RAN DH Tanan Makom... [TRANSLATION: The Mishnah teaches, in a place where people pay for returning Aveidos, this amount is given to Hekdesh. It is fine for the opinion that [our Mishnah permits] when the property of the Machzir (the one who returns the Aveidah) is forbidden to the Ba'al (owner of the) Aveidah. However, when the Ba'al Aveidah's property is forbidden to the Machazir, he may not return. This is why it says, in a place where people pay for returning Aveidos, this amount is given to Hekdesh. However, according to the opinion that even when the Ba'al Aveidah's property is forbidden to the Machazir, he may return, why is the Hana'ah given to Hekdesh?!]

ר"ן ד"ה תנן מקום שנוטלין עליה שכר תפול הנאה להקדש בשלמא למאן דאמר בשנכסי מחזיר אסורין על בעל אבידה אבל דבעל אבידה אסורין על מחזיר לא מהדר היינו דקתני מקום שנוטלין עליה שכר תפול הנאה להקדש אלא למאן דאמר אפילו נכסי בעל אבידה אסורים על מחזיר נמי מהדר אמאי תפול הנאה להקדש

(SUMMARY: The Ran gives two explanations of the question.)

כך היא עיקר הגירסא וה"פ בשלמא למ"ד דמתני' בשנכסי מחזיר אסורין על בעל אבידה דוקא היא

(a)

Explanation #1: This is the primary text. It means as follows. This is fine for the opinion that our Mishnah is only when the property of the Machazir (one who returns the Aveidah) is forbidden to the Ba'al Aveidah (who lost it);

דאילו נכסי בעל אבידה אסורין על מחזיר לא מהדר משום פרוטה דרב יוסף

However, if the Ba'al Aveidah's property is forbidden to the Machazir, he may not return it, due to the Perutah of Rav Yosef;

מש"ה קתני סיפא דמקום שנוטלין עליה שכר אם זה המחזיר גברא יקרנא ואינו רוצה לקבל שכרו לא ישהנו בעל אבידה לאותו שכר אצלו דהא מתהני מיניה

Therefore, the Seifa says that in a place where they receive wages [for returning], if the Machazir is esteemed, and he does not want to take his wage, the Ba'al Aveidah may not keep the wage for himself, for then he benefits from [the Machazir];

אלא תפול הנאה להקדש

i.

Rather, the benefit (wage) goes to Hekdesh.

אלא למ"ד דאפילו נכסי בעל אבידה אסורין על המחזיר מהדר אם כן רישא דקתני ומחזיר לו אבידתו אפי' בשנכסי בעל אבידה אסורין על מחזיר נמי היא

However, according to the opinion that even when the Ba'al Aveidah's property is forbidden to the Machazir, he returns it, the Reisha teaches that he returns his Aveidah even when also the Ba'al Aveidah's property is forbidden to the Machazir;

וסיפא דקתני תפול הנאה להקדש אכולא מילתא קאי

The Seifa teaches "the Hana'ah goes to Hekdesh." This refers to the entire case (no matter whose property is forbidden to whom);

ובשלמא בנכסי מחזיר אסורין אתי שפיר אי מחזיר גברא יקרנא הוא כדפרישית

Granted, when the Machazir's property is forbidden to the Ba'al Aveidah, this is fine, if the Machazir is esteemed, like I explained;

אבל בשנכסי בעל אבידה אסורין על מחזיר למה לי דתפול הנאה להקדש יעכבנו בעל האבידה לעצמו שהרי לא נאסרו נכסי מחזיר

However, when the Ba'al Aveidah's property is forbidden to the Machazir, why does the Hana'ah go to Hekdesh? The Ba'al Aveidah may keep it, for the Machazir's property is not forbidden [to him]!

וליכא למימר דהכא כשבעל אבידה גברא יקרנא ורוצה ליתן שכר ומקבל לא מצי שקיל דהא נכסי בעל אבידה אסורין עליו ומשום הכי תפול הנאה להקדש

Suggestion: Here, the case is, the Ba'al Aveidah is esteemed and wants to pay the wage to the Machazir, and [the Machazir] may not take it, for the Ba'al Aveidah's property is forbidden to him. Therefore, the wage goes to Hekdesh.

דבכהאי גוונא לא שייך יקרנא לקבל אבידתו בחנם כך פירשו רבותי

Rejection: In such a case, esteem is no reason not to receive his Aveidah for free. My Rebbeyim explained like this.

ולי נראה דהכי קאמר אמאי תפול הנאה להקדש יתן שכרו בעל אבידה למחזיר

(b)

Explanation #2: I explain that it means as follows. Why must the wage go to Hekdesh? The Ba'al Aveidah should pay the wage to the Machazir!

דנהי דנכסי בעל אבידה אסורין על המחזיר אפילו הכי מותר ליקח ממנו שכרו דהא תלמוד מזבינא (הגהות ישנות) דרמי על אפיה

Granted, the Ba'al Aveidah's property is forbidden to the Machazir. Even so, he may take his wage, for we learn from a Zevina d'Rami Al Apei (the item is hard to sell);

דאמר (גירסת כתב יד) לעיל דהנאת מוכר הוא ולא לוקח ונפקא מינה דאי לוקח מודר ממוכר מותר ליקח ממנו זבינא דרמי על אפיה

We said above (31a) that the seller benefits [from such a sale], and not the buyer. We derive from this that if the buyer is Mudar Hana'ah from the seller, he may buy from him a Zevina d'Rami Al Apei;

מאי טעמא דהא מכל מקום מודר מיתהני מההוא מידי דמוכר

i.

Question: What is the reason? In any case, the Mudar benefits from the seller's item!

אלא ודאי היינו טעמא דכיון דזבינא דרמי על אפי' הא משכח מינה לוקח טובא וכל כה"ג אף על גב דאתי לידיה ממדיר לא מקריא הנאה

ii.

Answer: Rather, surely the reason is because a Zevina d'Rami Al Apei, the buyer can find it easily [from other sellers]. In such a case, even though it came to him from the Madir, this is not called Hana'ah;

הכא נמי במקום שנותנין עליה שכר דהיינו בבטל מן הסלע

iii.

Also here, where they pay wages for returning Aveidos, i.e. the Machazir lost time from his work and lost a Sela...

אף על גב דיהיב ליה כי ההוא אגרא בעל אבידה למחזיר לא מיתהני מחזיר מיניה דבעל אבידה כלל שאותו שכר כבר היה מצוי בידו

iv.

Even though the Ba'al Aveidah gives that wage to the Machazir, the Machazir does not benefit from the Ba'al Aveidah at all, for that reward was already available in his hand. (Had he not returned the Aveidah, he would have worked at his job and earned it!)

וכיון שכן אמאי תפול הנאה להקדש הא מצי בעל אבידה למתביה למחזיר כנ"ל ונכון הוא.

v.

Therefore, why should the Hana'ah go to Hekdesh? The Ba'al Aveidah may give it to the Machazir! So it seems to me. This is correct.

2)

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה ומשני אחדא קתני

(a)

Gemara: The Gemara answers, it was taught about one [case].

כלומר רישא דמחזיר אבידתו בין בנכסי מחזיר אסורין על בעל אבידה בין בנכסי בעל אבידה אסורין על מחזיר

Explanation: I.e. in the Reisha, he may return his Aveidah whether the Machazir's property is forbidden to the Ba'al Aveidah, or the Ba'al Aveidah's property is forbidden to the Machazir;

אבל סיפא במקום שנותנין עליה שכר תפול הנאה להקדש אחדא בלחוד קאי דהיינו אנכסי מחזיר אסורין על בעל אבידה.

2.

However, in the Seifa, in a place where they pay wages [for returning Aveidos], the wage goes to Hekdesh. This refers to only one case, i.e. when the Machazir's property is forbidden to the Ba'al Aveidah.

ר"ן ד"ה איכא דמתני לה בהדין לישנא... לא שנו אלא בנכסי בעל אבידה אסורין על מחזיר

(b)

Gemara: Some teach the following version. [The Mishnah permits] only when the Ba'al Aveidah's property is forbidden to the Machazir.

ומתני' לצדדין קתני שוקל לו את שקלו ופורע לו את חובו מדיר למודר

Explanation: Our Mishnah discusses different cases. He may pay his Shekel and pay his debt, i.e. the Madir for the Mudar;

ומחזיר לו אבידתו מודר למדיר (הגהה בגליון) ותורם לו את תרומותיו מדיר למודר

2.

He may return his Aveidah, i.e. the Mudar [returns] to the Madir. He may separate Terumah for him, i.e. the Madir for the Mudar.

ומשום דבעי תנא למיתני כולהו גווני דשרי בין מדיר למודר תנא הכי כך נראה בעיני

3.

Because the Tana wanted to teach all of the cases in which it is permitted, whether the Madir or Mudar [helps the other], he taught like this. So it seems to me.

ר"ן ד"ה אבל בנכסי מחזיר אסורין על בעל אבידה לא מהדר ליה משום דקא מהני ליה

(c)

Gemara: However, when the Machazir's property is forbidden to the Ba'al Aveidah, he may not return, for he benefits him;

ועדיף טפי מפורע לו חובו דהא קא ממטי ליה בידיה

Explanation: This is greater benefit than paying his debt [which is permitted], for [here] he brings [his Aveidah] to him in his hand;

ואי לא דקא מהדר ליה אפשר דפסדא מיניה לגמרי.

i.

Had he not returned to him, perhaps [the Aveidah] would have been totally lost from him.

ר"ן ד"ה בשלמא למ"ד אף בשנכסי מחזיר אסורין מהדר

(d)

Gemara: It is fine for the one who says that even when the Machazir's property is forbidden [to the Ba'al Aveidah], he returns;

כלומר דמודר מחזיר למדיר ומדיר למודר

Explanation: I.e. the Mudar may return to the Madir, and the Madir to the Mudar.

ר"ן ד"ה היינו דמתרץ מקום דאיכא לתרוצי דאחדא קתני כלומר היכא דמהדר מדיר למודר

(e)

Gemara: Then the answer [to the question from] "in a place [where they pay...]" is proper, that it refers to one of them, i.e. when the Madir returns to the Mudar;

אלא למ"ד בשנכסי מחזיר אסורין על בעל אבידה לא מהדר וא"כ מתני' דמחזיר לו אבידתו בשנכסי בעל אבידה אסורין על מחזיר בלחוד היא

Explanation: However, according to the opinion that when the Machazir's property is forbidden to the Ba'al Aveidah, he may not return, if so our Mishnah of "he returns his Aveidah" is only when the Ba'al Aveidah's property is forbidden to the Machazir;

וא"כ היכי מתרץ מקום דבכה"ג ליכא למימר תפול הנאה להקדש וכמו שכתבתי למעלה.

If so, how can we explain "in a place"? We cannot say [that the wage goes to Hekdesh] in such a case [the Mudar returns to the Madir], like I explained above (Sof DH Tanan. There is no reason why the Madir should not take back his Aveidah for free, even if he is esteemed.)

RAN DH ul'Inyan Halachah [TRANSLATION: Regarding the Halachah.]

ר"ן ד"ה ולענין הלכה

(SUMMARY: The Ran rules that in both cases one returns the Aveidah.)

קיי"ל דבין בשנכסי מחזיר אסורין על בעל אבידה בין בשנכסי בעל אבידה אסורין על המחזיר מהדר

(a)

Pesak: We hold that whether the Machazir's property is forbidden to the Ba'al Aveidah, or the Ba'al Aveidah's property is forbidden to the Machazir, he returns.

דהא מ"ד דבנכסי מחזיר אסורין על בעל אבידה לא מהדר אתותב

(b)

Source: The one who says that when the Machazir's property is forbidden to the Ba'al Aveidah, he does not return, he was refuted.

ואף על גב דמ"ד בלישנא קמא דנכסי בעל אבידה אסורין על מחזיר לא מהדר לא אתותב דאדרבה אתיא לדידיה מתניתין טפי שפיר

(c)

Implied question: The one who says in Version #1 that when the Ba'al Aveidah's property is forbidden to the Machazir, he does not return, he was not refuted. Just the contrary, according to him, the Mishnah is better!

אפ"ה כיון דהאי לישנא בתרא הוא והך סברא דבין בנכסי מחזיר אסורין בין בנכסי בעל אבידה אסורין מהדר איתמרא בתרתי לישני כוותיה נקטינן וכן פסק הרמב"ן (הגהות ישנות) ז"ל.

(d)

Answer: Even so, since this (the second) version is last [it is primary], and this opinion, that whether the Machazir's property is forbidden to the Ba'al Aveidah, or the Ba'al Aveidah's property is forbidden to the Machazir, he returns, was said in both versions, we follow it. Also the Ramban rules like this.

RAN DH Amar Rava Haysah Lefanav Kikar Shel Hefker... [TRANSLATION: Rava said, if a Hefker loaf was in front of him - if he took it to eat it, he transgresses Me'ilah for its full value.]

ר"ן ד"ה אמר רבא היתה לפניו ככר של הפקר...

(SUMMARY: The Ran explains why he discussed a Hefker loaf.)

האי דנקיט לה בככר של הפקר ולא נקט לה בככר שלו שהיתה עומדת בחצרו והקדישה

(a)

Implied question: Why does he discuss a Hefker loaf, and not his loaf that was in his Chatzer, and he was Makdish it?

משום דבכי האי גוונא נטלה לאכלה לא מעל

(b)

Answer: It is because in such a case, if he took it to eat it he did not transgress Me'ilah;

דכיון דמקמי הקדש שלו היתה ולאחר הקדש ג"כ ברשותו עומדת ה"ל כגזבר של הקדש

Since before Hekdesh it was his, and also after Hekdesh it stands in his Reshus, he is like the Gizbar of Hekdesh [regarding it];

דאמרי' בסוף פ"ק דחגיגה (דף יא) שאם נטל דבר של הקדש לזכות בו לא מעל משום דמעיקרא נמי ברשותיה קאי והשתא נמי ברשותיה

We say in Chagigah (11a) that if he (the Gizbar) took something of Hekdesh to acquire it, he was not Mo'el, since initially it was in his Reshus, and also now it is in his Reshus;

ואין מעילה בהקדש אלא במוציא מרשות הקדש לרשות אחר ומה לי בחצרו מה לי בידו הכא והכא לא נפיק מרשותיה

i.

Me'ilah of Hekdesh is only when he takes from Hekdesh's Reshus to another Reshus. There is no difference whether it is in his Chatzer or in his hand. Either way, it did not leave his Reshus!

להכי נקיט ליה בככר של הפקר שהיתה עומדת תוך ד' אמותיו שקונות לו בכל מקום

3.

Therefore, he discusses a Hefker loaf that was within his four Amos, which acquire for him everywhere;

ומש"ה כי אמר ככר זו הקדש חייל ומקדיש זה לא זכה בו מעולם

4.

Therefore, when he says "this loaf is Hekdesh", it takes effect, and this person who was Makdish never acquired it.

דאע"ג דאמר בפ"ק דב"מ (דף י) דד' אמות של אדם קונות לו אפי' כי לא אמר אקנה

(c)

Implied question: It says in Bava Metzi'a (10a) that a man's four Amos acquire for him everywhere, even if he did not say "I will acquire"!

הכא שאני משום דכיון דאמר ככר זו הקדש גלי אדעתיה דלהקדש ניחא ליה דליקני לדידיה לא ניחא

(d)

Answer: Here is different. Since he said "this loaf is Hekdesh", he revealed that he wants Hekdesh to acquire it, but he does not want [to acquire it].

וגילויי דעתא כי האי מהני כדמוכח סוגייא דהתם

Such Giluy Da'as (revealing his intent) helps, like is proven in the Sugya there.

ומצי למעבד הכי דה"ל כמגביה מציאה לחבירו דקנה חבירו ולא הוא

(e)

Explanation: He is able to do so (be Makdish it without acquiring it), for this is like one who picks up a Metzi'ah for his friend. His friend acquired it, and he did not;

הכא נמי הקדש קני ואיהו מעולם לא קנה זה נ"ל

Also here, Hekdesh acquires, and he never acquired. So it seems to me.

ומש"ה נטלה לאכלה מעל לפי כולה שכיון שלא זכה בו מעולם אינו כגזבר עליה

(f)

Support: This is why if he took it to eat it, he was Mo'el for its entire value. Since he never acquired it before, he is not like a Gizbar regarding it;

ולפיכך כשנטלה הוציאה מרשות הקדש ומשום הכי מעל.

Therefore, when he took it, he removed it from the Reshus of Hekdesh. Therefore, he was Mo'el.

RAN DH Lehorishah l'Vanav Ma'al Lefi Tovas Hana'ah she'Bah [TRANSLATION: [If he picked it up] to bequeath it to his sons, he was Mo'el for the amount of benefit he has from it.]

ר"ן ד"ה להורישה לבניו מעל לפי טובת הנאה שבה

(SUMMARY: The Ran explains why he is Mo'el for the amount of Tovas Hana'ah.)

דכיון דלא הגביהה אלא להורישה לבניו ולא שיקנו אותה עכשיו לא נפקא לחולין

(a)

Explanation: Since he picked it up only to bequeath it to his sons, and not that they should acquire it now, it did not become Chulin;

אבל מ"מ מעל לפי טובת הנאה לפי שמעכשיו יחזיקו לו בניו טובה כיון שהוא מחזר להורישם

However, in any case he was Mo'el for the amount of Tovas Hana'ah, for from now his sons will have gratitude to him, since he seeks to bequeath to them;

ובניו מועלין לכשיוציאו

His sons are Mo'el from when they spend [or consume] it.

והא דאייתי הכא הך מימריה דרבא

(b)

Question: Why was this teaching of Rava brought here?

משום דדמיא ליה להך בעיא דבעא מיניה רב חייא בר אבין דכי היכי דהכא הקדיש הככר ואח"כ נטלה לאכלה בדרב חייא בר אבין נמי אסר הככר ואח"כ נתנה לו.

(c)

Answer: It is because it resembles the question that R. Chiya bar Avin asked of Rava. Just like here he was Makdish the loaf and afterwards took it to eat it, also in the question of R. Chiya bar Avin, he forbade the loaf and afterwards gave it to him.

6)

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה בעא מיניה רב חייא בר אבין מרבא...

(a)

Gemara - Question (Rav Chiya bar Avin): If Shimon said to Levi 'my loaf is forbidden to you', and then he gave it to him, what is the law? Does 'my loaf' mean 'as long as it is in my possession'?

דככרי בעוד שהככר שלו משמע אבל לאחר שנתנה כיון דלא הוי שלו מותר בה

Explanation: "My loaf" connotes while the loaf is his, but after he gave it, since it is not his (the Madir's), it is permitted to him (the Mudar);

RAN DH Oh Dilma [TRANSLATION: Or, perhaps he said to him "[it is forbidden] to you" and he made it Hekdesh to him.]

ר"ן ד"ה או דלמא עליך א"ל ועילויה שויה הקדש

(SUMMARY: The Ran explains why it was a proper question.)

דה"ק ליה זו שהיא עכשיו ככרי אסורה עליך לעולם

(a)

Explanation: He said to him "this, which is now my loaf, is permanently forbidden to you."

ובודאי פשיטא ליה לרב חייא דהיכא שנתן מדיר ככר זה לאדם אחר מותר המודר בו

(b)

Observation: Surely, it is obvious to R. Chiya bar Avin that in a case where the Madir gave the loaf to someone else, it is permitted to the Mudar;

וכדתנן לקמן בפרק השותפין /נדרים/ (דף מו) ביתך שאני נכנס שדך שאני לוקח מת או שמכרן לאחר מותר

A Mishnah below (46a) teaches "I will not enter your house or buy your field", if the owner died or sold it to someone else, he is permitted;

אלמא כל היכא דאפסקיה אחר שרי

i.

Inference: Whenever someone else interrupted in the middle, he is permitted!

אלא היינו טעמא דמבעיא הכא משום דלא אפסקיה אחר דממדיר למודר קאתי

(c)

Distinction: The reason he asks here is because no one else interrupted in the middle. It comes from the Madir to the Mudar.

וכ"ת תפשוט מההיא דפ' השותפין לאיסורא

(d)

Question: He should resolve this from the case below (46a) that it is forbidden!

מדקתני מכרן לאחר מותר משמע הא מכרן למודר אסור

It taught that if he sold it to someone else, [the Mudar] is permitted. This implies that if he sold it to the Mudar, he is forbidden!

ליתא דאיכא למימר דמשום דבעי למתנא סיפא ביתך זה שאני נכנס שדך זה שאני לוקח מת או שמכרן לאחר אסור

(e)

Answer: This [inference] is wrong. We can say that since he needed to teach in the Seifa "I will not enter this house of yours or buy this field of yours", if the owner died or sold it to someone else, he is forbidden....

דהתם נקט אחר לרבותא מש"ה איכא למימר דנקט רישא נמי לאחר ולאו דוקא דה"ה לו

There, it mentions someone else for a Chidush. Therefore, we can say that also the Reisha mentioned someone else, but it is not precise. The same applies if he sold it to him (the Mudar).

והקשה רשב"ם ז"ל מאי קמבעיא לרב חייא בר אבין מתני' היא דתנן בפירקין (לקמן /נדרים/ דף מג)

(f)

Question (Rashbam): What was R. Chiya bar Avin's question? A Mishnah (43a) teaches this!

המודר הנאה מחבירו ואין לו מה יאכל הולך אצל חנווני הרגיל אצלו ואומר לו פלוני מודר הנאה ממני ואיני יודע מה אעשה לו הרי זה נותן לו ובא ונוטל מזה

Citation (Mishnah): If Ploni is Mudar Hana'ah from Shimon, and Ploni has nothing to eat, Shimon goes to a grocer he regularly buys from, and says "Ploni is Mudar Hana'ah from me. I do not know what I will do for him!" The grocer gives to Ploni, and takes [money] from Shimon.

היה מהלך במדבר נותן לאחר וכו' אם אין עמהם אחר מניח על הסלע וכו'

2.

Citation (cont.): If he was walking in the Midbar, he gives to someone else [and that person gives to Ploni]. If there was no one else, he puts [food] on a rock [and makes it Hefker].

והתם ודאי לא באומר נכסים אלו עליך דבכה"ג אפילו אפסקיה אחר נמי אסור

There, surely he did not say "this property is forbidden to you", for in such a case even if someone else interrupted in the middle it is forbidden!

אלא ודאי באומר נכסי עליך ואפ"ה טעמא דאיכא אחר הא מידו של מדיר למודר אסור

i.

Rather, he said "my property is [forbidden] to you", and even so, [it is permitted] only because someone else interrupted in the middle. If it goes straight from the hand of the Madir to the Mudar, it is forbidden.

וי"ל דהתם במדירו מהנאתו וכיון שכן אם נותן מתנה בשעת מתנה הרי הוא נהנה ממנו

(g)

Answer: That Mishnah discusses one who was Mudar from Hana'ah from him. Therefore, if he gives to him a gift, at the time of the gift he benefits from him;

אבל הכא דאמר ככרי איכא למימר דשרי משום דבשעה שנהנה מן הככר אינו של מדיר.

Here, he said "my loaf." We can say that it is permitted [if he gives it to him], since when he benefits from the loaf, it is not the Madir's.

RAN DH Amar Lei Peshita d'Af Al Gav... [TRANSLATION: He told him, 'obviously, even though he gave it to him for a gift, it is forbidden to him. If not, what does 'to you' exclude - if he will steal it?!]

ר"ן ד"ה אמר ליה פשיטא דאף על גב...

(SUMMARY: The Ran explains Rava's answer.)

בתמיה כלומר ודאי דאף על גב דיהבה ניהליה במתנה אסר עליו ככרו

(a)

Explanation: This is said in astonishment. Surely, he forbade his loaf to him even if he [later] gave it to him for a gift;

דאי לא לאיזה ענין אסרה עליו ומאי נפקא ליה מן איסורו הרי בעוד שהככר שלו וברשותו אין צריך לאסרו עליו שהרי אסור ועומד הוא לו

If not, for which case did he forbid it? What difference does his Isur make? While the loaf is [still] his, he need not forbid it to him, for it is already forbidden to him (he may not steal it)!

וליכא למימר דמש"ה אסרו עליו משום דאי מגנבא מיניה תתסר עליה דליכא דמסיק אדעתיה הכי

i.

You cannot say that he forbade it in case he will steal it, it will be forbidden to him, for this does not cross one's mind!

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה אמר ליה לאפוקי דאי אזמניה עלה

Gemara: He told him, it excludes (forbids the Mudar) if he will invite him to eat from it.

כלומר לעולם אימא לך דאי יהיב ליה במתנה שריא ליה וכי קאמר ליה עליך לאפוקי דאי אזמניה עלה תתסר ליה דההיא שעתא נמי ככרו היא.

Explanation: Really, I can tell you that if he gave it to him for a gift, it is permitted to him. He said 'to you' to exclude (forbid) if he will invite him to eat from it. It will be forbidden to him, for also at that time it is [the Madir's] loaf.
