DIVISION OF CHIYUVIM FOR MELACHOS (Yerushalmi Halachah 1 Daf 39b)

מתני' כלל גדול אמרו בשבת כל השוכח עיקר שבת ועשה מלאכות הרבה בשבתות הרבה אינו חייב אלא חטאת אחת

(a)

(Mishnah): (We discuss liability for Melachah on Shabbos b'Shogeg, i.e. he forgot that it is Shabbos, or that this Melachah is forbidden.) There is a great Klal (general rule) of Shabbos - anyone who forgot Ikar (the entire concept of) Shabbos and did many Melachos on many Shabbosos, is liable only one Chatas;

והיודע עיקר שבת ועשה מלאכות הרבה בשבתות הרבה חייב על כל שבת ושבת

If he knew Ikar Shabbos, and did many Melachos on many Shabbosos (each time he forgot that it is Shabbos), he is liable [one Korban] for every Shabbos;

והיודע שהוא שבת ועשה מלאכות הרבה בשבתות הרבה חייב על כל מלאכה ומלאכה [דף מ עמוד א]

If he remembered that the day is Shabbos, and did many Melachos on many Shabbosos (he forgot that these Melachos are forbidden), he is liable only one Korban for every Av Melachah;

העושה מלאכות הרבה מעין מלאכה אחת אינו חייב אלא חטאת אחת:

One who does many Melachos resembling one Melachah (they are Toldos, i.e. derivatives of it) is liable only one Korban.

(Gemara) Question: Why is it called a great Klal?

א''ר יוסי בי רבי בון שהוא גדול מכלל שביעית. שהשבת חלה על הכל ושביעית אינה חלה אלא על עבודת הארץ בלבד.

Answer #1 (R. Yosi bei R. Bun): It is greater than the Klal of Shevi'is, for [the Isur Melachah of] Shabbos takes effect on everything (attached and detached), and Shevi'is takes effect only on working the land.

Question: A Mishnah says "a great Klal of Shevi'is'' - why is it called great?

א''ר יוסה בי רבי בון שהוא גדול מכלל מעשרות. שהשביעית חלה בין על אוכלי אדם בין על אוכלי בהמה. ומעשרות אינן חלין אלא על אוכלי אדם בלבד.

Answer (R. Yosi bei R. Bun): It is greater than the Klal of Ma'aseros, for Shevi'is takes effect both on human food and animal food, and Ma'aser takes effect only on human food.

תני בר קפרא כלל גדול אמרו במעשרות. מהו כלל גדול.

Question: Bar Kapara taught "they said a great Klal of Ma'aseros'' - why is it called great?

אמר רבי יוסה בי רבי בון שהוא גדול מכלל פיאה. שהמעשרות חלין בין על דבר שמכניסו לקיום ובין על דבר שאין מכניסו לקיום. ופיאה אינה חלה אלא על דבר שמכניסו לקיום.

Answer (R. Yosi bei R. Bun): It is greater than the Klal of Pe'ah, for Ma'aser takes effect both on something she'Machniso l'Kiyum (one enters them to store them for a long time) and Ein Machniso l'Kiyum, and Pe'ah takes effect only on she'Machniso l'Kiyum.

[דף מט עמוד ב (עוז והדר)] ואית דבעי מימר מהו גדול מיכן שיש למטה ממנו.

Answer #2: [It is called a great Klal of Shabbos] because there is a smaller Klal (below, Mishnah 3, which applies only to Hotza'ah).

אנן תנינן כל השוכח עיקר שבת. תניי דבית רבי כל שאינו יודע עיקר שבת.

Our text of the Mishnah says "anyone who forgot Ikar Shabbos.'' Tana'im of Rebbi's academy taught "anyone who does not know Ikar Shabbos.''

רבי לעזר כמתניתין. רבי יוחנן כהדא דתני דבית רבי.

R. Lazar [held like] our Mishnah. R. Yochanan held like the Tana of Beis Rebbi.

הא רבי (ליעזר) [צ''ל לעזר - קרבן העדה] אמר כל השוכח עיקר שבת הא אם אינו יודע כל עיקר פטור.

Assumption: R. Lazar taught "anyone who forgot Ikar Shabbos.'' This implies that if he never knew Ikar Shabbos, he is exempt.

מן מה דרב תני מתניתין ופתר לה אי זהו שאינו יודע עיקר שבת קטן שנשבה בין העכו''ם. הדא אמרה הוא הדא הוא הדא.

(h)

Rejection: [Also] Rav taught our text of the Mishnah, and explained, who never knew Ikar Shabbos? It is a baby captured by Nochrim. This shows that this (one who forgot Ikar Shabbos) and this (one who never knew Ikar Shabbos) are the same (they bring one Korban).

הא אמר ר' יוחנן כל שאינו יודע עיקר שבת. הא (אינו) [צ''ל היה - שערי תורת ארץ ישראל] יודע ושכח חייב.

(i)

Assumption: R. Yochanan said [that our Mishnah teaches] "anyone who never knew Ikar Shabbos.'' This implies that if he knew and forgot, he is liable for [each one].

מן מה דמר רבי שמואל רבי אבהו בשם רבי יוסי בן חנינא כל הדא הילכתא כרבי ליעזר. ברם כרבנן אינו חייב אלא אחת הדא אמרה היא הדא היא הדא.

Rejection: Since R. Shmuel taught in the name of R. Avahu citing R. Yosi ben Chaninah "this entire Halachah (R. Akiva asked about one who did forgot Shabbos and did Melachah on many Shabbosos, and R. Eliezer said that he is liable for each Shabbos) is like R. Eliezer, but Rabanan say that he is liable only once (R. Akiva did not accept his answer, and our Mishnah is like R. Akiva)'', this shows that this (one who does not know Ikar Shabbos) and this (one who forgot Ikar Shabbos) are the same. (We explained this like PNEI MOSHE.)

בעון קומי בריה דר' יסא את מה שמעת מן אבוך מן דרבי יוסי. [דף מ עמוד ב] אמר כרבי יוחנן.

They asked R. Yosa's son "what did you hear from your father, from R. Yosi [about the text of our Mishnah]?'' He said, like R. Yochanan.

אמר לון רבי חזקיה לא אמר כן. אלא ר' סימון בר זבדא הוה פשט עם בריה דרבי יוסה. ושמע מינה כהדא דרבי ליעזר.

Rejection (R. Chizkiyah): He did not say so! R. Simon bar Zavda was learning with R. Yosah's son, and he heard from him (R. Yosah, or his son) like R. Li'ezer (PNEI MEIR)!

2)

THE SOURCE FOR MULTIPLE CHATA'OS (Yerushalmi Halachah 1 Daf 40b)

(מטאלין) [צ''ל מנא אילין - פני משה] מילייא.

(a)

Question: What is the source [for the laws of our Mishnah]? (PNEI MOSHE)

ועשה אחת ועשה הנה ועשה מהנה

(b)

Answer: [The Torah could have written] 'V'Asah Achas.' [It added a Mem and wrote me'Achas, and added] v'Asah Henah, [and added a Mem and wrote] "v'Asah me'Henah'';

ועשה (אחת) [צ''ל מאחת - קרבן העדה] לחייב על כל אחת ואחת. [דף נ עמוד א (עוז והדר)] הנה לחייב על כולהן אחת. מהנה לחייב על התולדות.

"V'Asah me'Achas'' obligates one [Chatas] for each [transgression, e.g. he remembered that it is Shabbos, and forgot Melachos]. V'Asah Henah obligates one for all of them (he remembered the Melachos, but forgot that it is Shabbos). "Me'Henah'' obligates for Toldos.

או נימר בעכו''ם הכתוב מדבר.

(c)

Suggestion: Perhaps the verse teaches about [liability for different Avodos done to] idolatry!

תני רבי זכייה קומי רבי יוחנן זיבח קיטר וניסך בהעלם אחת חייב על כל אחת ואחת.

(d)

Objection #1: R. Zakai taught in front of R. Yochanan that if one slaughtered, burned, and poured libations in one Helam, he is liable for each one. (The Torah explicitly forbade bowing, to obligate for each Avodah);

אמר ליה רבי יוחנן בבלייא עברת בידך תלתא נהרין ואיתברת. אינו חייב אלא אחת.

Rebuttal (R. Yochanan): Babylonian! You crossed three rivers [to come to Eretz Yisrael to learn], and you stumbled! He is liable only once.

עד לא יתברינה בידיה יש כאן אחת אין כאן הנה.

Before [R. Yochanan] broke [R. Zakai's teaching], there is "Achas'' (we can expound that he is liable for each one), but there is no [way to expound] "Henah'' (that he is liable only once for all of them);

מן דתברה בידי' יש כאן הנה אין כאן אחת. והיכן בעכו''ם

After he broke it, there is "Henah'' (he is liable only once for all of them), but there is no "Achas'' (liability for each one)! How can you say [that Achas and Henah teach about] idolatry?! (We explained this like PNEI MEIR.)

בעבודתה בעבודת הגבוה בהשתחויה

(e)

Answer: [We expound about] its special Avodah, Avodos of Hash-m, and bowing;

בעבודתה לחייב על כל אחת ואחת בעבודת הגבוה לחייב על כולהן אחת בהשתחויה לחייב על מקצתה.

In its special Avodah, ["Achas''] obligates for each one. In Avodos of Hash-m, ["Henah'' teaches like R. Yochanan,] that he is liable only once for all of them. Bowing [was taught explicitly] to obligate for part (e.g. he did not spread his hands and feet. This is like a Toldah.)

ר' בון בר חייא בשם רב שמואל בר רב יצחק כתיב [ויקרא ד ג] אם הכהן המשיח יחטא לאשמת העם והביא פר מצוה שהמשיח מביא עליהן פר. יצאת עכו''ם שאינו מביא עליה פר אלא שעירה בלבד.

(f)

Objection #2 (R. Bun bar Chiya citing R. Shmuel bar Rav Yitzchak): [After "me'Achas me'Henah''], it is written "Im ha'Kohen ha'Mashi'ach Yecheta l'Ashmas ha'Am v'Hevi Par'' discusses a Mitzvah for which a [Kohen] Mashi'ach brings a Par [if he sinned through mistake Hora'ah]. It excludes idolatry, for which he does not bring a Par, rather, only a female goat!

התיבון הרי חלבים ועריות [דף נ עמוד ב (עוז והדר)] הרי המשיח [דף מא עמוד א] מביא עליהן פר.

(g)

Question: For Chelev and Arayos, a Mashi'ach brings a Par [and the same applies to other Chayavei Kerisus. We can say that me'Achas me'Henah applies to them!]

לא אתינן מתני אלא דברים שיש להן תולדות. חלבים אין להן תולדות. עריות עשה בהן את המערה כגומר.

Answer: We can teach only matters that have Toldos (this was the third Drashah). Chelev does not have Toldos. Arayos [also has no Toldos. Do not say that Ha'ara'ah (the first stage) is a Toldah. It is an Av, for the Torah] made Ha'ara'ah like full [Bi'ah, so it is an Av].

חברייא אמרין [ויקרא כג ג] שבת הוא לה' לחייב על כל שבת ושבת.

(i)

(Talmidim): "Shabbos Hu la'Shem'' obligates for each Shabbos.

אמר ר' אילא כתיב [שמות לה ב] כל העושה בו מלאכה יומת לא העושה בו ובחבירו.

(j)

(R. Ila): "Kol ha'Oseh Vo Melachah Yumas'', and not one who does on Shabbos and another [Shabbos, i.e. half a Shi'ur of Melachah on each - PNEI MOSHE].

את אמר אין השבתות מצטרפות חולקות.

(k)

Question: You say that Shabbosos do not join. Do they divide [to obligate a Chatas for each Shabbos]?

אמר רבי יוסי בי רבי בון כשם שאינן מצטרפות כך אין חולקות.

Answer (R. Yosi bei R. Bun): Just like they do not join, they do not divide.

3)

ONE WHO DOES NOT KNOW WHEN IS SHABBOS (Yerushalmi Halachah 1 Daf 41a)

גדול שנשבה בין העכו''ם רב ושמואל חד אמר מונה ששה ועושה שבת. וחרנה אמר עושה שבת ומונה ששה.

(a)

If an adult was captured by Nochrim, Rav and Shmuel [argued about this]. One of them said that he counts six days [from the day he was captured], and makes Shabbos [on the seventh he refrains from Melachah], and the other said that he makes Shabbos [immediately] and counts six.

רבי יצחק בר אלעזר בשם רב נחמן בר יעקב מונה ששה ועושה שבת. חמשה ועושה שבת ארבעה ועושה שבת ג' ועושה שבת שנים ועושה שבת. אחד ועושה שבת.

(b)

(R. Yitzchak bar Elazar citing Rav Nachman bar Yitzchak): He counts six days and makes Shabbos [on the seventh]. He counts five days and makes Shabbos. He counts four days and makes Shabbos. He counts three days and makes Shabbos. He counts two days and makes Shabbos. He counts one day and makes Shabbos.

אמר ר' מנא אין אישתבאי בתלתא הוא עבד בשובתא.

(c)

Objection (R. Mana): If he was captured on Tuesday, he works on Shabbos (every day that he rests is really a weekday! His first 'Shabbos' is really Monday, and the next ones are Sunday, Friday, Tuesday, Friday, Sunday!)

רב הוה חייליה לתרין מחזירין הוא עבד שובתא.

(d)

Answer: Rav [Nachman bar Yitzchak], his attribute is within two cycles, he rests on Shabbos. (PNEI MEIR, HA'GAON RAV C. KANIEVSKY, SHLITA - this answers when he was captured on Tuesday. If he was captured on Friday, he will not rest on Shabbos until the third cycle.)

ואין לא לתמוה ויחוש לכל הימים [דף נא עמוד א (עוז והדר)] כהדא קידש אשה בעולם.

(e)

Question: Should he not because concerned for all days, like one who was Mekadesh a woman somewhere [and does not know whom, e.g. he sent a Shali'ach, and the Shali'ach did not return]?!

רבי יעקב בר אחא איתפלגון ר' יוחנן ור' שמעון בן לקיש. ר' יוחנן אמר חושש לכל הנשים. ריש לקיש אמר אינו חושש לכל הנשים.

(R. Yakov bar Acha): R. Yochanan and Reish Lakish argued about this. R. Yochanan said that he is concerned for all women (he may not marry anyone, lest the Shali'ach was Mekadesh him to a relative, e.g. her mother or sister). Reish Lakish says, he is not concerned for all women. (Presumably, we follow R. Yochanan against Reish Lakish. OHR SOMAYACH (Hilchos Ishus 9:6) - the Yerushalmi asks from here, for it holds that R. Yochanan's stringency is not a fine.)

תמן יש לו תקנה יכול הוא לישא גיורת. יכול הוא לישא משוחררת. הכא מה אית לן.

(f)

Answer #1: There, there is a solution; he can marry a convert or freed slave. Here, what can he do?! (If he cannot do Melachah any day, he will starve!)

תמן אמרין חושש לכל הימים ועושה כדי קיום הנפש.

(g)

Answer #2: There (in Bavel), they say that every day he does only Melachah needed to stay alive (it is permitted for Piku'ach Nefesh).
