THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. הנודר מן הירק מותר בדילועין כו'

(a)

(Mishnah): If one vowed from Yerek, he is permitted gourds...

דלא הוי ירק אלא פרי

Explanation #1: It is not Yerek, rather, a Pri.

ואית דמפרשי דסתם ירק נאכל כמות שהוא חי ודלועין אינן כן.

Explanation #2: Some say that Yerek is eaten raw, and gourds are not.

ר"ן ד"ה והוא אומר לא מצאתי אלא דילועין

(b)

Mishnah: He says 'I didn't find [Yerakos], only gourds.'

אלמא לא מיקרו ירק דאי מיקרו ירק יקחם.

Inference: They are not called Yerek, If they were called Yerek, he would buy them!

ר"ן ד"ה אמר להם כן הדבר

(c)

Mishnah: He said to them, so it is!

מזה אני מביא ראיה לאסור דלועין.

Explanation: From there I bring a proof to forbid gourds.

ר"ן ד"ה אסור בפול המצרי לח

(d)

Mishnah: He is forbidden moist Egyptian beans.

דכל שהוא לח ירק הוי.

Explanation: Anything moist is Yerek.

RAN DH Gemara v'Ha Min Yerek Nadar [TRANSLATION: But he vowed from Yerek!]

ר"ן ד"ה גמ' והא מן ירק נדר

(SUMMARY: The Ran explains that we ask only against R. Akiva.)

לרבי עקיבא פריך היכי אסר בדילועין דהא מן ירק נדר ודילועין לאו ירק נינהו אלא פרי

Explanation #1: We ask against R. Akiva. How does he forbid Dilu'in (gourds)? He vowed from Yerek, and Dilu'in is not Yerek, rather, Pri!

Note: Below (in DH b'Omer), the Ran gives another explanation.

דבשלמא פול המצרי א"ל דכיון שעושים ממנו גורן (גירסת כתב יד) כשהוא יבש ומקמי הכי לא עד ההיא שעתא ירק הוי ולא פרי

Granted, we can say that Egyptian bean [is forbidden], since they make from it a granary when it is dry, and beforehand they do not, until then it is Yerek, and not Pri;

אלא דלועין קשיא ואף ע"ג דר"ע יהיב טעמא דמימליך עליה שליח לא סגי ליה ההוא טעמא כיון דמן ירק נדר ודלועין לאו ירק נינהו.

However, Dilu'in is difficult. Even though R. Akiva gave the reason that a Shali'ach would ask about it, this is not enough, since he vowed from Yerek, and Dilu'in is not Yerek.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה אמר עולא באומר ירקי קדרה עלי

(a)

Gemara: The case is, he said 'pot Yerakos Alai.'

וכיון דמייתר לישניה למיכלל דלועין אתי כיון דמימלך שליחא עלייהו.

Explanation: Since he said extra words, he comes to include gourds, since a Shali'ach would ask about them.

ר"ן ד"ה ודילמא ירק הנאכל בקדרה קאמר

(b)

Gemara: Perhaps he said so to include Yerakos eaten in a pot!

דכיון דדלועין ליתנהו בכלל ירק לית לך לרבויינהו מייתורא דלישניה אלא מאי דליכא לספוקי דמשתמע מיניה כגון שומים ובצלים הבאים להטעים את הקדרה

Explanation: Since gourds are not included in Yerek, you should include from his extra words only something that there is no Safek that his words imply it, e.g. garlic and onions, which come to give flavor to [a Tavshil in] the pot;

אבל דלועין לא משתמעי מיניה דירקי קדרה להטעים את הקדרה משמע.

However, his words do not imply gourds, for 'pot Yerakos' implies what comes to give flavor to the pot.

RAN DH b'Omer Yerek ha'Mevushal bi'Kederah Alai [TRANSLATION: The case is, he says 'Yerek cooked in a pot is Alai.']

ר"ן ד"ה באומר ירק המבושל בקדרה עלי

(SUMMARY: The Ran explains which expressions forbid which kinds of Yerek.)

וכל כה"ג סבירא ליה לרבי עקיבא דכיון דדלועין ממליך שליחא עלייהו אסור בהן

Explanation: In every such case, R. Akiva holds that since a Shali'ach asks about Dilu'in, they are forbidden to him;

ורבנן סברי דכיון דצריך לאימלוכי עלייהו לאו מיניה הוא

Rabanan hold that since a Shali'ach needs to ask about them, they are not its species.

וקיי"ל כר' עקיבא כמו שנפרש לפנינו בס"ד

(b)

Ruling: We hold like R. Akiva, like we will explain below with Hash-m's help.

הילכך נודר מן הירק אינו אסור בפרי האדמה אמר ירק קדרה עלי אסור בפירות האדמה הבאים להכשיר המאכל כשומים ובצלים ומותר בדלועין

(c)

Consequence: Therefore, one who vows from Yerek is not forbidden Pri ha'Adamah. If he said Yerek Kederah Alai, he is forbidden Peros ha'Adamah that come to enhance the food, like garlic and onions, and he is permitted Dilu'in;

אמר ירק המתבשל בקדרה עלי אסור בכל פירות האדמה דמימלך שליחא עלייהו כי אמר ליה משלח ירק,

If he said "Yerek that is cooked in a pot", he is forbidden all Peros ha'Adamah that a Shali'ach asks about when the sender told him [to get] Yerek.

ואית דמפרשי והא מן ירק נדר דסתם ירק נאכל כמות שהוא חי ואמר עולא באומר ירקי קדרה עלי דכיון דאמר הכי אפילו ירק המתבשל בכלל

(d)

Explanation #2: Some explain [the question] "he vowed from Yerek!" because Stam Yerek is eaten like it is, raw. Ula answered "he said Yerek Kederah is Alai." Since he said so, even Yerek that is cooked is included;

ודילמא ירק הנאכל בקדרה קאמר דכיון דסתם ירק נאכל כמות שהוא חי ואמר ירקי קדרה לרבויי אתא ירק הנאכל חי ובקדרה כגון שומים וחזרת

[The Gemara asks] "perhaps he meant Yerek eaten in a pot"! Since Stam Yerek is eaten like it is, raw, and he said "Yarkei Kederah", this is to include, we include Yerek that is eaten raw and in a pot, like garlic and lettuce;

אבל דילועין שאין נאכלין חיים כלל לא

However, Dilu'in, which are not eaten raw at all, [are] not [included].

ופרקינן ירק (גירסת כתב יד) המתבשל בקדרה עלי דכיון דאמר המתבשל משמע הנך דבעו בשול טובא ואין דרכן לאכלן חיים כדלועין,

We answer [that he said] "Yerek that is cooked in a pot is Alai." Since he said "that is cooked", it connotes those that require much cooking, and it is not normal to eat them raw, like Dilu'in.

ונמצא עכשיו לפי דרך זה דנודר מן הירק אסור בירק הנאכל כמות שהוא חי בלבד ומותר בכל מה שמתבשל אף על פי שלפעמים נאכל חי

(e)

Consequence: It turns out that according to this Perush, one who vows from Yerek is forbidden only Yerek that is eaten raw, and is permitted everything that is [normally] cooked, even if sometimes it is eaten raw.

אמר ירקי קדרה עלי אסור אף באותן שנאכלין חיים ומבושלין אבל לא באותן שאין נאכלין אלא מבושלין

If he said "Yarkei Kederah are Alai", he is forbidden even those that are eaten raw and cooked, but not those that are eaten only cooked;

אמר ירק המתבשל בקדרה אסור אף באותן שאין נאכלין בלא בשול.

2.

If he said "Yerek that is cooked in a pot", he is forbidden even those that are not eaten without cooking.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה אמר אביי מודה ר"ע לענין מלקות שאינו לוקה

(a)

Gemara: Abaye said, R. Akiva agrees about lashes, that he is not lashed [for things that a Shali'ach would ask about].

דכיון דדלועין לא משתמעי בהדיא אלא מרבוייא דלישניה אף על גב דממליך שליחא עליה לא מתסרי בודאי אלא מספיקא הילכך לא לקי.

Explanation: Since gourds are not explicitly implied, only due to extra words, even though a Shali'ach would ask about them, they are not Vadai forbidden, only due to Safek. Therefore, he is not lashed.

ר"ן ד"ה תנן התם

(b)

Gemara: A Mishnah there teaches.

מתני' היא במסכת מעילה (ד' כ).

Explanation: It is a Mishnah in Me'ilah (20a).

ר"ן ד"ה השליח שעשה שליחותו בעל הבית מעל

(c)

Gemara: If the Shali'ach fulfilled his mission, the sender transgressed Me'ilah.

דאע"ג דקיי"ל אין שליח לדבר עבירה

Question: We hold that Ein Shali'ach li'Dvar Aveirah! (The Shali'ach's Aveirah is attributed to himself, and not to the sender.)

שאני מעילה דילפינן חטא חטא מתרומה כדאיתא בפ"ב דקדושין (דף מב:).

Answer: Me'ilah is different. We learn from [a Gezeirah Shavah] "Chet-Chet" from Terumah (just like Terumah can be [separated] via a Shali'ach, Me'ilah can be via a Shali'ach), like it says in Kidushin (42b).

ר"ן ד"ה לא עשה שליחותו שליח מעל

(d)

Gemara: If he did not fulfill his mission, the Shali'ach transgressed Me'ilah.

דאדעתא דנפשיה קעביד.

Explanation: He acted on his own volition (and not due to the sender's command).

RAN DH Man Tana Amar Rav Chisda... [TRANSLATION: Who is the Tana? Rav Chisda said, our Mishnah is unlike R. Akiva.]

ר"ן ד"ה מאן תנא אמר רב חסדא מתניתין (גירסת כתב יד) דלא כר' עקיבא

(SUMMARY: The Ran explains why it is unlike R. Akiva.)

כלומר מאן תנא האי דמפרש ואזיל דאמר לו תן בשר לאורחים ונתן להם כבד מיקרי לא עשה שליחותו

Explanation: I.e. [the Gemara asked] who is the Tana of this that [the Mishnah] proceeds to explain, that if one said "give meat to the guests", and he gave to them liver, it is called that he did not do his Shelichus?
