Explanation (cont.): A Mikveh refutes this! It is Metaher Teme'im after they became Tamei, but it does not save Tehorim;

שאם טבל בעודו טהור לא מהניא ליה טבילה שלא יבא לידי טומאה אם יגע אחר כן בשרץ

If a person immersed when he is Tahor, the Tevilah does not help that he will not become Tamei later if he touches a Sheretz;

דאדרבה דרשינן בספרא (הגהת הרש"ש) מוהנוגע בנבלתם יטמא הלל אומר אפילו הם בתוך המים.

Just the contrary! We expound in the Sifra from "veha'Noge'a b'Nivlasam Yitma" - Hillel says, even if they [Sheratzim] are in the water (a Mikveh, they are Metamei him).

Explanation: They said to him that a Mikveh disproves [him], for it does not save.

אלמא לפום ק"ו דר"א היה ראוי למקוה שיציל ולא יבא טובל לכלל טומאה כי היכי דבעל מעכב נדרי אשתו שלא יחולו

Inference: This shows that according to R. Eliezer's Kal va'Chomer, it is proper that a Mikveh save, and he will not come to Tum'ah, just like a husband stops his wife's vows, that they not take effect.

ומקצת נסחי גרסי הכי ומה מקוה שמעלה את הטמאין מטומאתן אינו מציל על הטהורים מליטמא

Version #2: Some texts say 'a Mikveh elevates (is Metaher) Teme'im from their Tum'ah, but it does not save Tehorim from becoming Tamei;

אדם שאין מעלה את הטמאים מטומאתן אינו דין שלא יציל על הטהורים מליטמא

A man, who does not elevate Teme'im from their Tum'ah, all the more so he should not save Tehorim from becoming Tamei!'

All the more so he should not save Tehorim from becoming Tamei! If he swallowed a Tahor ring and entered Ohel ha'Mes, he should not save the ring from becoming Tamei...

ואפי' הכי מציל דטהרה בלועה לא מטמאה כדאיתא בפרק בהמה המקשה (חולין עא:)

Even so, he saves, for swallowed Taharah does not become Tamei, like it says in Chulin (71b).

Inference: We do not learn such a Kal va'Chomer from what already took effect, to what did not yet take effect. This has its law, and this has its law. It does not depend on leniency or stringency;

Also here, even though a husband annuls Nedarim that already came to Isur, we do not judge a Kal va'Chomer that he can annul those that did not yet come to Isur.

ואיכא תו הכא גירסא אחרינא דגרסי הכי ומה אדם שאין מעלה את הטמאים מטומאתן מציל על הטהורים מליטמא

Version #3: There is another text, which says that man does not elevate Teme'im from their Tum'ah, but he saves Tehorim from becoming Tamei;

מקוה שמעלה את הטמאים מטומאתן אינו דין שיציל על הטהורים מליטמא

A Mikveh, which elevates Teme'im from their Tum'ah, all the more so it should save Tehorim from becoming Tamei!

ופשוטה היא עם מה שכתבתי דה"ק ליה אי ק"ו דידך איתיה נדון נמי קל וחומר במקוה שיציל על הטהורים מליטמא

This is clear, based on what I wrote. They said [to R. Eliezer] as follows. If your Kal va'Chomer is correct, we should learn also a Kal va'Chomer to teach that a Mikveh saves Tehorim from becoming Tamei!

ואפי' הכי את גופך מודית דלא דיינינן ליה דודאי מקוה אינו מציל אף על פי שמעלה

Even so, you yourself agree that we do not judge [such a Kal va'Chomer]. Surely, a Mikveh does not save, even though it elevates;

בעל נמי לא מעכב חלות נדריה אף על פי שמפר אותן

Also a husband cannot stop her vows from taking effect, even though he annuls them!

Implied question: According to this text, it would have sufficed for Rabanan to judge like this. A Mikveh elevates Teme'im from their Tum'ah. All the more so it should save Tehorim from becoming Tamei!

דק"ו דדאין ר"א במתני' בכי האי גוונא בלחוד איתיה ובכי הא בלחוד שפיר מוכחי רבנן לר"א דמדהא ליתיה דידיה נמי ליתיה

The Kal va'Chomer that R. Eliezer judges is only in this case. In this case alone, Rabanan properly prove to R. Eliezer, that since this [Kal va'Chomer] is not true, also his is not true!

אפי' הכי אלומי הוא דמאלמי לפרכייהו ומרכבי ליה להאי ק"ו אתרי רכשי מחומרא וקולא ומאי (הגהות ישנות) דחייל ומאי דלא חייל דומיא דק"ו דדאין ר"א ומחומרא וקולא דאדם ומקוה

Answer #1: Even so, they strengthened their question, and bolstered the Kal va'Chomer with two powers, from stringency and leniency, and what took effect and what did not take effect. This is like the Kal va'Chomer that R. Eliezer judged, and from the stringency and leniency of a man and a Mikveh.

ומוכחי (הגהות ישנות) ליה דאע"ג דהאי ק"ו עדיף טפי מדידיה אפ"ה לא דיינינן ליה

They proved to him that even though this Kal va'Chomer is better than his, even so, we do not judge it;

Inference: This shows that we do not judge leniency and stringency from what took effect over what did not take effect. This has its law, and this has its law;

All the more so we do not judge the Kal va'Chomer of R. Eliezer, which is weaker!

Answer #2: Alternatively, this Kal va'Chomer comes to refute the Kal va'Chomer of R. Eliezer in the Beraisa;

In a place where one cannot annul his own vow, after he vowed... This Kal va'Chomer [of Rabanan] is truly similar to this one [of R. Eliezer in the Beraisa].

THE RAN EXPLAINS THE GEMARA

Gemara: Say [oppositely based on] the Seifa! If we immerse a Kli to be Metaher it, we should be able to immerse a Kli...

רבנן נמי הוא דפרכי לר"א פירכא אחרינא דלפום קל וחומר דידיה הוה מצינן למידק דכיון שמטבילין כלי טמא ליטהר כ"ש שמטבילין אותו שלאחר שיטמא יעלה מטומאתו

Explanation: Also the Seifa is Rabanan. They ask a different question. According to [R. Eliezer's] Kal v'Chomer, we could have inferred that since we immerse a Tamei Kli to be Metaher it, all the more so we can immerse it so after it will become Tamei, it will rise (become Tahor) from its Tum'ah!

ואת גופך מודית דלא דיינינן כי האי גוונא אלמא ק"ו דידך ליתיה.

And you yourself agree that we do not make such a Kal v'Chomer. We infer that your Kal v'Chomer is invalid!

Gemara: We learn from this that they take effect.

מדאמרו ליה לכשיטמא ליטהר דאי לא הוה להו למימר יטבילו כלי שיציל עליו מליטמא כדאמרינן לעיל.

Explanation: Since they said to him 'when it will become Tamei, it will become Tahor.' If not (they do not take effect), they should have said 'they should immerse a Kli to save it from becoming Tamei', like we said above!

Gemara: They said.

בני הישיבה דמהא ליכא למשמע מיניה.

Explanation: The Bnei Yeshivah, that from here we cannot infer.

Gemara: Come and learn. R. Eliezer said, Tamei seeds, once one seeded them in the ground, they become Tahor.

נפקא לן מדכתיב על כל זרע זרוע אשר יזרע טהור הוא.

Explanation: We learn from "Al Kol Zera Zaru'a Asher Yizare'a Tahor Hu."

Gemara: They are already seeded.

Explanation: And Tum'ah touched them afterwards. All the more so they should be Tehorim!

And you admit to me about this Kal v'Chomer.

Source: For if not, granted, you hold that Tamei seeds that were planted were purified from their Tum'ah via seeding. What was already planted, what is the source [that it does not become Tamei]?

אלא ודאי ק"ו כי ה"ג מיניה וביה דייניתו ואמאי לא מודיתו לי בקל וחומר דמתני'.

Conclusion: Rather, surely we make such a Kal v'Chomer from the matter itself. Why don't you admit to me about the Kal v'Chomer of our Mishnah?

Gemara: We learn from this that they do not take effect.

דודאי בזרעים טמאים הכי דיינינן שלא תחול בהם טומאה דאי חיילא במאי פקעה

Explanation: Surely for Tamei seeds, we make such a Kal v'Chomer that Tum'ah not take effect on them (i.e. on what was planted), for if it takes effect, how will it be uprooted?

ור"א זרעים הוא דמדמה לנדרים אלמא ס"ל לר"א בנדרים דלא חייל.

And R. Eliezer compares seeds to Nedarim. We infer that R. Eliezer holds that Nedarim do not take effect.

RAN DH v'Rabanan Lo Darshei Kal va'Chomer [TRANSLATION: And Rabanan do not expound a Kal v'Chomer.]

Explanation: Why do they argue with R. Eliezer? Don't they agree that we expound a Kal va'Chomer from what took effect to what did not take effect? A Beraisa teaches that we judge such a Kal va'Chomer!

Implied question: Why did the Gemara ask from this Beraisa, and not from the Kal va'Chomer of seeds that R. Eliezer said to them?

Answer #1: The Gemara was unsure about Rabanan's opinion about what was already seeded. Therefore, it asks from this Beraisa, for no one argues with it.

אי נמי אפשר דסבירא להו לרבנן דלזרועין ועומדין לא צריך קל וחומר דמקרא דעל כל זרע זרוע גופיה נפקי כך נראה בעיני.

(d)

Answer #2: Perhaps Rabanan hold that what was already seeded does not need a Kal va'Chomer. We learn from the verse itself "Kol Zera Zeru'a." So it seems to me.

(a)

Gemara: One who was already sold, goes out [to freedom].

בסימנין.

Gemara: She was not sold.

Gemara: It is not all the more so that she cannot be sold?

Explanation: Yes, normally [Chachamim] expound [such] a Kal va'Chomer. However, here is different, for the verse uproots it.

ומקשו הכא א"כ דאי לאו קרא מודו רבנן לר"א בק"ו דידיה מאי מהדרי ליה מקוה יוכיח דהא אינהו גופייהו מודו ליה אלא דקרא קדרשי

Question: If so, that if not for the verse, Chachamim would agree to R. Eliezer's Kal va'Chomer, why did they say that a Mikveh disproves him? They themselves agree [to his Kal va'Chomer], just they expound a verse!

ואיכא למימר דהכי אמרי ליה לא תדחוק נפשך למדחי דרשא דילן משום קל וחומר דידך דמקוה יוכיח דאיכא למידן קל וחומר ואתא קרא ואפקיה

Answer: They say to him as follows. Do not force yourself to reject our Drashah due to your Kal va'Chomer. A Mikveh proves that we can learn from a Kal va'Chomer, and a verse overrides it!

דמקוה שאינו מציל מדרשא נפקא לן מדכתיב והנוגע (כן צריך להגיה) בנבלתם יטמא הלל אומר אפילו הן בתוך המים

We know from a Drashah that a Mikveh does not save, since it says veha'Noge'a b'Nivlasam Yitma" - Hillel says, even if they are in the water;

A man saves swallowed Taharah. Also this is learned from a verse. This shows that a verse overrides a Kal va'Chomer!

וכי האי גוונא בהפר' נדרים נמי לא תפלוג אדרשא דילן לקיומי ק"ו (דילן) [דילך]

And similarly regarding Hafaras Nedarim, do not argue with our Drashah in order to sustain your Kal va'Chomer!

דכי היכי דהתם את גופך מודית דאתא קרא ואפקיה הכא נמי אתא קרא ואפקיה

Just like there, you yourself agree that the verse overrides [the Kal va'Chomer], also here, the verse overrides it!

Implied question: Until now, we thought that Rabanan challenge him, that we cannot learn such a Kal va'Chomer of leniency and stringency at all!

Answer: In the conclusion of our Sugya, we conclude that they say that a Mikveh proves that a verse comes and overrides such a Kal va'Chomer.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. הפרת נדרים כל היום

Mishnah: Hafaras Nedarim is the entire day.

יום השמיעה.

Explanation: The day that he heard.

ר"ן ד"ה להקל ולהחמיר

Mishnah: To be lenient and to be stringent.

לאו דוקא להקל ולהחמיר דהא לא שייכא קולא וחומרא הכא

Remark: This is not precise, for leniency and stringency does not apply here.

אלא ה"ק פעמים שזמנו מרובה פעמים שזמנו מועט לאפוקי מעת לעת דלעולם זמנו שוה.

Explanation: Rather, it means as follows. Sometimes the time [to annul] is great, and sometimes it is small. This excludes me'Es la'Es, which is always the same (24 hours).

Mishnah: If she vowed on Shabbos night.

Implied question: The same applies to a weekday! Why does it discuss Shabbos?

שנדרה בשבת סמוך לחשכה מפר עד שלא תחשך והיינו להחמיר

Explanation: She vowed on Shabbos close to dark. He can annul before it gets dark. This is the stringency.

ובדין הוא דליתני אינו מפר אלא (לכשתחשך) +מסורת הש"ס: [עד שתחשך]+ כיון דלהחמיר קתני

(b)

Implied question: Really, it should have taught "he can annul only until it gets dark", since it taught "to be stringent" (it should stress the stringency)!

אלא להכי תנא האי לישנא משום דשייך ביה טפי מאי דמסיים מלתיה שאם קודם חשכה לא הפר אינו יכול להפר

(c)

Answer: It taught these words (before it gets dark) for they fit better than with his final words "if he did not annul before dark, he cannot annul";

דאשמועינן בהאי לישנא דמפירין נדרים בשבת אפילו שלא לצורך השבת

These words teach that we may annul vows on Shabbos even not for the need of Shabbos;

Gemara: The verse says "on the day he hears."

דמשמע יום השמיעה בלבד.

Explanation: This implies only the day that he heard.

ר"ן ד"ה דכתיב מיום אל יום

Gemara: For it is written "mi'Yom El Yom."

דמשמע מעת לעת שיעור שיש בין תחילת יום אחד לתחילת יום אחר דהיינו עשרים וארבעה שעות.

Explanation: This implies me'Es la'Es, the amount between the beginning of one day and the beginning of another (the next) day, i.e. 24 hours.

Gemara: I might have thought only during the day, but not at night.

Explanation: Perhaps 'Yom' implies so.

Explanation: This implies that from the end of the day before he heard, until the end of the day that he heard. I.e. she vowed at the beginning of the night; he can annul at night and during the day, until its end.

Gemara: From Sunday until Sunday.

דהכי משמע קרא מיום שמיעה עד יום כיוצא בו.

Explanation: So the verse implies - from the day that he heard until a similar day.

Gemara: It is written "on the day that he hears."

דאינו מפר אלא יום שמיעה

Explanation: He can annul only [on] the day that he heard.

Consequence: Therefore, you are forced to say that "mi'Yom El Yom" is only to give the amount of 24 hours.

Gemara: My dear one.

ר' חייא שהיה דודו של רב

Explanation: R. Chiya, who was Rav's uncle.

וקי"ל הכי דהפרת נדרים כל היום ותו לא וכסתם מתני'.

Ruling: We hold like this, that Hafaras Nedarim is the entire day, and no further, and like our Stam Mishnah.

Gemara: Chiya bar Rav would throw an arrow and check.

אגב גררא דרב מייתי הכא הא דחייא בר רב

Remark: Along with [the words of] Rav, we bring here [the practice of] his son Chiya.

שדי גירא ובדיק בעוד שהיה מתעסק לירות חצים היה בודק אדם הבא לפניו להתיר נדרו

Explanation: He would throw an arrow and check. While he was shooting arrows, he would check a man who came in front of him to permit his vow;

שואלו אם מתחרט ומתירו דקסבר פותחין בחרטה ומשום הכי לא היה צריך עיון למצוא פתח.

He would ask him if he regrets, and permit him. He holds that we are Pose'ach with regret, therefore he did not need investigation to find a Pesach.
