WHAT ONE MAY OFFER ON A BAMAH (Yerushalmi Halachah 11 Daf 15b)

תני אמר ר' יהודה כל מה שהציבור [צ"ל והיחיד - קרבן העדה] מקריב באהל מועד שבמדבר הוא מקריב באהל מועד שבגלגל

(Beraisa - R. Yehudah): Everything that the Tzibur and an individual offers in the Ohel Mo'ed in the Midbar, he offers in the Ohel Mo'ed in Gilgal;

מה בין אוהל מועד שבמדבר לאוהל מועד שבגלגל אהל מועד שבמדבר לא היה לו היתר במה אהל מועד שבגלגל היה לו היתר במה ובמתו בראש גגו ואין מקריב עליה אלא עולה ושלמים בלבד

What is the difference between the Ohel Mo'ed in the Midbar, and the Ohel Mo'ed in Gilgal? When the Ohel Mo'ed was in the Midbar, there was no Heter [for an individual to build a] Bamah. When the Ohel Mo'ed was in Gilgal, there was a Heter Bamah, and [one could build] his Bamah on his roof, and he may offer on it only Olah and Shelamim (but not Menachos and Nezirus).

Chachamim say, everything that the Tzibur offers in the Ohel Mo'ed in the Midbar, they offer in the Ohel Mo'ed in Gilgal.

מאי טעמא (דר' יודה) [צ"ל דרבנן - קרבן העדה] [דברים יב ח] לא תעשו בגלגל ככל אשר אנחנו עושים פה היום מה [דף טז עמוד א] תעשו שם דבר שהוא בא לידי ישרות ואיזו זו זו עולה ושלמים

What is Rabanan's reason? "Lo Sa'asu" in Gilgal "k'Chol Asher Anachnu Osim Po ha'Yom" (the Tzibur and individuals offer even obligations, and even without a fixed time). What will you offer there? Something that comes to Yashrus ("Ish Kol ha'Yashar b'Einav", i.e. voluntary). What is this? It is Olah and Shelamim. (This limitation applies to an individual.)

What is R. Yehudah's reason? In a place that "Ish Kol ha'Yashar b'Einav" (individuals offer what they want, i.e. Bamas Yachid), do not do "k'Chol Asher Anachnu Osim Po ha'Yom." What will you offer there? Something that comes to Yashrus ("Ish Kol ha'Yashar b'Einav", i.e. voluntary). What is this? It is Olah and Shelamim. (However, one may offer on the Bamas Tzibur just like in the Midbar - ha'Gaon Rav C. Kanievsky, Shlita.)

ר' יהודה אומר היחיד הוזהר והיחיד הותר הוזהר ובמתו בראש גגו והותר לעולה ולשלמים

R. Yehudah says, an individual is warned (Lo Sa'asu...), and an individual is permitted, and his Bamah is on his roof, and he is permitted Olah and Shelamim;

רבנן אמרי אף הציבור והיחיד הוזהרו ציבור הותר מכללו יחיד לן באיסורו

Rabanan say, even the Tzibur and an individual are warned (Lo Sa'asu...). The Tzibur is totally permitted, and an individual retains his Isur (even on a Bamah Gedolah, he may not offer obligations).

תני בשם ר"ש הציבור אינו מביא אלא מה שקבע עליו הכתוב

(g)

(Beraisa, in the name of R. Shimon): The Tzibur brings [in Gilgal] only what the Torah fixed [a time] for it. (This is unlike Chachamim and R. Yehudah, who say that the Tzibur offered in Gilgal like in the Midbar.)

R. Shimon holds that once Ma'aser Sheni was fixed, it did not cease. (This is not relevant here. It is brought below, and was copied here.)

Question: What is the difference between them (Chachamim and R. Shimon)?

ר' בא בר ממל אמר פר העלם דבר ביניהן

Answer #1 (R. Ba bar Mamal): They differ about Par Helam Davar. (It is an obligation of the Tzibur without a fixed time.)

ר' יוסה אומר נדבת הציבור ביניהן

Answer #2 (R. Yosah): They differ about Nedavah of the Tzibur (Olos offered when the Mizbe'ach is idle).

תני אחד האיש ואחד האשה

(Beraisa): The same applies to a man or woman (they may offer on a Bamah).

Objection (R. Yochanan): A woman may not [offer on a Bamah]. It says "Ish" in the Parshah!

(Beraisa): Also Nezirus (all permit it on a Bamah, like Nedarim and Nedavos.)

Objection (R. Yochanan): Nezirus is not [permitted on a Bamah. He accepted Isurei Nezirus, and automatically the Korbanos] are an obligation!

(Beraisa): Also Nesachim (are offered on a Bamas Yachid.)

(R. Yosah bei R. Bun): The Tana who taught Nesachim argues with Rebbi;

דתני ר' אומר אומר אני אף משנכנסו ישראל לארץ אין נסכיה קריבין אלא מבפנים

(Beraisa - Rebbi): I say that even from when Yisrael entered Eretz Yisrael, Nesachim are offered only inside (on a Bamah Gedolah);

מה טעמא [במדבר כח ז] בקדש הסך נסך שכר לה' אין כתיב בלא תעשה אלא מבפנים

What is the reason? "Ba'Kodesh Hasech Nesech Shechar la'Shem" - the Lav is written only inside [ba'Kodesh].

Question: What is the source [that it is forbidden] outside?

נישמעינה מן הדא מניין לשוחט לפסח (וליחיד ולבמת יחיד ולבמת ציבור בשעת איסור במה) [צ"ל בבמת יחיד בשעת איסור הבמות - קרבן העדה] שהוא עובר בל"ת ת"ל [דברים טז ה] לא תוכל לזבוח את הפסח (באחת) [צ"ל באחד]

Answer #1: We learn from the following. What is the source for one who slaughters Pesach on a Bamas Yachid at a time of Isur Bamos that he transgresses a Lav? It says "Lo Suchal Lizbo'ach Es ha'Pasach b'Achad";

Question: He is Chayav Kares, and you say so (what is the source for a Lav)?!

Answer (Reish Lakish): It discusses one who slaughters [Pesach on Erev Pesach] after six hours Lo Lishmah at a time of Heter Bamos. (Bamos are permitted for Olah and Shelamim, but not for Pesach.)

ולמה הוא אומר בשעת איסור במה בשעת איסור במתו

Why does [the Beraisa] say at a time of Isur Bamah? It is a time when his Bamah is forbidden [for Pesach. At other times, it is like Shelamim.]

ולמה לי שלא לשמו שלא תאמר שלמים הן והן כשירין

Why does [Reish Lakish] say Lo Lishmah? It is lest you say that [Lo Lishmah] it is a Shelamim, and it is Kosher [on a Bamah].

ועוד מן הדא יכול אם שחטו משש שעות ולמעלן יהא כשר מה אית לך משש שעות ולמטן יהא (פסול) [צ"ל כשר - קרבן העדה] לא שלא לשמו

Answer #2: We learn from the following. One might have thought that if he slaughtered after six hours it is Kosher. [Since he asked only about after six,] this implies that before six hours it is Kosher. Do we not discuss Lo Lishmah?!

אמר רבי יוסה הדא אמרה שלמים הבאין מחמת פסח כשירים בבמה

Inference (R. Yosah): This teaches that Shelamim that comes due to Pesach (e.g. Pesach was lost, and another was offered in place of it. The initial Pesach is offered for Shelamim) is Kosher on a Bamah.

עולה הבאה מחמת אשם על דעתיה דרבי לעזר מהו שתהא כשירה בבמה

Question: An Olah that comes due to Asham (e.g. the owner died. It is Ro'eh (it grazes until it gets a Mum, redeemed, and Olah is brought with the money), according to R. Lazar, is it Kosher on a Bamah?

נישמעינה מן הדא זה הכלל כל שהוא נידר ונידב קרב בבמה וכל שאינו לא נידר ולא נידב אינו קרב בבמה

Answer: We learn from the following. The rule is, anything brought due to Neder or Nedavah is offered on a Bamah, and anything not brought due to Neder or Nedavah is not offered on a Bamah. (Shirei Korban - R. Lazar holds that one may volunteer Asham Taluy. Therefore, it is considered brought due to Neder or Nedavah.)

אמר ר' יוסי בן חנינה אין הבהמה ניתרת אלא בנביא מה טעמא [דברים יב יג יד] השמר לך פן תעלה עולותיך בכל מקום אשר תראה כי אם במקום וגומר

(R. Yosi ben Chaninah): An animal is permitted [to offer it on a Bamah when Bamos are forbidden] only through a Navi [for Hora'as Sha'ah]. What is the reason? It says "Hishamer Lecha Pen Ta'aleh Olasecha b'Chol Makom Asher Tir'eh Ki Im ba'Makom..."

Question: Does Eliyahu offer at a time of Isur Bamos?!
