HASH-M EMPATHIZES EVEN WITH RESHA'IM (Yerushalmi Halachah 8 Daf 29b)

משנה א"ר מאיר בזמן שאדם מצטער שכינה מה הלשון אומרת קלני מראשי קלני מזרועי

(a)

(Mishnah - R. Meir): When a person is in pain, how is the Shechinah (Divine Presence) pained? 'My head is heavy. My arms are heavy.'

אם כך אמר הכתוב מצטער אני על דמן של רשעים קל וחומר על דמן של צדיקים שנשפך:

If the verse says that I am pained over the blood (pain) of Resha'im, all the more so over the blood of Tzadikim that is spilled!

גמרא אנן תנינן קליני אית תניי תני קל אני.

(b)

(Gemara): Our text of the Mishnah says Kalini. Some texts say "Kal Ani";

מאן דמר קליני לית הוא אלא קליל מה דמר קל אני לית הוא אלא נטיל.

The one who teaches Kalini (like Kal Eini), it is an expression of Kalil (I am not light, rather, heavy). The one who teaches Kal Ani, it is an expression of Natil (a heavy burden, like "Koved Even v'Netel ha'Chol" - Mishlei 27:3).

מתניתא דלא כר' מאיר דאמר אף המגדף עובר בלא תעשה:

Our Mishnah [above, 29a] is unlike R. Meir, who says that even for a blasphemer he transgresses a Lav [if he leaves him hanging overnight. The Mishnah learns from "Lo Salin... Ki Kilelas Elokim Taluy." R. Meir expounds this verse to teach about the Shechinah's pain.]

LIKUT ATZAMOS (Yerushalmi Halachah 9 Daf 29b)

משנה ולא זו בלבד אלא כל המלין את מתו עובר בלא תעשה

(a)

(Mishnah): Not only this - rather, anyone who leaves his Mes overnight (unburied) transgresses a Lav;

הלינו לכבודו להביא לו ארון ותכריכין אינו עובר עליו בלא תעשה

If he left him for his honor, to bring a coffin or shrouds, he does not transgress a Lav.

ולא היו קוברין אותן בקברות אבותיהן אלא שני קברות היו מתוקנין לבית דין אחד לנסקלין ולנשרפין ואחד לנהרגין ולנחנקין:

They would not bury [someone executed] in the cemetery of his ancestors. Rather, Beis Din has two cemeteries, one for Niskalim and Nisrafim (those stoned and burned) and one for Neheragim and Nichnakim (killed by the sword and choked).

גמרא תני המעביר ארון ממקום למקום אין בו משום ליקוט עצמות.

(Gemara - Beraisa): If one moves a coffin from place to place, [the Aveilus] of gathering bones does not apply.

א"ר אחא הדא דתימר בארון שיש אבל בארון עץ יש משום ליקוט עצמות

(d)

(R. Acha): This applies to a marble coffin, but a wood coffin, gathering bones applies [to moving it].

א"ר יוסי אפילו בארון עץ אין בו משום ליקוט עצמות.

(e)

(R. Yosi): Even a wood coffin, gathering bones does not apply to it. (KORBAN HA'EDAH - even this is considered as if they were buried the entire time. R. Acha holds that only in a stone coffin, they are considered buried.)

אי זה ליקוט עצמות

Question: [If so, according to R. Yosi,] what is gathering bones? (The Yerushalmi in Mo'ed Katan 1:5 answers, it is when they are moved in an inner garment.)

א"ר חגיי והוא ששמע למחר אבל בו ביום יש שמיעה לליקוט עצמות.

(g)

(R. Chagai): (If he was not there when they were moved, he does not conduct Aveilus.) This is if he heard the next day, but the same day, [Aveilus due to] Shemi'ah applies to gathering bones.

תני ניקומכי קומי ר' זעירא [דף ל עמוד א] אין שיעור לליקוט עצמות.

(h)

(Nikomachi, in front of R. Zeira): There is no Shi'ur to gathering bones.

;רבי מני הורי לר' לא דכפרא לקרוע ולהתאבל כר' אחא ולא ליטמות כר' יוסי.

(i)

R. Mani ruled for R. La of Kafra to tear and mourn like R. Acha, but not to become Tamei (if he is a Kohen), like R. Yosi. (His Mes was moved in a wood coffin.)

תני ליקוטי עצמות כשמיען איזה ליקוט עצמות המלקט עצם עצם משיתעכל הבשר.

(Beraisa): Gathering bones is like a Shemu'ah (hearing that a relative died. He conducts Aveilus that day.) What is gathering bones? It is one who gathers bone by bone, after the flesh was consumed.

תני ליקוט עצמות אין אומר עליהן קינים ונהי ולא ברכת אבלים ולא תנחומי אבלים.

(k)

(Beraisa): Gathering bones - we do not say lamentations over it, nor Birkas Avelim;

אילו הן ברכת אבלים שאומרים בבית הכנסת אילו הן תנחומי אבלים שהן אומרים בשורה.

Birkas Avelim is what we say in the Beis ha'Keneses. Tanchumei (consolation of) Avelim is what we say in the consolation line.

תני אבל אומר עליהן דברים מהן הן דברים רבנן דקיסרין אמרין קילוסין:

(Beraisa): However, we say matters over them. What are matters? Rabanan of Kisarin say, they are praises [of Hash-m, who kills and revives].

AFTER THE EXECUTION (Yerushalmi Halachah 10 Daf 30a)

משנה נתעכל הבשר היו מלקטין את העצמות וקוברין אותן במקומן

(a)

(Mishnah): After the flesh has decomposed (the deceased received atonement), they gather the bones and bury them in their place (with his ancestors).

והקרובין באין ושואלין את שלום העדים ואת שלום הדיינין כלומר דעו שאין בלבינו עליכם שדין אמת דנתם

(b)

His relatives greet the witnesses and judges, i.e. "know that we do not bear a grudge, for you judged correctly."

ולא היו מתאבלין אלא אוננים שאין אנינה אלא בלב:

(c)

[The relatives] do not mourn (Aveilus), they conduct Aninus, for this is only in the heart.

גמרא תני בראשונה היו מלקטין את העצמות וקוברין אותן במהמורות נתעכל הבשר היו מלקטין אותן קוברין אותן בארזים

(d)

(Gemara - Beraisa): Initially, they would gather the bones and bury them in deep pits (without a coffin, so the flesh will be consumed). When the flesh was consumed, they would gather them and bury them in cedar coffins;

אותו היום מתאבל ולמחר היה שמח לומר שיניחוהו אבותיו מן הדין

That day he would mourn, and the next day he was happy, to say that his fathers are no longer being judged (since the flesh was consumed).

ולא עוד אלא היו קוברין אותן בפני עצמן הנסקלין בנשרפין והנהרגין בנחנקין.

(e)

(The Mishnah (29b) said that they would not bury him in his ancestors' cemetery. Not only this, rather, they bury them by themselves - Niskalim with Nisrafim [in one cemetery], and Neheragim with Nichnakim [in another cemetery].

הוא שדוד אומר אל תאסוף עם חטאים נפשי הנסקלין והנשרפין ועם אנשי דמים חיי הנהרגין והנחנקין.

This is what David said "Al Te'esof Im Chata'im Nafshi" - this refers to ha'Niskalim and ha'Nisrafim; "v'Im Anshei Damim Chayai" refers to ha'Neheragim and ha'Nichnakim.
