RAN DH Im Timtzi Lomar Ha Lo Amar Lah [TRANSLATION: If you will say behold, he did not tell her.]

(SUMMARY: The Ran resolves a contradiction in inferences.)

(a)

Inference: These words imply that had he said "today it is Mekuyam for you, and annulled tomorrow", obviously this helps.

(b)

Implied question: Below, it connotes that this would not help!

1.

He later asked, if he said "it is annulled for you tomorrow", what is the law?...

2.

[It continues] or, since he did not say "it is Mekuyam for you today", when he said "it is annulled for you tomorrow", he means from today;

i.

Inference: It is obvious to Rabah that if he said "it is Mekuyam for you today, and annulled for you tomorrow", it does not help. The inferences contradict each other!

(c)

Answer: In all of these cases, Rabah is unsure. When he said "if you will say 'since he did not say...'", this is an abbreviated expression;

1.

Indeed, he should have said "if you will say 'since he did not say...' And further, even if he said so, [perhaps] it does not help."

2)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: If you will say that since he affirmed it today, tomorrow, it is as if [the vow] persists...

1.

Explanation: Since he said 'it is annulled for you tomorrow', this implies that he affirmed it today. And since he affirmed it today, it is as if it is [permanently binding], for tomorrow is not a time of Hafarah.

(b)

Gemara: 'It is affirmed for a Sha'ah', what is the law?

1.

Explanation: A Sha'ah and after a Sha'ah is unlike today and tomorrow, because the entire day it can be annulled. (Therefore, we cannot learn from 'It is affirmed today.')

(c)

Gemara: And he said 'and I', he cannot annul.

1.

Explanation: Since he said "and I", that he was Tofes in her Nezirus (he made himself a Nazir, like she is), he revealed that he is pleased [with her Nezirus]. It is as if he was Mekayem her Nezirus. Therefore, he cannot annul it.

3)

RAN DH v'Amai Neima va'Ani d'Amar... [TRANSLATION: Why is this? We should say that 'and I' refers to himself, that he is a Nazir!]

(SUMMARY: The Ran explains the resolution from here, and its rejection.)

(a)

Explanation: I.e. he intends to be a Nazir, therefore he was Tofes in her Nezirus;

1.

However, her Nezirus, granted he was forced to be Mekayem it for a moment, for if not, he could not be Tofes in it...

i.

However, afterwards, if he wants, he should be able to annul it, if it is true that when he said "it is Mekuyam for you for a Sha'ah, and annulled for you after a Sha'ah", it helps.

2.

Surely, if it helps, it makes no difference whether he said so at once, or he said "it is Mekuyam for you for a Sha'ah", and afterwards he said "it is annulled for you."

3.

Conclusion: [The Gemara answers] Rather, surely this is why he cannot annul [her Nezirus], for once he was Mekayem it [even for a Sha'ah], it is Mekuyam!

(b)

Explanation (cont.): The Gemara rejects this. We cannot resolve the question from here. Indeed, afterwards he can annul;

1.

Rather, here he cannot annul [her Nezirus], for since he said "and I", it is as if he said "it is Mekuyam forever."

(c)

Ruling: This question is not resolved. We are stringent. Therefore, it is not Hafarah.

4)

THE RAN EXPLAINS THE MISHNAH

(a)

Mishnah: If the father died, the husband does not receive authority.

1.

Explanation: The husband cannot annul.

(b)

Mishnah: The husband annuls during Bagrus.

1.

Explanation: The Gemara will explain this.

(c)

Gemara: What is the reason? The verse says "bi'N'ureha Beis Aviha."

1.

Explanation: Why does the husband not receive authority [when the father dies], like a father [receives authority when the husband dies]?

2.

Remark: This is why here we ask what is the reason [that the husband does not receive authority], and below, when the husband died and the father received authority, we ask 'what is the source of this?' (Here, we ask why the husband is unlike the father.)

(d)

Gemara: "Bi'N'ureha Beis Aviha."

1.

Explanation: This implies that even though the father is not [alive], Beis Aviha is.

(e)

Gemara: "V'Im Hayo Sihyeh l'Ish".

1.

Explanation: Above is written Hafarah of the father, and next to it "v'Im Hayo Sihyeh l'Ish" - this implies two Havayos (Kidushins).

70b----------------------------------------70b

(f)

Gemara: This equates the first Havayah (Kidushin) to the second.

1.

Explanation: I.e. the law of the second is like the law of the first;

i.

Just like [vows] before the first [Kidushin], the father can annul [them] alone, also those before the second, after the husband died, the father annuls alone.

(g)

Gemara: Perhaps this is only vows that were not Nir'eh to the Arus (he had no opportunity to annul them).

1.

Explanation: This is like vows before her first Kidushin, which were not Nir'eh to the Arus at all.

(h)

Gemara: However, vows that were Nir'eh to the Arus...

1.

Explanation: I.e. he heard them before he died - really, I can say that he cannot annul them!

5)

RAN DH u'Mehadrinan Lei bi'Ndarim... [TRANSLATION: We answer him, vows that were not Nir'eh to the Arus, we know them from "bi'N'ureha Beis Aviha."]

(SUMMARY: The Ran explains when the father annuls alone, and why.)

(a)

Explanation: [He can annul them] because the Arus did not merit [opportunity to annul] them at all;

1.

We need the Hekesh to vows that were Nir'eh to the Arus, to teach that the father can annul them alone.

(b)

Distinction: This is only before she became Mekudeshes;

1.

After she became Mekudeshes, a Beraisa below (71a) explicitly teaches that her father and latter husband annul her Nedarim, because this is unlike before her first Kidushin.

6)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: What is the case?

1.

Explanation: In which a husband annuls during Bagrus.

(b)

Gemara: How is this? Death takes her out of the father's Reshus.

1.

Explanation: Once he died, his rights were uprooted. He cannot bequeath them to his sons.

2.

Source: We learn from "v'Hisnachaltem Osam li'Vneichem", but rights in your daughters are not to your sons (Kesuvos 43a).

(c)

Gemara: And Bagrus takes her out of the father's Reshus.

1.

Source: It says "bi'N'ureha Beis Aviha", and not a Bogeres.

(d)

Gemara: Also Bagrus, the husband does not receive authority.

1.

Explanation: Because the father's Reshus was on her before Bagrus, for when he was Mekadesh her, she was a Na'arah.

(e)

Gemara: Rather, he was Mekadesh her when she was a Bogeres.

1.

Explanation: And you want to say that since there is no Reshus of her father over her, once she reached the time that Chachamim gave to an Arus and Arusah to finance themselves (prepare needs of the Nisu'in)...

2.

Since from then and onwards, the husband is obligated to feed her, like it says in Kesuvos (57a), he can annul.

7)

RAN DH Ha Tanina Chada Zimna [Behold, this was [already] taught once!]

(SUMMARY: The Ran explains that the Gemara interjected before the question finished.)

(a)

Explanation: [This was already taught] in this Perek. [The Gemara asks] why do we need two [Mishnayos teaching the same matter]?

(b)

Before the Makshan finished his question, we are meticulous about the latter Beraisa, and explain it, why she has 12 months [to prepare for Chupah]. Thirty days should suffice for her!

1.

Rav Huna holds like this in Kesuvos (57b), that Chachamim allotted only 30 days for a Bogeres. After this [time], her husband is obligated to feed her [and he can annul her vows].

(c)

Implied question: Rav Huna was refuted there!

(d)

Answer: Also there, we conclude that whenever 12 months passed from Bagrus, if she became Mekudeshes afterwards, she has only 30 days;

1.

The only case in which she gets 12 months [in Bagrus] is when she became Mekudeshes on the day that she began to become Bogeres.

i.

Note: It is unreasonable to say that if she became Mekudeshes within 12 months of Bagrus, she gets 12 months, and if she became Mekudeshes after 12 months of Bagrus (even one day later), she gets only 30 days! Rather, surely the Gemara means that a Bogeres always gets until 12 months after Bagrus, and in any case (e.g. if this is less than 30 days) she gets at least 30 days.

2.

Therefore, we ask here "how did the Tana teach uniformly "a Bogeres who waited 12 months"? The only fixed time for which a Bogeres cannot get less than this, is 30 days!

i.

However, we do not find a Bogeres who became Mekudeshes who needs 12 months, except for one who became Mekudeshes on the first day of her Bagrus;

ii.

For this rare case, the Tana should not have taught [Stam] 12 months for a Bogeres.

8)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: We answer [that the Mishnah means] 'a Bogeres or one who waited 12 months.'

1.

Explanation: I.e. a Bogeres like her law; her time is more or less (between 30 days and 12 months), like I wrote, and a Na'arah who waited the time fixed for her, i.e. 12 months. [In both cases] since her husband must feed her, he can annul [her vows].

(b)

Gemara: In any case it is difficult.

1.

Explanation: Why are there two [Mishnayos about] a Bogeres?

9)

RAN DH Ibo'is Eima [TRANSLATION: If you want to say.]

(SUMMARY: The Ran explains this opinion to mean that the Tana began teaching it here.)

(a)

Explanation: Here, Bogeres is Davka (it is primarily taught here). It was taught there, because R. Eliezer and Rabanan needed to argue [about a Bogeres];

1.

Therefore, it was taught again there, to teach that this is not unanimous.

(b)

Question: The words of the Gemara are difficult. It says that Bogeres here is Davka;

1.

Just the contrary! The latter Mishnah is Davka. It needs [to teach] the law itself, that we should not rely on the first Stam [Mishnah], for it is a Stam followed by a Machlokes! (In such a case, the Halachah does not necessarily follow the Stam.)

(c)

Answer: When the Gemara says that Bogeres here is Davka, this is not precise. Rather, it means that the latter Mishnah is drawn after the first Mishnah;

1.

The Tana did not begin [in that Mishnah] to teach the law of Bogeres, rather, in our first Mishnah it began to teach it;

i.

Afterwards, in the other Mishnah, he teaches that we should not rely on the first Stam, for not all agree with it.

10)

THE RAN EXPLAINS THE GEMARA

(a)

Gemara: And if you want to say, Bogeres there is Davka.

1.

Explanation: There, the Tana began to teach the law of Bogeres;

2.

The first Mishnah does not have the law of Stam. Rather, since the Reisha taught 'in this, the father has more power than the husband', it taught also, according to one Tana, that in another matter, the husband has more power than the father.
