Explanation #1: Some say that this is only when the Neder was for the need of his friend, like the Neder that Moshe made to Yisro to dwell with him for his (Yisro's) benefit, and Tzidkiyahu's Neder to Nebuchadnetzar brought below, which was for his (Nebuchadnetzar's) benefit, lest people disgrace him;

אבל נדר שנדר שלא לצורך חבירו מתירין לו שלא בפניו

However, a Neder not for the need of his friend, we permit him not in front of him (the friend).

ומסתברא דהא מילתא תליא במאי דפליגי בירושלמי בטעמא דאין מתירין לו אלא בפניו

Assertion: Presumably, this depends on the argument in the Yerushalmi about why we permit him only in front of him;

דאיכא מ"ד התם דטעמא דמילתא מפני הבושה כלומר שיתבייש מחבירו שהנדר היה להנאתו ועכשיו רוצה שיתירו לו

One opinion says that the reason is due to shame. He will be embarrassed of his friend, for whose benefit the vow was made, and now he wants that they will permit him;

והאי טעמא לא שייך אלא כשהנדר היה להנאתו הא לאו הכי משמע דמתירין אותו אפילו שלא בפניו

This reason applies only when the vow was for his benefit. If not, it connotes that we permit him even not in front of him;

מיהו איכא דיהיב טעמא התם מפני החשד כלומר שחבירו שהוא מודר ממנו לא ידע בהתירו וכשהוא נהנה ממנו יחשדנו שהוא עובר על נדרו

However, one opinion there says that it is due to suspicion. I.e. the friend from whom Ploni is Mudar does not know about the Heter. When he (Ploni) benefits from him, he (his friend) will think that he transgresses his vow.

ולהאי טעמא אפי' נדר שהוא שלא להנאת חבירו אין מתירין לו אלא בפניו דאיכא חשדא

According to this reason, even if the vow was not for his benefit, we permit him only in front of him, for there is suspicion.

ותו איכא בין הני תרי לישני דלמ"ד מפני החשד כל שהודיעוהו מתירין לו אפילו שלא בפניו דתו ליכא חשדא

Observation: There is another difference between these versions. According to the opinion that it is due to suspicion, as long as they informed him, we permit him even not in front of him, for then there is no suspicion;

ולמ"ד מפני הבושה אפי' הודיעוהו דוקא בפניו דכל שלא בפניו ליכא בושה.

According to the opinion that it is due to shame, even if they informed him, we permit him only in front of him, for whenever he is not in front of him, there is no shame.

RAN DH v'Heicha d'Havi Befanav... [TRANSLATION: And when it is in front of him, and against his friend's will.]

(SUMMARY: The Ran discusses whether Heter not in front of him helps b'Di'avad.)

פשיטא דמתירין בנדר שאינו להנאתו של חבירו אבל בנדר שהוא להנאתו ודאי אין מתירין לו אלא מדעתו וכן כתב ר"ת ז"ל

Ruling: Obviously, [in front of him, and against his friend's will,] we permit a Neder that is not for his friend's benefit. However, a Neder that is for his friend's benefit, we permit only with his [friend's] consent. Also R. Tam said so.

מיהו היכא שהתירוהו שלא מדעתו אי שרי נדרו או לא צריכא עיונא

Question: However, when they permitted him without his [friend's] consent, this requires investigation whether or not it is permitted.

דבפרק השולח משמע דדיעבד הותר הנדר

Answer #1: In Gitin (35b) it connotes that b'Di'avad, the vow is permitted;

דאמרי' התם (גיטין לה:) גבי התקין ר"ג שתהא נודרת ליתומים וכו' ל"ש אלא שלא נשאת ופרכינן וליחוש דלמא אזלא לגבי חכם ושרי לה

It says there regarding R. Gamliel's enactment that a widow vows to orphans [that she did not receive anything from her Kesuvah, in place of the Shevu'ah that was initially enacted] "this is only if she did not [yet] remarry." The Gemara asked "we should be concerned lest she go to a Chacham, and he will permit her!"

ואי דיעבד נמי לא מהני כי אזלא גבי חכם מאי הוי דהא נדר אלמנה להנאת יתומים הוא

If also b'Di'avad it does not help, even if she goes to a Chacham, it does not matter, for a widow's vow is for the orphans' benefit!

אלא ש"מ דאפי' להנאת חבירו כל שהתירוהו בדיעבד מותר

Inference: Even a Neder that is for his friend's benefit, in any case that it was permitted, b'Di'avad he is permitted.

וה"נ מדשרו ליה סנהדרין לצדקיהו ואי אפילו בדיעבד אינו מותר היכי הוי שרי ליה לצדקיהו לגלויי מילתא משמע דיעבד שרי

Support: [We learn this] also from the Sanhedrin's Heter for Tzidkiyahu. If even b'Di'avad it is not permitted, how was he allowed to reveal the matter? This implies that b'Di'avad, it is permitted.

וכ"ת אכתי קשיא דנהי דדיעבד שרי לכתחלה מיהו אסור והיכי שרו ליה סנהדרין לצדקיהו

Question: Still, this is difficult. Granted, b'Di'avad it is permitted. However, l'Chatchilah it is forbidden. How did the Sanhedrin permit Tzidkiyahu?

איכא למימר דלדבר מצוה מתירין וצדקיהו הוה מצטער ביותר כשלא היה יכול לגלות ומתבטל ע"י כך ממלאכת שמים

Answer #1: For a Mitzvah, we permit. Tzidkiyahu was excessively pained that he could not reveal, and through this he was unable to serve Hash-m properly;

וגם מצות המלך שמצוה עליהם להתירו מצוה היא עליהם לקיים וכך תרצו בתוספות

Answer #2: The king's command [to the Sanhedrin] that they permit him was a Mitzvah upon them. And so Tosfos answered.

In any case it connotes that b'Di'avad, he is permitted. If not, how did it help Tzidkiyahu that they permitted him?! This is proven also from the Gemara in Gitin.

Rebuttal (of Support): Others reject these proofs. Really, even b'Di'avad he is not permitted;

שהרי הכתוב צווח בצדקיהו ומענישו בדבר כדכתיב וגם במלך נבוכד נצר מרד אשר השביעו באלהים

The verse screams about Tzidkiyahu and punishes him for the matter - "v'Gam b'Melech Nebuchadnetzar Marad Asher Hishbi'o bEi'lokim"!

וכן כתב הראב"ד ז"ל וצא וראה מה עלתה בו ובסנהדרין

Also the Ra'avad says so. See what happened to him (Tzidkiyahu) and the Sanhedrin!

Rebuttal (of Answer #1): Also from Gitin there is no proof. A widow's vow, since she vowed to orphans, what benefit do children have if she is forbidden Peros?! (Shalmei Nedarim - indeed, they would benefit if she can permit it only in front of them. However, the vow itself does not help them. It is unlike the Shevu'os of Moshe and Tzidkiyahu. Those Shevu'os themselves benefited Yisro and Nebuchadnetzar.)

ועוד דהכי קאמרינן דלמא אזלא לגבי חכם ושרי לה ותחשוב להיות מותרת

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. יש דברים שהן כנולד ואינן כנולד

(Mishnah): There are matters that are like Nolad, but they are not like Nolad.

לפי שהוא כתולה נדרו בדבר דכיון דאמר שאביה רע משמע כל זמן שאביה רע ולפיכך כשמת או עשה תשובה שרי.

Explanation: It is because he is like one who attributes his Neder to a matter. Since he said 'for her father is evil', this implies as long as her father is evil. Therefore, when he died or repented, he is permitted.

ר"ן ד"ה גמ'. נעשה כתולה נדרו בדבר

Gemara: He becomes like one who attributes his Neder to a matter.

כדפרישית ומש"ה שרי אפי' בלא שאלת חכם

Explanation: This is like I explained. Therefore he is permitted even without asking a Chacham.

והכי איתא בירושלמי דאמרינן התם מפני שהוא כתולה נדרו בדבר כאומר (גירסת כתב יד, וכן הוא בירושלמי) קונם שאני נהנה לאיש פלוני כל זמן שהוא לובש שחורים לבש לבנים מותר

Support: The Yerushalmi says so. We say there, that it is because he is like one who attributes his Neder to a matter. It is as if he said 'Konam is what I will benefit Ploni as long as he wears black.' If he wore white, he is permitted;

והיינו רישא דשאביה רע ותנא נדר בטעות דהיינו סיפא נדר כעורה והרי היא נאה

Explanation: This is the Reisha of "her father is evil." He also taught Neder b'Ta'os, i.e. the Seifa "he vowed because she is ugly, and she is pretty."

והא דלא אמרינן בסיפא גבי כעורה ונעשת נאה

Implied question: Why don't we say in the Seifa regarding "she is ugly" that she became pretty?

היינו טעמא משום דאדם רע עשוי לעשות תשובה ועשוי למות הלכך אומדים דעתו דכי אמר שאביה רע כל זמן שאביה רע קאמר

Answer #1: An evil man is wont to repent or die. Therefore, we establish his intent, that when he said "because her father is evil", he meant as long as he is evil;

However, it is not common that an ugly woman becomes pretty. Therefore, he did not intend that she become permitted to him when she becomes pretty. The Rashba said so.

Answer #2: If he said "that I will [not] marry Plonis, for she is ugly", like it taught regarding her evil father, indeed, he meant as long as she is ugly;

אבל הכא כיון דלפלונית כעורה קאמר לא משמע כתולה נדרו בדבר החכם הותיק ר' שמואל בן החכם הגדול רבי יהודה בר חסדאי ז"ל.

However, here, since he said "Plonis Ke'urah (the ugly Plonis)", this does not connote that he attributes his vow to the matter. [So said] the Chacham R. Shmuel, the son of the great Chacham R. Yehudah bar Chisdai.

Nasan, who said that anyone who vows is like one who built a Bamah!

דהתם שאני דהוו איומים גדולים ואי אפי' על דעת הנהו נדר יתבייש לומר כן נמצא שאין נדריו נתרין יפה

Answer: There is different, for they are great threats, and even if he vowed with intent for them, he will be ashamed to say so. It turns out that Nedarim are not permitted properly;

לימא ליה כל דמיעני לאו עלי נפל שאני מחויב לפרנסו לבדי מאי דמטי לי לפרנסיה בהדי כולי עלמא מפרנסנא ליה

He should say to him "not everyone who waxes poor falls upon me, that I am obligated to finance him alone! The share incumbent on me to finance him, along with everyone else, I will finance him";

ורשאי הוא בכך אע"פ שאסר עליו נכסיו שהרי לא יתן בידו אלא ליד גבאי

He may do so, even though he forbade his property to him, for he does not give to his hand. Rather, he gives to the Gabai (collector of Tzedakah);

וכיון שאם רצה גבאי ליתן לאחר הרשות בידו שרי

Since if the Gabai wanted, he could give [the Madir's money] to someone else, he is permitted [to give it to the Mudar];

דהוה ליה כי ההיא דתנן (לעיל /נדרים/ מח) נותן לאחר משום מתנה והלה מותר בו.

This is like the Mishnah above (48a) "he gives to another for a gift, and it is permitted to the other (the Mudar)."

ר"ן ד"ה כל הנופל אין נופל לידי גבאי תחלה

Gemara: Anyone who falls does not fall to the Gabai first.

אלא שואל מקרוביו ומתפרנס וההיא שעתא קעבר אקרא דכתיב וחי אחיך עמך.

Explanation: Rather, he asks his relatives, and is financed from them. At that time, he transgresses the verse "v'Chei Achicha Imach" (Vayikra 25:36. The Ran implies that this applies only to a relative. Tosfos implies that it applies to strangers as well.)

Explanation: We tell him, had you known that you will need to [divorce her and] pay her Kesuvah, would you have vowed? If he says 'no', we permit him.

Gemara: We learn from this that there is a lien on Metaltelim to pay the Kesuvah.

Gemara: We learn from this that we are not Mesader for one who owes money (to leave for him basic necessities).

פלוגתא היא בפרק המקבל (ב"מ קיד) איכא מ"ד דמניחין לו מטה ומפץ וכלי אומנותו ומזון י"ב חדש דגמר מיכה מיכה מערכין

Reference: This is an argument in Bava Metzi'a (114a). One opinion holds that we leave for him a bed, mattress, tools of his trade and food for 12 months. He learns from a Gezeirah Shavah "Michah-Michah" from Erchin;

ואיכא מ"ד אין מסדרין ומדתנן הכא אפי' אתה מוכר שער ראשך ש"מ דאין מסדרין.

And there is an opinion that we are not Mesader. Since the Mishnah taught here 'even if you must sell hair of your head', this teaches that we are not Mesader.

RAN DH Lomar she'Ein Mekar'im... [TRANSLATION: This teaches that we do not tear the Kesuvah.]

Explanation: I.e. indeed, we are Mesader (leave for him essentials). However, [R. Akiva] told him "even if you will go beyond the letter of the law, and you do not want Sidur, do not think that you will be exempt [before paying the entire Kesuvah]";

דלעולם אין קורעין כתובתה כדי שאם ימצא לך לאחר מכן תחזור ותגבה

We never tear her Kesuvah [before it is fully paid, even if you gave all your property], so that if you acquire [property] afterwards, she will return to collect [the rest].

דנהי דתנן בערכין נתן סלע והעשיר אין לו עליו כלום וסדור מערכין גמרי' ליה

Implied question: A Mishnah in Erchin (7b) teaches that if one gave a Sela [for it was all he had, even though he was obligated an Erech, which is more], and [afterwards] he became rich, [the Gizbar] has no claim against him. We learn Sidur from Erchin!

ה"מ לענין סדור אבל לענין השג יד לא.

(c)

Answer: That is regarding Sidur, but not regarding Heseg Yad. (An Oni pays what he can, and he is exempt from the rest of the Erech. We do not learn Heseg Yad from Erchin to others who owe money.)

RAN DH umid'Amrinan Hacha... [TRANSLATION: And from that we say here, we learn that there is a lien on Metaltelim for the Kesuvah.]

ר"ן ד"ה ומדאמרי' הכא שמעת מינה מטלטלי משתעבדי לכתובה

(SUMMARY: The Ran infers that we hold that a Kesuvah is not collected even from the husband's Metaltelim.)

שמעי' מהא דלדידן דקי"ל דמטלטלי לא משתעבדי לכתובה אפי' מיניה דידיה לא משתעבדי

Explanation: We learn from here that according to us, that we hold that there is no lien against Metaltelim for the Kesuvah, there is no Shibud even from his Metaltelim (that he still owns).

וטעמא משום דאין זמן כתובה ידוע ושמא לא תגבה לעולם וכשהיא גובה אינה גובה אלא ע"י מיתה וגרושין הלכך לא סמכה דעתה אלא על הקרקע

The reason is because the time for [payment of] the Kesuvah is not known. Perhaps it will never be paid, and when she collects, she collects only through death or divorce. Therefore, she relies only on land. (She does not rely on Metaltelim, lest he no longer have them when she collects.)

ומש"ה לרבנן הורע כחה של כתובה מחוב דעלמא

Therefore, according to Rabanan [the ability to collect] a Kesuvah is weaker than a regular debt.

אע"ג דמטלטלי דיתמי לבע"ח לא משתעבדי

Implied question: A creditor has no lien against Metaltelim of orphans! (This suggests that a debt is no stronger than a Kesuvah.)

כי היכי דגבו מיניה אפי' מגלימא דעל כתפיה

Answer: Just like [creditors] collect from him (the borrower), they collect from the shirt on his back (unlike a Kesuvah)s.

והכי מוכחא שמעתא דחבילה דבפרק האומר דקדושין (דף סה:)

This is clear from the Sugya in Kidushin (65b) about [collecting a Kesuvah from] a bundle. (We say that it is like R. Meir, and unlike Rabanan.)

ולר"מ עדיפא טפי כתובה מבעל חוב דעלמא דנהי דמטלטלי דיתמי לבע"ח לא משתעבדי לכתובה משתעבדי.

(b)

Observation: According to R. Meir, [the ability to collect] a Kesuvah is stronger than a regular creditor. Even though a creditor has no lien against Metaltelim of orphans, there is a lien against them for a Kesuvah!
