosi): Who holds that [one is liable for Helam (forgetting) Tum'ah and Helam Mikdash [or Helam Tum'ah and Kodshim]? It is R. Yishmael, and we want [to establish also the Seifa] like R. Akiva!

פעמים שיש כאן העלם טומאה והעלם מקדש ואינו חייב אלא אחת.

Sometimes there is Helam of the Tum'ah and the Mikdash, and he is liable only once [even according to R. Yishmael];

היך עבידא ניטמא וידע נעלמה ממנו טומאה ונכנס למקדש ויצא וידע. נעלם הימינו מקדש ונכנס למקדש ויצא וידע הרי כאן העלם טומאה והעלם מקדש ואינו חייב אלא אחת.

How is this? He became Tamei, knew, and forgot the Tum'ah, and entered the Mikdash and left, and found out [that he was Tamei]. He forgot the Mikdash, entered the Mikdash and left and found out. There is Helam Tum'ah and Helam Mikdash, and he is liable only once.

ופעמים שיש כאן כמה ידיעות וכמה העלימות ואינו חייב אלא אחת.

Sometimes [it seems that] there are several Yedi'os (awarenesses) and several He'elamos, and he is liable only once;

היך. ניטמא וידע נעלמה הימינו טומאה. עד שהוא בהעלם טומאה נעלמה הימינו מקדש ונכנס למקדש ויצא וידע ואמר טומאה זו אין חייבין עליה קרבן.

How is this? He became Tamei, knew, and forgot the Tum'ah. Amidst Helam Tum'ah, he forgot the Mikdash, entered the Mikdash and left and found out, and said "one is not liable a Korban for this Tum'ah";

ניטמא וידע נעלמה הימינו טומאה עד שהוא בהעלם טומאה נעלם הימינו מקדש ונכנס למקדש ויצא אפי' כמה פעמים ובסוף ידע הרי כאן כמה ידיעות והעלימות ואינו חייב אלא אחת:

He became Tamei, [again] and knew, and forgot the Tum'ah. Amidst Helam Tum'ah, he forgot the Mikdash, entered the Mikdash and left, even many times, and at the end he found out [that one is Chayav Korban for it], there are several Yedi'os and He'elamos, and he is liable only once.
