However, who will tell us that "Al Da'as" implies so (the vow lasts only if the person mentioned wants it), that we will say that one who vows "Al Da'as Ploni", that Ploni can permit him?! Rather, surely it is like I wrote.

Mishnah: A Shomeres Yavam... R. Eliezer says, he can annul.

מסקינן בגמרא דיפר בשותפות אב קאמר ובשעשה בה מאמר.

Explanation: We concluded in the Gemara that he says that he can annul in partnership with the father, and when he gave to her a Ma'amar.

ר"ן ד"ה רבי יהושע אומר לאחד ולא לשנים

Mishnah: R. Yehoshua says, to one, but not to two.

משום דס"ל אין ברירה וכדמפרש בגמרא בס"ד.

Explanation: It is because he holds that Ein Bereirah, and like we will explain in the Gemara with Hash-m's help.

Mishnah: R. Akiva says, not to one, and not to two.

דגריע ליה יבם מארוס ואפי' בשותפות לא מצי מיפר.

Explanation: He holds that a Yavam is weaker than an Arus, and even in partnership, he cannot annul.

Mishnah: And what [is the law] of a woman that he himself acquired...

Explanation: She is not a Shomeres Yavam. Rather, he was Mekadesh her to himself; he can annul her vows in partnership with the father.

Explanation: I.e. a Shomeres Yavam. She is acquired to him without Kidushin, for she is forbidden to all men until he does Chalitzah to her. It is not all the more so that he can annul her vows in partnership with the father?!

Mishnah: Akiva, your words apply to two Yevamim.

דכל אחד יש לו רשות בה.

Explanation: Just the contrary (not only is there Zikah. In fact,) Zikah is stronger than Eirusin. She (a Shomeres Yavam) is like a Nesu'ah. Therefore, the Yavam can annul alone. So we are thinking now;

מיהו אין ברירה דהיכא דשני יבמין אין ברירה למי היא זקוקה ולמי תהיה לאשה ומש"ה אפילו שניהם אינן יכולין להפר

However, Ein Breirah. When there are two Yevamim, there is no Breirah (retroactive clarification) to whom she is Zekukah and (i.e.) to whom she will be a wife. Therefore, even both of them cannot annul [in partnership];

דכיון דבשעת הפרתן אין ברור לנו מי הוא אישה אין הפרתן כלום דרחמנא אמר אישה יקימנו ואישה יפירנו דבעינן שיהא ידוע בשעת הפרה

Since at the time they annul, it is not clear to us who is her husband, the Hafarah has no effect. The Torah said "Ishah Yekimenu v'Ishah Yeferenu." [Her husband] must be known at the time of Hafarah.

וכן כתב רש"י ז"ל בפרק ד' אחים (יבמות כט:) וסוגיא דשמעתא דהתם מסייע ליה

For so we find in Yevamos (51b) that R. Gamliel holds that Ma'amar acquires a total Kinyan, like Beis Shamai, and even so he holds that his brother can forbid her to the Yavam via a Get or Bi'ah;

וכיון שכן היכי משוית לה כנשואה או כארוסה הא מגרע גרעה

Since this is so, how can you consider her like a Nesu'ah or Arusah? She is less [attached to the Yavam than even an Arusah]!

דארוסה לא מצי איניש למיסרה על הארוס ואחוה מצי למיסרה על היבם.

An Arusah, a man cannot forbid her to the Arus. [Here,] the brother can forbid her to the Yavam!

Note: An adult Arusah who willingly has Bi'ah with another man, she forbids himself to her Arus. A brother can forbid a Yevamah to the Yavam against her will. And in any case, others cannot forbid an Arusah via a Get. (PF)

Citation (Yevamos 29a - Mishnah): If there were three brothers, and two of them were married to sisters, and the third was single, and a husband of a sister (call her Leah) died, and the single brother gave a Ma'amar [to Leah], and his other brother died...

Citation (cont.): Beis Shamai say, he keeps his wife (Leah), and the other (her sister) goes out (without Chalitzah or Yibum), for she is considered Achos Ishah;

This is why R. Elazar said to dispel the Tzarah, i.e. to dispel [Leah's] sister, so she will not forbid [Leah] due to Achos Zekukaso (one may not marry the sister of his Shomeres Yavam). Ma'amar makes her (Leah) like a Nesu'ah [so it is as if her sister does not fall to Yibum at all];

אבל אינו קונה קנין גמור דאי בעי לאפוקה לא סגי לה בגיטא.

ii.

However, [Ma'amar] does not acquire a total Kinyan. If he wants to divorce [Leah], a Get does not suffice. (She needs also Chalitzah.)

Rabanan argue with R. Eliezer above in the Mishnah of a Bogeres. They hold that even though he feeds her, he does not merit to annul her vows;

The Stam opponent of R. Eliezer is [assumed to be] R. Yehoshua, for everywhere he argues with him;

Answer #2: Rabanan who argue with R. Eliezer in the Mishnah of a Bogeres are not R. Yehoshua. R. Eliezer and R. Yehoshua both hold that whenever an Arus must feed her, he can annul [alone];

When there is one Yavam, and he stood in judgment and fled, indeed [both agree that he can annul alone];

However, when there are two Yevamim, and one of them stood in judgment and fled, they argue. R. Eliezer holds that also this Yavam, since he stood in judgment and fled, he is like an Arus. She vows with intent for him;

R. Yehoshua holds that a Yevamah is not totally [acquired] to the Yavam like an Arusah is totally [acquired] to an Arus;

An Arusah, a man cannot forbid her to the Arus. Therefore, whenever he feeds her, she vows with intent for him;

דאם בא עליה בלא חופה קני לה ליורשה וליטמא לה תפשוט מר"א דנישואין עושה

Explanation: [If it makes Nisu'in,] if he had Bi'ah with her without Chupah, he acquired her to inherit her and become Tamei for her (if he is a Kohen). We should resolve from R. Ami that it makes Nisu'in!

דהא אמר ר"א יפר וקס"ד דמפר לחודיה בלא שותפות

This is because R. Eliezer said "Yafer" (he can annul), and we are thinking that this means that he can annul alone, without partnership.

ומסקינן לעולם אימא לך דאירוסין עושה ומאי יפר בשותפות קאמר,

We conclude that really, I can say that [Ma'amar] makes Eirusin. "Yafer" means with partnership.

ואיכא למידק היכי הוה סליק אדעתיה מעיקרא דיפר לחודיה קאמר והא ממתני' משמע דבשותפות דוקא קאמר דא"ר אליעזר

Question: How could we think initially that "Yafer" means alone? Our Mishnah connotes that R. Eliezer holds [that he annuls] only with partnership!

ומה אם אשה שקנה הוא לעצמו הרי הוא מפר נדריה אשה שהקנו לו מן השמים אינו דין שיפר נדריה

A woman that he acquired himself, he can annul her vows. A woman that Shamayim was Makneh to him, all the more so he can annul her vows!

והאי ק"ו לא סגי אלא להפר בשותפות

This Kal va'Chomer suffices only [to teach] that he annuls with partnership!

Even if you will say that R. Eliezer holds that Ma'amar makes Nisu'in, how is it proven from the Kal va'Chomer that according to R. Akiva, he can annul alone?

לימא ליה ר"ע אנא לא סבירא לי דנישואין עושה כדקאמרת

R. Akiva can say to him, I hold that Ma'amar does not make Nisu'in, [un]like you say!

אלא ודאי להפר בשותפות דייק ליה ר"א האי ק"ו דס"ל דלא גרע יבם מארוס

Conclusion: Rather, surely R. Eliezer learns from the Kal va'Chomer that he annuls with partnership. He holds that a Yavam is no worse than an Arus.

והיינו נמי דקמהדר ליה ר"ע אין היבמה גמורה לאישה כשם שהארוסה גמורה לאישה דה"ג במתני' במקצת נסחי

Support: This explains why R. Akiva answered him that a Yevamah is not totally [acquired] to the Yavam like an Arusah is totally [acquired] to an Arus. This is in some texts of the Mishnah.

Inference: R. Eliezer made his Kal va'Chomer only to equate a Yavam to an Arus. How could we think that R. Eliezer holds that a Yavam annuls alone?!

Answer: We thought that R. Eliezer addresses R. Akiva according to R. Akiva's reasoning;

He says to him as follows. Granted, you hold that Ma'amar does not make Nisu'in. However, admit to me that he annuls with partnership, for a Yavam is no worse than an Arus!

ואהדר ליה ר"ע אין מגרע גרע שאין היבמה גמורה לאישה שאין חייבין עליה סקילה כנערה המאורסה וכדמפ' לקמן,

R. Akiva answered him that a Yavam is worse than an Arus, for a Yevamah is not totally [acquired] to her 'husband' (i.e. Yavam), for one (any other man) is not stoned for [Bi'ah with] her, like one is for a Na'arah Me'orasah, like we explain below (75a).

ומקשו הכא תו למאי דמסקינן מאי יפר יפר בשותפות אמאי לא פרכינן מי קתני יפרו יפר קתני כדפרכינן ביבמות

Question: [Meforshim] asked further, according to the conclusion that he annuls in partnership, why don't we ask "the Mishnah does not say 'they annul.' It says 'he annuls'!", like we ask in Yevamos?

י"ל דהתם הוא דפרכינן הכי משום דאכתי לא קים לן דאיכא לתרוצה בשעמד בדין וברח דבתר דאקשינן מי קתני יפרו יפר קתני מוקמינן לה התם בהכי

Answer: There, we ask so because we still did not know that we can establish it when he stood in judgment and fled. After we ask "it does not say 'they annul'; it says 'he annuls'!", we establish it there like this (he stood in judgment and fled);

אבל הכא דאתמר האי פרוקא לעיל אי הוה פריך ליה מי קתני יפרו ידע דהוה מוקי ליה בשעמד בדין וברח ומש"ה לא איכפת ליה לאקשויי.

However, here, this answer (he stood in judgment and fled) was said above. Had we asked "it does not say 'they annul'", he knew that he would establish it when he stood in judgment and fled. Therefore, he was not concerned to ask.
