THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה גמ' בשלמא לא ילוה ממנו ולא יקח ממנו ולא ישאל ממנו

(a)

Gemara: Granted, he may not be Malveh from him, nor buy from him, nor be Sho'el from him.

כלומר מודר ממדיר דקא מתהני מיניה ומשום הכי אסור

Explanation: The Mudar may not do so from the Madir, for he benefits from him. Therefore, it is forbidden.

RAN DH Ela Lo Yash'ilenu... [TRANSLATION: However, why can't he be Mash'il to him, nor be Malveh to him, nor sell to him? What benefit does he get from him?!]

ר"ן ד"ה אלא לא ישאילנו ולא ילונו ולא ימכור לו מאי קא מיתהני מיניה

(SUMMARY: The Ran explains why we assume that only the buyer benefits from a sale.)

נ"ל דמשמע ליה דמתני' בזבינא חריפא

(a)

Explanation: [The Makshan] understands that our Mishnah discusses a Zevina Charifa (an item in demand).

ומש"ה משמע ליה הכי ולא מוקי ליה בזבינא דרמי על אפיה וליפרוך איפכא

Implied question: Why did he understand so? He could have established it to discuss Zevina d'Rami Al Apei (an item that is hard to sell), and ask oppositely;

א"נ בזבינא מציעתא ולא תקשי ליה מידי במכר

Alternatively, he could have established it to discuss an average sale, and he would have no question at all from a sale!

משום דסבירא דכי היכי דבהני דקתני מקמי הא דהיינו לא ישאילנו ולא ילונו לא מהני מידי

Answer: This is because he holds that just like in the cases taught before this, i.e. he may not be Mash'il to him nor be Malveh to him, he does not benefit at all;

הכי נמי בלא ימכור לו לא מתהני מידי והיינו בזבינא חריפא ומש"ה פריך הכי.

Also here, he may not sell to him in a case that he does not benefit at all, i.e. a Zevina Charifa. This is why he asked like this.

RAN DH Amar R. Yosi b'Ribi Chanina... [TRANSLATION: R. Yosi bar Chanina said, the case is, they vowed not to benefit from each other.]

ר"ן ד"ה א"ר יוסי בר' חנינא כגון שנדרו הנאה זה מזה

(SUMMARY: The Ran explains the Chidush according to this.)

וכי תימא אם כן מאי קמ"ל

(a)

Question: If so, what is the Chidush?

נראה דסתם לן כר"א דאמר ויתור אסור במודר הנאה

(b)

Answer: This is a Stam Mishnah like R. Eliezer [ben Yakov], who says that Vitur (small benefits that people normally do for free) are forbidden to a Mudar Hana'ah.

ואף על גב דכבר סתם לן כוותיה בריש פירקין /נדרים/ (דף לב:)

Implied question: There is already a Stam Mishnah like him at the beginning of our Perek (32b)!

קמ"ל דכל הני נמי לא גריעי מויתור ואסירי לר"א.

Answer: Here it teaches that all these (loans and sales) are no less than Vitur, and are forbidden according to R. Eliezer.

RAN DH Abaye Amar Gezeirah Lish'ol... [TRANSLATION: Abaye said, a decree forbids being Sho'el lest he come to be Mash'il. And so all of them are a decree.]

ר"ן ד"ה אביי אמר גזירה לשאול משום להשאיל וכן כולהון גזירה

(SUMMARY: The Ran explains why elsewhere we do not decree.)

דמש"ה אסרינן נמי למכור לו אטו ליקח ממנו

Explanation: For this reason we forbid also selling, lest he come to buy from him.

ואף על גב דתנן לעיל בפרק ד' נדרים /נדרים/ (דף לא) שאיני נהנה לישראל לוקח ביתר ומוכר בפחות שישראל נהנין לי לוקח בפחות ומוכר ביתר

Implied question: A Mishnah above (31b) teaches that [one who vowed] "I will not benefit from Yisrael", he buys for more [than the real value] and sells for less; [if he vowed] "Yisraelim will not benefit from me", he buys for less and sells for more;

ואמרינן עלה בסוגיין דלעיל דכל היכא דהוי זבינא חריפא שרי מודר למכור למדיר ולא גזרינן

It says in that Sugya above that whenever it is a Zevina Charifa, the Mudar may sell to the Madir, and we do not decree!

כבר כתב הרמב"ן (הגהת היעב"ץ) ז"ל דהתם כיון דמכלהו ישראל נדר לא גזרינן עלה דאי גזרינן עלה ומצריכינא ליה ליהנות לעובדי כוכבים טריחא ליה מילתא

Answer: The Ramban already wrote that there, since he vowed from all Yisrael, we do not decree about this, for if we decree about it and obligate him to benefit from Nochrim, it is a toil for him;

אבל כאן שאינו אסור אלא להנאת חבירו בלבד מצי למיקם עלה דמילתא וגזרינן

Here, he is forbidden to benefit only from his friend. He can fulfill this, and we decree.

וא"ת והא אפי' במודר הנאה מחבירו בלבד תנן לקמן בפרק השותפין /נדרים/ (דף מז:) הריני עליך חרם המודר אסור ומשמע אבל מדיר לא

(d)

Question: Even regarding one who is Mudar Hana'ah only from his friend, a Mishnah below (47b) teaches [if one said] "I am Cherem to you", the Mudar is forbidden [to benefit from the Madir]. This connotes that the Madir is not forbidden;

ואמאי הוה ליה למיתני שניהם אסורין ומשום גזירה

What is the reason? It should have taught that both of them are forbidden, due to a decree!

י"ל דלאו קושיא היא דכי גזרי' הכא ה"מ בהני בלחוד דתנינן במתני' דלא משמע להו לאינשי דליתסרו במודר הנאה

Answer: This is not difficult. We decree here only about these matters in our Mishnah, which people do not think that they are forbidden to a Mudar Hana'ah;

ואי עביד להו מודר למדיר אתי נמי למישקל להו ממדיר

If the Mudar will do so for the Madir, he will come to also take (buy or borrow) them from the Madir;

אבל בהנאה גמורה כאכילת פירות וכיוצא בה ליכא למיגזר הלכך לא מצי תני שניהם אסורין.

However, regarding absolute Hana'ah, like eating Peros and similar matters, there is no need to decree. Therefore, it could not teach that both of them are forbidden.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. קונם שדה שאני חורש בה לעולם

(a)

Mishnah: Konam, I will never plow [my] field with it.

שואל אמר כך לחבירו מתוך שכעס עליו שלא רצה להשאילה לו.

Explanation: The borrower said so to his friend, amidst anger at him that he did not want to lend it to him.

ר"ן ד"ה אם היה דרכו לחרוש הוא אסור וכל אדם מותרין

(b)

Mishnah: If he himself normally plows, he is forbidden [to plow his field with it], but all others are permitted [to plow his field with it];

שכיון הוא חורש אין במשמעות לשונו אלא חרישתו בלבד.

Explanation: Since he plows, his words imply only his plowing.

ר"ן ד"ה ואם אין דרכו לחרוש הוא וכל אדם אסורין

(c)

Mishnah: And if he does not normally plow, he and all people are forbidden.

שלא נתכוין לחרישתו כיון שאין דרכו לחרוש

Explanation: He did not intend for his own plowing, since he does not normally plow;

אלא שלא יהנה בחרישתו אכוין ומש"ה הוא וכל אדם אסורים לחרוש בשבילו כדי שלא יהנה בחרישתה.

Rather, he intended not to benefit from its plowing. Therefore, he and all people are forbidden to plow for him, lest he benefit from its plowing.

ר"ן ד"ה הולך אצל חנוני הרגיל אצלו

(d)

Mishnah: He goes to a grocer that he often frequents.

רבותא קמ"ל דאע"ג דרגיל אצלו ומקיפו תדיר לא אמרי' שליחותיה קעביד

Explanation: This teaches that a bigger Chidush. Even though he often frequents him, and [the grocer] constantly gives to him on credit, we do not say that he does his Shelichus;

וכ"ש שאם לא אמר לאדם מיוחד אלא דאמר כל הזן אינו מפסיד שרי כדאיתא בפרק המדיר.

And all the more so, if he did not say so to a particular person, rather, he said 'whoever feeds him will not lose', it is permitted, like it says in Kesuvos (70b).

RAN DH u'Va v'Notel mi'Zeh [TRANSLATION: He comes and takes from him.]

ר"ן ד"ה ובא ונוטל מזה

(SUMMARY: The Ran explains that the Madir is not obligated to pay him.)

אם רצה קאמר ולומר דאף על גב דלבסוף נוטל מזה ודעתייהו בהכי לאו שליחותיה קעביד

Explanation: This is if he wants to. [The Mishnah] teaches that even though in the end, he takes from [the Madir], and they intended for this, he did not do his Shelichus;

דלא הוי שליח אלא באומר כל השומע קולי יזון כדאיתא בהמדיר (כתובות דף ע:)

He is his Shali'ach only if he said 'whoever hears my voice, feed [him], like it says in Kesuvos (70b).

אבל ליכא למימר דכי קתני ובא ונוטל מזה מדינא קאמר

Suggestion: Perhaps the Mishnah says 'he comes and takes from him', in Din (the Madir must pay him)!

דאי (גירסת כתב יד) מחייב לשלומי אלמא שליחותיה קעביד ומהני ליה ואסור.

(c)

Rejection: If he were obligated to pay him, this would imply that he did his Shelichus, and he benefited him, and it would be forbidden.

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה היה ביתו לבנות

(a)

Mishnah: If he needed to build his house.

לא זו אף זו קתני

Explanation: The Mishnah teaches that not only this, rather, even this (a bigger Chidush).

ברישא אשמעינן דלצורך מזונות שרי וסיפא קמ"ל דאפילו לצורך בנין ביתו התירו.

The Reisha teaches that for the need of food, it is permitted. The Seifa teaches that even to build his house, they permitted.

ר"ן ד"ה נותן לאחר משום מתנה

(b)

Mishnah: He gives to someone else, for a gift.

דלבתר הכי לא מתהני מיניה אלא ממקבל מתנה.

Explanation: Afterwards, [the Mudar] does not benefit from [the Madir], rather, from the one who received the gift.

ר"ן ד"ה והוא נוטל ואוכל

(c)

Mishnah: And he takes it and eats.

דלאו מדידיה מתהני אלא מהפקרא.

Explanation: [The Mudar] does not benefit from [the Madir], rather, from Hefker.

ר"ן ד"ה ור' יוסי אוסר

(d)

Mishnah: And R. Yosi forbids.

בגמ' מפרש טעמא.

Explanation: The Gemara will explain the reason.

ר"ן ד"ה גמ'. מה מתנה עד דאתי מרשות נותן לרשות מקבל

Gemara: Just like a gift [is not acquired] until it comes from the giver's Reshus to the recipient's Reshus...

שאם אמר הריני נותן מתנה זו לפלוני יכול לחזור בו עד שיגיע לידו של מקבל.

Explanation: If he said 'I give this gift to Ploni', he can retract until it comes to the recipient's hand.

ר"ן ד"ה אף הפקר עד דאתי לרשו' זוכה

Gemara: Also Hefker, until it comes to the Reshus of one who acquires it.

שאינו [יוצא] מרשות בעלי' עד שיזכה בו אחר ואי בעי למיהד' מצי הדר

Explanation: It does not leave the Reshus of the owner until someone else acquires it, and [before this] if he wants to retract, he can retract;

הלכך כי זכי בה מודר ממדיר קא מתהני.

Therefore, when the Mudar acquires it, he benefits from the Madir.

ר"ן ד"ה שנדרו קודם להפקרו

(g)

Gemara: His vow preceded his Hefker.

שאסרו ואח"כ הפקירו.

Explanation: He forbade him, and afterwards made it Hefker.

ר"ן ד"ה מה לי הפקרו קודם לנדרו

(h)

Gemara: What difference does it make if his Hefker was before his Neder?

דהא כל זמן שלא זכה בו דמפקיר הוי ודינא הוא דליחול נדריה עליה ואמאי קתני ה"ז מותר.

Explanation: As long as he did not acquire it, it is of the Mafkir. It is proper that his vow take effect on it. Why does the Mishnah teach that it is permitted?

ר"ן ד"ה כל הנודר אין דעתו על מה שהפקיר

(i)

Gemara: Anyone who vows does not intend [to forbid] what he made Hefker.

אין הכי נמי דכיון דמצי הדר ביה דיליה (גירסת כתב יד) הוי ואי הוה אסר ליה לאותו דבר שהפקיר בפירוש חייל נדרו

Explanation: Indeed, since he can retract, it is his. If he explicitly forbade to him the matter that he made Hefker, the vow takes effect on it;

אלא הכא היינו טעמא משום דכל האוסר נכסיו סתם אין דעתו על מה שהפקיר.

Rather, here the reason is, anyone who forbids his property Stam, he does not intend for what he made Hefker.

RAN DH Hachi Garsinan Mesiv Rava... [TRANSLATION: The text says, Rava asked, if he gave part to the first, and all to the second, he acquired to make the first work for him.]

ר"ן ד"ה הכי גרסינן מתיב רבא...

(SUMMARY: The Ran explains the question.)

וברייתא היא בתוספתא דבבא בתרא והכי פירושו מי שיש לו שני עבדים ונתן מקצת נכסיו לראשון ואח"כ נתן לשני לא קנה ראשון דדלמא בגופיה שייר

(a)

Explanation: This is a Beraisa in the Tosefta of Bava Basra (9:4). It means that if one has two slaves, and gave part of his property (he did not specify which part) to the first, and afterwards he gave to the second, the first did not acquire, for perhaps [the master] left over in (part of) the slave himself;

וכיון שעצמו לא קנה נכסים נמי לא קנה דעבדא דקני נכסי הוא

Since he did not acquire himself, also the property he did not acquire, for he is a slave who acquired property. (It belongs to his master.)

אבל שני זכה בעצמו ובנכסים וזכה נמי להשתעבד בראשון דלגביה ליכא שיורא

2.

However, the latter acquired himself and the property, and also the right to make the first slave work for him, for regarding [the latter], nothing [in the gift] was left over.

ואי אמרת דאין דעתו על מה שהפקיר ה"נ אין דעתו על מה שנתן כבר.

3.

Question: If you (R. Yochanan) say that one does not intend for what he made Hefker, also here [we should say that] one does not intend for what he already gave! (Presumably, the master thinks that the first gift took effect.)

RAN DH Ela Amar Rava... [TRANSLATION: Rather, Rava said, R. Yosi's reason is due to the gift of Beis Choron.]

ר"ן ד"ה אלא אמר רבא טעמא דר' יוסי משום מתנת בית חורון אמר

(SUMMARY: The Ran explains why R. Abba's question is not difficult for Rava.)

ומדינא ודאי אפילו לר' יוסי שרי דמכי אפקריה נפקא ליה מרשותיה

(a)

Explanation: According to letter of the law, surely, it is permitted even according to R. Yosi, for once he was Mafkir it, it left his Reshus;

אלא דכיון דאנן סהדי דלא אפקריה אלא כדי שיזכה מודר אי שרינן ליה אתי למישרי אפי' היכא דאמר בפירוש וכמעשה דבית חורון

However, since [it is so obvious that] we can testify that he made it Hefker only in order that the Mudar will acquire it, if we permit him, people will come to permit even when he said [so] explicitly, like the episode in Beis Choron.

דתנן בפרקין דלקמן ואינן לפניך אלא כדי שיבא אבא ויאכל עמנו

A Mishnah below (48a) says [that Yakov was Mudar Hana'ah from his son Reuven. Reuven was marrying off his son. He told a friend David 'the courtyard and the banquet are yours.] They are in front of you only in order that my father can come and eat with us.'

ומש"ה דוקא בנדרו קודם להפקרו אסור דאיכא למגזר אבל הפקרו קודם לנדרו שרי.

Therefore, it is forbidden only if he vowed before he made it Hefker, for then there is reason to decree, but if he made it Hefker before he vowed, it is permitted.

RAN DH Tanya ha'Mafkir Es Sadehu... [TRANSLATION: A Beraisa teaches, if one made his field Hefker, all three days he can retract.]

ר"ן ד"ה תניא המפקיר את שדהו כל ג' ימים יכול לחזור בו

(SUMMARY: The Ran explains why he can retract within three days.)

ראיתי שמועה זו שלא נתבררה יפה בדברי הראשונים ז"ל לפי עניות דעתי וכך נראה לי בפירושה

(a)

Remark: The Rishonim did not explain this teaching well, in my humble opinion. I explain as follows;

כל שלשה ימים יכול לחזור בו מכאן ואילך אין יכול לחזור בו

[The Reisha taught that] all three days he can retract. From then and onwards he cannot retract.

מדקא מפליג בסיפא דאם אמר תהא שדה זו מופקרת ליום אחד וכו' בין זכה ללא זכה דקתני שעד שלא זכה יכול לחזור בו ומשזכה אין יכול לחזור בו

We know this, for the Seifa distinguishes. If he said "this field is Hefker for one day...", [it distinguishes] between whether or not someone acquired it. It taught "before someone acquired it, he can retract. Once someone acquired it, he cannot retract";

וברישא לא מפליג בהכי אלא תולה חזרה בקודם ג' ולאחר ג' ש"מ הכי קתני כל ג' ימים יכול לחזור בו מהפקירו ואפילו זכה אחר קודם חזרתו לא קנה

Inference: The Reisha does not distinguish like this. Rather, it makes retraction dependent on before three days and after three. This shows that it teaches that all three days he can retract from his Hefker. Even if someone else acquired it before he retracted, he did not acquire it;

ומפרש טעמא לקמן דמפקרין והדרין בהון דמשום דהפקר פטור מן המעשר היו הרמאין מפקירין שדותיהן כדי להפטר והיה דעתן בשעת הפקירן שיחזרו בהן ויזכו בהן ונמצא שלא היה הפקירן אלא להערמה בלבד

The Gemara explains the reason below, that people used to make [their fields] Hefker, and then acquire them again, because Hefker is exempt from Ma'aser. Swindlers would make their fields Hefker to be exempt [from Ma'aser], with intent while making them Hefker to acquire them again. It turns out that their Hefker was a mere ruse.

ולפיכך הוצרכו לומר שאם יזכו בהם לא יהו כזוכים מן ההפקר והוצרכו גם כן לומר שאפילו יזכה בו אחר לא יקנה ויהא מפקיר יכול לחזור בו תוך ג'

i.

Therefore, they needed to say that if they acquire them, they are not [exempt from Ma'aser] like one who acquires from Hefker. They also needed to say that even if someone else acquires, he did not acquire, and the Mafkir can retract within three days.

ואף על גב דלגבי אחר ליכא למיחש לרמאין

(b)

Implied question: Regarding another [who acquired], there is no concern for swindlers!

אפ"ה אי לא הא לא קיימא הא שאם יראו הרמאין שכשיזכה בו אחר קנה לא ישמעו לדברי חכמים שהם לא יקנו דלימרו כי היכי דאחר זכי מהפקרא אנן נמי מהפקרא זכינן

Answer #1: Even so, if not for this [decree, that others cannot acquire], this [decree, that it is not exempt from Ma'aser] would not endure. If swindlers would see that another can acquire, they would not heed Chachamim's words that [the Mafkir] cannot acquire [from Hefker]. They would say "just like another acquires from Hefker, also I acquire from Hefker!"

ועוד שכיון שנהגו הרמאין ברמאותן זה כל ג' ימים אינו מתברר שיהא הפקר דאיכא למיחש דלא מדעתייהו מפקרי אלא להערמה בלבד ולא הוי הפקר

(d)

Answer #2: Also, since the swindlers did this ruse, all three days it is not clarified that it is Hefker. There is concern that they do not truly intend for Hefker. It is a mere scheme, and it is not Hefker;

ולפיכך ראוי לומר דאפי' זכה בו אחר יכול מפקיר לחזור בו שעדיין לא נגמר הפקירו

Therefore, it is proper to say that even if someone else acquired, the Mafkir can retract, since his Hefker was not finalized.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה מכאן ואילך אין יכול לחזור בו

(a)

Gemara: From this time and onwards, he cannot retract.

ואפי' לא זכה בו אדם לא כל הימנו לחזור בו משום דלאחר שלשה תו ליכא למיחש לרמאין

Explanation: And even if no one acquired, he cannot retract, for after three days there is no concern for swindlers. (He can make Chazakah to acquire it again, but he cannot retract from the Hefker to acquire it without a new Kinyan. - PF)

שכל שנעשה ההפקר ברמאות אין הבעלים מאחרין לזכות בו יותר מג'.

2.

Any Hefker that is a mere ruse, the owner does not delay more than three days to acquire it back.
