12TH CYCLE DEDICATION
NEDARIM 16-19 - Two weeks of Dafyomi study material have been dedicated by Ms. Estanne Abraham-Fawer to honor the eighth Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to him -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

AMBIGUOUS VOWS (Yerushalmi Perek 2 Halachah 4 Daf 7a)

הרי עלי כתרומה אם בתרומת הלשכה נדר אסור

(a)

(Mishnah): 'Harei Alai ki'Terumah' - if he vowed (intended for) Terumas ha'Lishkah, it is forbidden.

הא בתרומת תודה מותר.

(b)

Inference: If [he vowed about] Terumah of [Lachmei] Todah (the Kohen takes one loaf of each of the four kinds), he is permitted. (Its Isur to a Zar is not due to making it Hekdesh.)

ואם של גורן מותר.

(c)

(Mishnah): If [he vowed about] Terumah of grain, he is permitted.

הא בתרומת תודה אסור.

(d)

Inference: If [he vowed about] Terumah of Todah, he is forbidden!

הכא את אמר אסור והכא את אמר מותר.

(e)

Contradiction: Here you say that [Terumah of Todah], he is forbidden, and here you say he is permitted!

נישמעינה מן הדא כחלת אהרן וכתרומתו מותר.

(f)

Answer: We learn from the following. Like Chalah of Aharon and his Terumah, he is permitted.

הא בתרומת תודה אסור.

(g)

Inference: If he referred to Terumah of Todah, he is forbidden!

וחכמים אומרים סתם תרומה ביהודה אסורה ובגליל מותרת. שאין אנשי גליל מכירין תרומת הלשכה.

(h)

Chachamim say, Stam Terumah in Yehudah, he is forbidden. In Galil, he is permitted, for Bnei Galil do not know Terumas ha'Lishkah.

אבל אם היו מכירין סתם אסור.

(i)

Inference: If they knew, Stam he would be forbidden.

סתם חרמין ביהודה מותרין ובגליל אסורין שאין בני גליל מכירין חרמי כהנים.

(j)

Stam Cherem in Yehudah is permitted, and in Galil he is forbidden, for Bnei Galil do not know Cherem of Kohanim.

אבל אם היו מכירין סתמן מותר.

(k)

Inference: If they knew, Stam he would be permitted!

הכא את אמר מותר. וכא את אמר אסור.

(l)

Contradiction: Here you say (infer) that [Stam] he is permitted, and here you say he is forbidden!

אמר רבי אלעזר תרין תניין אינון.

(m)

Answer #1 (R. Elazar): These [clauses] are of two Tana'im (they argue).

אמר רבי ירמיה [דף ז עמוד ב] חד תניי הוא כמאן דמר סתם חרמין לבדק הבית. ברם כמאן דמר סתם חרמין לכהנים אפי' בגליל יהא מותר.

Answer #2 (R. Yirmeyah): They are like one Tana. He holds like the opinion that Stam Cherem is to Bedek ha'Bayis. However, according to the opinion that Stam Cherem is to Kohanim, even in Galil it would be permitted. (I.e. in Yehudah they hold that Stam Cherem is to Kohanim, and in Galil it is to Bedek ha'Bayis.)

רבי יוסי בשם רבי הילא בגליל על ידי שרגילין בחרם עכן את אמר אסור. וביהודה על שאינן רגילין בחרם עכן את אומר מותר:

(R. Yosi citing R. Heila): In Galil, since they are used to the Cherem of Achan, you say that he is forbidden. In Yehudah, since they are not used to the Cherem of Achan, you say that he is permitted. (TAL TORAH - because Achan was from Yehudah, Bnei Yehudah avoided Cherem Bedek ha'Bayis, for it recalls disgrace of their Shevet.)

Note: The Mishnah said that in Galil he is forbidden, for people of Galil are not familiar with Cherem of Kohanim! I.e. because they are used to the Cherem of Achan, they do not think about Cherem of Kohanim. The idea for this Perush came from RIDVAZ.
