דהא אמרינן בגמרא היכי דמי דשרי דמקבל בטסקא

(a)

Proof: We say in the Gemara "in what case is it permitted? When he receives Taska";

ומקבל בטסקא לאו היינו שכירות אלא הקרקע הרי הוא של מחזיק לעולם ומורישו לבניו אלא שנותן דבר ידוע בכל שנה לבעלים הראשונים

Receiving Taska is not rental. Rather, the land permanently belongs to the one making Chazakah on it, and he bequeaths it to his sons, just he gives a known amount each year to the original owner.

וכל כי האי גוונא קנין הגוף מיקרי ולא שעבוד בלבד שיפקיענו קונם

In every such case, it is called Kinyan ha'Guf, and not a mere Shibud, which Konam would uproot.

והאי דנקט מושכרין במתניתין

Implied question: Why did the Mishnah discuss when it is rented out?

משום דטסקא זו כעין שכירות הוא שאם אינו פורע המוטל עליו שנה שנה הדרא ארעא למרא

Answer: It is because this Taska is like rental. If he does not pay what is incumbent on him every year, the land returns to the [original] owner.

וכדאמרינן בעלמא (ב"מ ד' עג:) ארעא לטסקא משתעבדא ומלכא אמר דיהיב טסקא ליכול ארעא

Source: We say in general (Bava Metzi'a 73b) that there is a lien on land for Taska, and the king said that whoever pays the Taska eats [the Peros of] the land.

ואפילו הכי כיון דכל אימת דבעי למפרע לא מצי מסלק ליה אידך קנין הגוף יש לו בקרקע ומש"ה לא מצי אסר

Even so, since as long as he (the Machazik) wants to pay, the other (the original owner) cannot remove him [from the land], he has Kinyan ha'Guf, and therefore [the original owner] cannot forbid [him].

אבל בשכירות דעלמא מצי אסר כל זה פלפלו הראשונים ז"ל

However, in a regular rental, he (the original owner) can forbid [him]. The Rishonim delved into all of this.

ותמהני עליהם לפי שאני אומר להלכה דאפי' בשכירות דעלמא כל שאין לו למדיר תפיסת יד שרי מודר לאתהנויי ממרחץ ובית הבד שיש לו למדיר מושכרין בעיר

Rebuttal: I am astounded at them. I say that l'Halachah, even regular rental, as long as the Madir does not have Tefisas Yad, the Mudar may benefit from the bathhouse or olivepress that the Madir has rented out in the city;

דאע"ג דמן דינא ודאי דמשכיר יכול לאסור על השוכר ואפי' הקדים השוכר למשכיר שכרו וכדפרישנא לעיל במתניתין דריש פרקא

Implied question: According to letter of the law, the landlord can forbid to the tenant, even if the tenant paid the rent in advance to the landlord, like I explained above in the Mishnah (45b DH Rebbi)!

הני מילי כשאוסר אותם לשוכר או כשאוסר אותם על כל אדם שהשוכר בכלל

Answer: This is only when he forbids to the tenant, or to everyone, which includes the tenant;

משום דכיון דקונמות מפקעי מידי שעבוד אסתלק ליה שעבודא דשוכר לגמרי

Since Konamos uproot a lien, the tenant's lien is totally removed.

אבל לאסור אותו על אחר לא כל הימנו דכיון דאשתייר ליה שעבודא דשוכר כשהמודר נהנה לא ממדיר הוא נהנה אלא מן השוכר כנ"ל ודבר ברור הוא

However, he cannot forbid to someone else, since the tenant's lien remains. When the Mudar benefits, he does not benefit from the Madir, rather, from the tenant. So it seems to me. This is clear.

ולפיכך אני אומר דכי תנן לעיל היה א' מן השוק מודר מא' מהם הנאה לא יכנס לחצר ר"א בן יעקב אומר וכו'

Consequence: I say that when the Mishnah says above "if someone from the market (a stranger) was Mudar Hana'ah from one of them, he may not enter the Chatzer; R. Eliezer ben Yakov says..."

לאו משום רבותא דרבי אליעזר בן יעקב בלחוד תנא ליה אלא לרבותא דרבנן נמי נקטיה

This was said not only for a Chidush according to R. Eliezer ben Yakov. It was taught for a Chidush also according to Rabanan;

דסד"א נהי דקסברי רבנן דשותף מצי אסר אחבריה ה"מ משום דמפקע מיניה קנין שעבוד וכדכתיבנא לעיל

One might have thought that granted, Rabanan hold that a partner can forbid to his friend [the other partner], but this is only because he uproots his Kinyan Shibud, like I wrote above (45b DH Rebbi);

אבל לאחד מן השוק לא מצי אסר הך חצר שאין בה דין חלוקה דמצי א"ל כיון דשעבוד חבירך עדיין נשאר אצלו לתוך שלו אני נכנס ולא לתוך שלך

However, he cannot forbid to an outsider this Chatzer that has no Din Chalukah. He (the outsider) can say "since your partner's lien remains, I enter his share, and not yours";

קמ"ל דכיון דהך מדיר (הגהות ישנות) קני ליה בהא חצר קנין גוף ופירות לא כל הימנו.

The Mishnah teaches that this is not so. Since this Madir acquired this Chatzer for Kinyan ha'Guf and Peros, he (the outsider) cannot [say so. The partner can forbid him.]

THE RAN EXPLAINS THE MISHNAH (pertains to Mishnah 46a)

מתני'. האומר לחבירו קונם ביתך (כן נראה להגיה) שאני נכנס (שייך למשנה בדף מו.)

(a)

Mishnah: If one says to his friend 'Konam is your house, that I enter.'

כלומר למה שאני נכנס בו.

Explanation: I.e. what I enter in it [is forbidden like a Korban].

ר"ן ד"ה שדך שאני לוקח

(b)

Mishnah: ['Konam is] your field, that I buy.

כלומר אם אקחנו.

Explanation: I.e. if I will buy it.

ר"ן ד"ה מת או מכרן לאחר מותר

(c)

Mishnah: If he died or sold them to someone else, he is permitted.

דביתך אמר והשתא לאו ביתיה הוא

Explanation: He said 'your house', and now it is not his house.

וה"ה דאי נתנן לאחר נמי שרי אלא להכי נקט מכרן לאשמועינן דדוקא מכרן לאחר אבל אמר ביתך שאני נכנס ומכרו לו אסור.

Extrapolation: The same applies if he gave it to someone else, he is permitted. It mentioned selling it to teach that only if he sold it to another, but if he said 'your house that I enter ', and he sold it to him, it is forbidden.

RAN DH Konam l'Bayis Zeh... [TRANSLATION: Konam is this house that I enter, or this field that I but', and he died or sold it to someone else, it is forbidden.]

(SUMMARY: The Ran discusses the differences between "this house" and "your house".)

דכיון דבית זה קאמר שויה עילויה חתיכה דאסורא הלכך אפילו מכרו לאחר אסור

Explanation: Since he said "this house", he made it like a piece of Isur. Therefore, even if he sold it to someone else, it is forbidden.

והוי יודע דכי היכי דבית זה חמור מביתך לענין מכרן לאחר הכי נמי ביתך חמור מבית זה לענין נפילה

(b)

Observation: Just like "this house" is more stringent than "your house" regarding one who sold them to another, similarly "your house" is more stringent than "this house" regarding falling;

דאי אמר ביתך שאני נכנס ונפל ובנאו אסור ליכנס בו דכל שהוא ביתך משמע

If he said "[Konam] your house that I will enter", and it fell and he rebuilt it, he may not enter it, for this connotes whatever is his house;

ואי אמר בית זה ונפל אף ע"פ שחזר ובנאו מותר בו דכיון דנפל אזדא

If he said "this house", and it fell, even if he built it again, it is permitted to him. Since it fell, it (the Isur) went away.

ואי אמר ביתך זה משום זה אתה תופסו בין לחומרא דמכירה בין לקולא דנפילה

Ruling: If he said "Beischa Zeh (this house of yours)", we judge him based on "Zeh" (as if he said "this house"), both to be stringent about a sale, and lenient about falling.

והכי איתא בירושלמי ביתך זה משום מה אתה תופסו משום ביתך או משום זה זה (הגהת ר' בצלאל אשכנזי) נפל ובני הא לית הוא

Source - Citation (Yerushalmi): If he said "Beischa Zeh", how do we judge him? [Is he like one who said] Beischa, or [like one who said] Zeh? [If he is like one who said] "Zeh", if it fell and he rebuilt it, it is not the same house!

ושמעינן מן הדא האומר ליורשיו תנו בית חתנות לבני או בית ארמלות לבתי ונפל היורשים חייבים לבנותו

Citation (cont.): We learn from the following. If one told his heirs "give a Chasan's house to my son, or a widow's house to my daughter", and it fell, the heirs must [re]build it;

בית זה ונפל אין חייבין לבנותו

Citation (cont.): If he said "this house ", and it fell, they need not [re]build it. (Shalmei Nedarim - how can the Yerushalmi learn from a case in which he did not say "Beischa Zeh"? The Beis Yosef (YD 216 DH ul'Mai d'Mashma) answered that presumably, he showed to them one of his own houses, and not someone else's, so it is as if he said "Beisi Zeh." We resolve that "Zeh" connotes "like it is."

Note: I think that he over-simplified the Beis Yosef's answer! Even if we know that it is his house, since he did not say "Beisi", surely he is like one who said "Zeh"! The Beis Yosef explained that the Yerushalmi asked whether "Zeh" is precise, and comes to include after he sells it (and Beischa forbids after it falls and he rebuilds it), or if it merely excludes other houses of the owner. We learn from one who said to give a Chasan's house... If he said "Zeh", we do not say that it [merely] excludes other houses. Rather, it excludes after it falls. Likewise, one who said Beischa Zeh, we judge him like one who said Zeh, even to be lenient. (Perhaps it is lenient in other situations. Above, the Beis Yosef said that if "Zeh" is precise, and forbids after he sells it, Beischa forbids after he rebuilds it!)

ומסתברא דכי אמרינן בביתך שאני נכנס דאי נפל ובני ליה אסור לאו דוקא נפל ובני ליה במקומו דה"ה אם בנהו במקום אחר אסור דכל שהוא ביתך קאמר

Assertion: Presumably, just like we say that if he said "your house that I will enter", if it fell and they built it, it is forbidden, this is not only if they built it in its place. Also if they built it elsewhere, it is forbidden, for he meant "whatever is your house."

והאי דנקט נפל ובני

(f)

Implied question: If so, why did it discuss when it fell and he rebuilt [it]?

לרבותא נקטיה דבאומר בית זה אע"פ שחזר במקומו וכמדתו הראשונה מותר.

(g)

Answer: This is for a bigger Chidush, that when he says "Bayis Zeh", even though he returned (rebuilt it) in its place and like its initial size, it is permitted.

RAN DH Gemara Ba'i Avimi Konam... [TRANSLATION: Avimi asked, 'Konam is this house that you enter', and he died or sold it to someone else, what is the law?]

ר"ן ד"ה גמ' בעי אבימי קונם לבית זה...

(SUMMARY: The Ran explains why Avimi did not resolve this from our Mishnah.)

כלומר דנהי דאמרי' במתניתין דבאומר בית זה מכרו לאחר אסור

(a)

Implied question: (What was the question?) We say in our Mishnah that when he said "Bayis Zeh" and he sold it to someone else, it is forbidden!

ה"מ באוסר על עצמו דמצי אסר אנפשיה בית זה בין שיהא שלו או שימכרנו לאחר

(b)

Answer: This is only when he forbids to himself, for he can forbid to himself this house, whether it will be his [the current owner's], or he will sell it to another;

אבל אחבריה נהי דבית זה לעולם משמע וכדמוכחא מתניתין מיהו לא כל הימנו לאסרו לכשיצא מרשותו דה"ל נכסי חבירו על חבירו

However, [to forbid] to his friend, granted, "this house" connotes forever, like is proven from our Mishnah. However, he cannot forbid it after it leaves his Reshus, for this is [forbidding] another's property to someone else.

וה"ה דמבעיא ליה במפרש בית זה שאתה נכנס אפילו לאחר שיצא מרשותוי (הגהה במהדורת עוז והדר) דאפשר דלא מהני

Assertion: He also asks about when he explicitly says "[Konam] this house that you will enter even after it leaves my Reshus." Perhaps it does not help;

דאיהו לא מסתפק בלישנא דודאי פשיטא ליה דזה לעולם משמע וכדמוכחא מתניתין

He has no Safek about the [meaning of the] words. Surely, it is obvious to him that it connotes forever, like is proven from our Mishnah;

אבל עיקר בעיא היא אפילו כי בעי למיעבד הכי אי מצי עביד כיון דנכסיה השתא ברשותיה נינהו

2.

His primary question is even when [we know that] he wants to do so. Perhaps he can do so, for now the property is in his Reshus;

או לאו כיון דלאחר מכן נפקי מרשותיה והוי להו כנכסי חבירו על חבירו

i.

Or, perhaps he cannot, for afterwards it leaves his Reshus, and this is like [forbidding] another's property to someone else.

ומש"ה מייתי לה רב' ת"ש מדתנן בחייו ובמותו מת לא יירשנו דאלמא כי פריש מצי למיסר אפילו לאחר שיצאו מרשותו כיון דהשתא ברשותו נינהו

(d)

Support: This is why Rava brings a proof from the Mishnah "in his lifetime and after his death", they do not inherit him. This shows that when he specifies, he can forbid even after it leaves his Reshus, for now it is in his Reshus;

וכיון דכי פריש חייל איסורא פשיטא ליה דזה כמפרש דמי דמתני' נמי הכי מוכחא

Since when he specifies, the Isur takes effect, it is obvious to him that it is as if he specified. Also this is proven from our Mishnah [above].

ואע"ג דלעיל /נדרים/ (דף מב:) דחינן שאני התם דאמר בחייו ובמותו

(e)

Implied question: Above (42b), we rejected that there is different, for he said "in his lifetime and after his death"!

כלומר דאע"ג דזה לגבי נודר עצמו לעולם משמע לגבי מדיר לא משמע הכי וכמו שפירשתי אני למעלה

I.e. even though "this" regarding the Noder himself connotes forever, regarding the Madir it does not connote like this, like I explained above!

הכא לא ניחא לן בההיא דחיא ואמסקנא דלעיל סמכינן.

Answer: Now we are not pleased with that rejection. We rely on the conclusion above.

RAN DH v'Havi Yode'a [TRANSLATION: You should know.]

ר"ן ד"ה והוי יודע

(SUMMARY: The Ran explains that he inherits the property, and how he enables others to take it.)

דכי תנן הכא אם מת לא יירשנו לאו למימרא דכיון שנכסים אסורים לו בהנאה לא יזכה בהן

(a)

Suggestion: The Mishnah teaches here that if he dies, he (his son) does not inherit him. I.e. since the property is Asur b'Hana'ah to him, he does not acquire it.

דהא קתני בסיפא דההיא מתניתין בפרק הגוזל קמא /בבא קמא/ (דף קט) ויתן לבניו או לאחיו ואם אין לו לווה ובעלי חובין באין ונפרעין

(b)

Rejection: The Seifa of that Mishnah (Bava Kama 109a) says 'he gives it to his sons or brothers. If he lacks, he borrows, and creditors come and collect [from his inheritance]';

ואם לא זכה בגוף הנכסים היאך נותנן לבניו או לאחיו והיאך בעלי חובין באין ונפרעין

If he did not acquire the property itself, how could he give it to his sons or brothers, and how could creditors come and collect [from it]?!

אלא ודאי נכסים דידה (הגהה בגליון) נינהו אלא שאינו רשאי ליהנות מהן

Rather, surely the property is his, just he may not benefit from it;

ואיידי דתנא רישא יירשנו לומר שמותר ליהנות מהן כשאר היורשין תנא סיפא נמי לא יירשנו ולאו דוקא

For parallel structure with the Reisha, which taught "he inherits him", i.e. he may benefit from the property like other heirs, also the Seifa taught "he does not inherit him", and it is not precise.

וכ"ת היכי קתני נותנן לבניו או לאחיו

(c)

Question: How can it teach that he gives it to his sons or brothers?

בשלמא לווה ובעלי חובין באין ונפרעין שפיר דבעלי חוב לאו מדעתיה קא מיפרעו דליהוי פורע חובו באיסורי הנאה דבכה"ג ודאי אסור

Granted, it is fine that he borrows and creditors come and collect. They do not collect mi'Daito (according to his volition), that we should consider this paying a debt through Isurei Hana'ah. Such a case (willfully paying a debt with it) is surely forbidden;

דנהי דאמרינן לעיל דמבריח ארי מנכסי חברו הוא

Implied question: (Why is this forbidden?) We say above (33a) "he is Mavri'ach Ari (distances damage) from his friend's property"! (One may do so for a Mudar Hana'ah.)

היינו כשאחר פורע שלא מדעתו אבל מדעתו ודאי אסור דהוי מוציאן מרשות לרשות ונמצא מועל

Answer: That is when another pays not mi'Daito. Mi'Daito surely it is forbidden, for he transfers the property from Reshus to Reshus. It turns out that he is Mo'el (because Me'ilah applies to Konamos. Alternatively, if it were Hekdesh, he would be Mo'el);

אלא בעל כרחו ב"ד מגבין מהן ואע"ג דאיהו ממילא מתהני לא איכפת לן

i.

Rather, b'Al Korcho (against his will) Beis Din collect [for the creditor]. Even though automatically, the Mudar benefits (his loan is paid), we are not concerned;

אבל נותן לבניו או לאחיו היכי שרי והא מתהני מטובת הנאה דידהו ואסור כדאמרינן לעיל /נדרים/ (דף לו:) גבי תורם משלו על חבירו

Summation of Question (c): However, why may he give to his sons or brothers? He benefits from their Tovas Hana'ah (the amount one would pay someone to give something to someone else whom he wants to benefit), and this is forbidden, like we said above (36b) regarding one who is Torem his Peros to exempt his friend!

וי"ל דלאו למימרא שיתנם להם ממש אלא שמראה להם מקום ואומר להם נכסי אלו אסר עלי אבא ואיני יודע מה אעשה בהם טלו לעצמכם ועשו מהם מה שתרצו

(d)

Answer: [The Mishnah] does not mean that he truly gives to them. Rather, he shows to them a place and says to them "father forbade this property to me, and I do not know what I will do with it. Take for yourselves, and do with it what you want."

וכה"ג לאו מתנה הוא אלא גוונא דהפקר

Such a case is not a gift, rather, it is a kind of Hefker.

וכן כתב הר"ם במז"ל בפ"ה מהל' נדרים (הל' ח) שצריך להודיעם אלו נכסי אבי שאסר עלי אבא

Support: The Rambam wrote so in Hilchos Nedarim (5:8), that he must inform them "this is father's property, which he forbade to me."

עשאה הרמב"ם ז"ל כההיא דתנן לעיל מיניה הגוזל את אביו ומת וכו' לווה ובעלי חובין באין ונפרעין

The Rambam considers this like the previous Mishnah [in Bava Kama, 108b] "if one stole from his father [and swore falsely to deny it], and he (his father) died, he borrows and creditors come and collect;

Gemara: 'These Peros are Konam to me', 'they are Konam on my mouth', 'they are Konam to my mouth', he is forbidden Chilufeihem (what they are exchanged for) and Giduleihem (what grows from them).

RAN DH Ba'i Rami bar Aba... [TRANSLATION: Rami bar Chama asked 'this produce is forbidden to Ploni' - is he permitted Chilufeihem?]

Explanation: He does not ask only about Konamos. Rather, he is unsure about all Isurei Hana'ah.

והיינו דמייתי לקמן ת"ש מהמקדש בערלה

Support: This is why below he brings the Mishnah about one who is Mekadesh [a woman] with Orlah to resolve the question.

ולאו להחליפן לכתחלה מיבעיא ליה דודאי כל שהוא אסור בהנאה אסור למוכרו ולהחליפו

Explanation: He does not ask about whether one may exchange them l'Chatchilah. Surely, anything that is Asur b'Hana'ah, one may not sell or exchange it;

Source #1: If you would not say so, we find Damim (monetary value) for Chametz during Pesach or Shor ha'Niskal (an ox sentenced to be stoned). One could sell it to a Nochri!

ואמאי תנן שהגוזל פטור מן התשלומין

(e)

Source #2: Why does a Mishnah say that one who steals [Chametz or Shor ha'Niskal] is exempt from payment?! (Surely, the owner may not benefit from them in any way, including exchanging them.)

אלא ודאי פשיטא ליה דלכתחילה אסור אלא בשעבר והחליפן מספקא ליה

Conclusion: Rather, surely it is obvious to him that l'Chatchilah it is forbidden. He is unsure about one who transgressed and exchanged it.

ולאחר נמי לא מיבעיא ליה דפשיטא ליה דמותרין שאין לך תופס את דמיו אלא עבודת כוכבים ושביעית

Assertion: Also, he does not ask about someone else. Surely [what was exchanged for Isur] is permitted to him. The only Isurim that are Tofes (forbid) what is paid for them are idolatry and [Peros] Shemitah.

והיינו דתנן ומייתי לה בריש חולין (דף ד) חמצן של עוברי עבירה אחר הפסח מותר מיד מפני שהן מחליפין

Support: This is why a Mishnah, brought in Chulin (4a) says that Chametz of transgressors (who keep it during Pesach) is permitted immediately after Pesach, for they trade (their Chametz with that of Nochrim, to minimize their Isur. Others may eat Chametz that transgressors bought from Nochrim, even though it was traded for Isur.)

אלא מספקא ליה אי מיתסרי למחליף מדרבנן בעלמא או לא

Rather, he is unsure whether or not they are forbidden to the one who exchanged them, merely mid'Rabanan.

והכי הוי עיקר ספיקיה מי אמרינן דכי תנן במתניתין אסור בחלופיהן ובגידוליהן היינו משום שכוונת הנודר בכך

His primary Safek is about our Mishnah, which says that he is forbidden Chilufeihem and Giduleihem. Is this because the Noder intended for this?

ואי משום כוונתו הוא דוקא נודר אוסר עצמו בכך

If it is due to his intent, only a Noder forbids this to himself;

דנהי דחילופיהן כדבר שלא בא לעולם דמו לגבי דידיה מצי אסר אבל לגבי חבירו לא מצי אסר

Granted, Chilufeihem are like Davar she'Lo Ba l'Olam. He can forbid to himself, but he cannot forbid to another.

או דילמא דכי תנן במתניתין אסור בחילופיהן לאו בתר דעתיה אזלינן אלא דהכא הכי הוא דכל אסורי הנאה חילופין אסורין מדרבנן למחליף עצמו

Or, perhaps our Mishnah forbids Chilufeihem, but not because we follow his intent. Rather, for all Isurei Hana'ah, Chilufeihem are forbidden mid'Rabanan to the one who exchanged them!

הלכך לא שנא הוא ולא שנא חבירו

Therefore, there is no difference between him and his friend.

ותמהני אדבעי רמי במודר ליבעי לה בנודר עצמו ובמתניתין גופה

It is a Safek mid'Rabanan, so we are lenient. Even if he transgressed and he traded them, the Chalifin are permitted.

אבל הרב רבינו משה בר מיימון ז"ל כתב בפ' חמישי מהלכות נדרים (הלכה ט"ז) הרי גדוליהן וחלופיהן ספק לפיכך חברו אסור בגידולי פירות אלו וחלופיהן

Opinion #2: However, the Rambam wrote in Hilchos Nedarim (5:16) that Giduleihem and Chilufeihem are Safek. Therefore, he is forbidden the Gidulim of these Peros and Chilufeihem;
