ACQUISITIONS OF A CANAANITE SLAVE (Yerushalmi Halachah 3 Daf 13a)

(a)

Question: Why did the Mishnah not teach that a Canaanite slave goes free if his master destroyed one of his (24) periphery limbs?

א''ר יוחנן בן מרייה מפני המחלוקת אית תניי תני צריך גט שיחרור אית תניי תני אין צריך גט שחרור

Answer (R. Yochanan ben Marayah): It is because the issue is subject to dispute, as one opinion holds that he must nevertheless receive a freedom document and the other opinion does not require it.

פשיטא שהעבד מקבל מתנה מאחר לאחר מאחר לרבו מרבו לעצמו לא

It is obvious that a slave can acquire a gift from someone for someone else; he can acquire from someone for his master and he cannot acquire from his master for himself.

מאחר לעצמו מחלוקת רבי מאיר וחכמים

But as for acquiring from someone else for himself, there is a dispute between R. Meir and the Chachamim...

(אימר) [דתניא האומר] הא לך כסף זה שלא יהא לרבך רשות בהן זכה העבד זכה רבו ד''ר מאיר

(Beraisa - R. Meir): If a person says, "Take this money for yourself that your master will not control it'', when the slave acquires it, the master acquires it.

וחכמים אומרים זכה העבד לא זכה רבו

Chachamim: The slave acquires it but not the master.

מה צריכה ליה מרבו לאחר כשם שהעבד זכה מאחר לרבו כך הוא זוכה מרבו לאחר

Question: The only case that is in doubt is whether a slave can acquire from his master for someone else - do we say that just as a slave can acquire from someone else for his master, so too vice-versa?

נישמעינה מן הדא השואל את הפרה ושילחה לו ביד עבדו ביד בנו ביד שלוחו לית הדא אמרה שהעבד זכה מרבו לאחר

Suggestion (Beraisa): One who borrowed a cow and was sent it using the lender's slave, his son or his messenger, if the cow died on the way, the borrower is exempt, since these people did not make an acquisition on behalf of the borrower. (However if the borrower requested it to be sent this way, he is liable.) This can surely prove that a slave can acquire from his master for someone else!

Rejection (R. Elazar): The Beraisa is referring specifically to a Jewish slave.

אמר רבי יוחנן תיפתריניה בעבד כנעני תיפתר באומר לו פתח לה והיא באה מאיליה

Alternative explanation (R. Yochanan): The Beraisa could be referring to a Canaanite slave but the borrower told the lender, "Send it on its way and it will come by itself''...

ותנינן הנהיגה במשיכה קרא לה ובאת (אחרון) [אחריו] מתחייב בה כשואל

Support (Beraisa): If the borrower led it, pulled it or beckoned it and it came, he accepts responsibility like a borrower.

רבי זעירא שמע לה מן הדא [דף יג עמוד ב] אבל אינו מזכה לא על ידי בנו ובתו הקטנים ולא ע''י עבדו ושפחתו הכנענים מפני שידן כידו

Suggestion #2 (R. Zeira - Mishnah in Eiruvin): (When making a Shitufei Mavuos i.e. creating a single domain between all of the courtyards of an alley and the alley itself, thereby allowing the people of the courtyards to carry freely there on Shabbos; all courtyards give an amount of bread and the basket with all of the breads is placed in one of the courtyards. When a person wishes to make acquisition on behalf of all of the members of the alley, he could give all of the bread to someone else) but he cannot make an acquisition by giving it to his son or daughter who are children nor giving it to his Canaanite slave or slave woman, since their hand is like his hand.

לית הדא אמרה שאין העבד זוכה מרבו לאחר

Conclusion of proof: Does this not prove that a slave cannot acquire from his master for someone else?

תיפתר כרבי מאיר דרבי מאיר עבד יד העבד כיד רבו

Rejection: This Mishnah follows the view of R. Meir that the slave's hand is like his master's hand.

והתני אשתו דרבי מאיר עבד יד האשה כיד בעלה

Question: The Beraisa taught that one could make the acquisition by giving it to one's wife, but according to R. Meir, the wife's hand is like the husband's hand?

רבי חנינה בשם רבי פינחס תיפתר כהדין תנייא

Answer (R. Chanina citing R. Pinchas): It can be explained using the Beraisa (that even R. Meir agrees that the wife's hand is not like the husband's hand)...

דתני אשתו אינה פודה לו מעשר שני

Beraisa: One's wife cannot redeem Maaser Sheni for him (without paying the surcharge of an extra 1/5th).

רבי שמעון בן אלעזר אמר משום ר''מ אשתו פודה לו מעשר שני

R. Shimon ben Elazar citing R. Meir: One's wife can do so (since she is considered to be like an unrelated person redeeming Maaser Sheni on his behalf).

והדין תנייא דרבי מאיר עביד יד העבד כיד רבו ולא יד האשה כיד בעלה

Conclusion of proof: This understanding of R. Meir surely proves that R. Meir holds that although a slave's hand is like his master's, but a wife's hand is not like her husband's hand.

R. Zeira/R. Chiya citing R. Yochanan: It appears that a slave can acquire a freedom document for another since it is a subject relevant to him, but he cannot acquire a divorce document for a woman since it is not relevant to him (as he himself cannot give Kidushin nor give a Get).

אין תימר מתניתא היא הרי את שפחה וולדך בן חורין אם היתה עוברה זכת לו [דף יג עמוד ב (עוז והדר)] עוברה

Question: Is it not a Beraisa - "You are still a slave woman but your fetus is free'' - if she is pregnant, she acquires the freedom of the fetus from the master. (This shows that a slave can acquire from his master for someone else!)

Rejection: This is because the Sages viewed a fetus as one of its mother's limbs.

רבי בא בר חייה בשם רבי יוחנן נראין דברים שקיבל העבד גט שחרור ואל יקבל גט כוותין

R. Ba bar Chiya citing R. Yochanan: It appears that a slave can acquire a freedom document for himself (as he acquires his document and his hand at the same time) but he cannot acquire a freedom document for another slave (since he is not a valid messenger).

אין תימר משנה קודמת הרי את שפחה וולדך בן חורין אם היתה עוברה זכת לו

If you will ask that this law is explicitly written in the above Beraisa, that if a master said to his slave woman, "You are still a slave woman but your fetus is free'', that if she is pregnant, she acquires freedom on behalf of her fetus...?

עוברה עשו אותו כאחת מאיבריה

(We have already answered above that) the Sages viewed a fetus like one of its mother's limbs.

If on his death bed, a person said, "For plonis my slave woman, I am making her a document to prevent her falling to my inheritors upon my death''...

רבי לעזר ורבי שמעון בן יקים אעלון עובדא קומי רבי יוחנן אמר לא הכל ממנו לשעבד

R. Elazar and R. Shimon ben Yakim brought this case before R. Yochanan, who answered that the inheritors cannot enslave her, as they must follow the command of the deceased.

בניה מה הם

They asked R. Yochanan: What is the status of children born to her afterwards?

עבדים

Answer (R. Yochanan): They are slaves.

מה שייר בה

Question: So what did his document achieve?

מעשה ידיה

Answer: She keeps her earnings.

ר' אבא ור' יוסי תריהון אמרין דרבי היא דרבי אמר אדם משחרר חצי עבדו

R. Aba and R. Yosi: This ruling follows the opinion of Rebbi, that a person could free part of his slave.

כתב כל נכסיו לשני עבדיו כאחת שניהן יצאו לחירות ושניהן צריכין לשחרר זה את זה

If a person wrote over all of his property to his two slaves, they go free and must give freedom documents to each other.

רב יהודה בשם שמואל ר' אבהו בשם ר' יוחנן דרבי היא דרבי אמר אדם משחרר חצי עבדו

Rav Yehudah citing Shmuel/ R. Abahu citing R. Yochanan: This ruling follows the opinion of Rebbi, that a person could free part of his slave.

Question (R. Zeira to R. Aba): Can we not learn from here that a slave can acquire from his master for someone else? (See (e) above)

Answer (R. Aba): Do you think that after they received the property, they went free? Rather, they acquire freedom and the property at the same time.

הרי את בת חורין וולדך עבד וולדה כיוצא בה דברי רבי יוסי הגלילי

Beraisa (R. Yosi Haglili): If a master said to his slave woman, "You are free but your fetus is still a slave'', the slave also goes free.

וחכמים אומרים לא עשה כלום

Chachamim: He has not done anything.

אמר ר' אלעזר כך פירשה ר' הושעיה אב המשנה שניהן בן חורין

Opinion #1 (R. Elazar): R. Hoshiyah 'Master of Mishnah' explained that the Chachamim said that they both go free.

Opinion #2 (R. Imi citing R. Yochanan): They are both slaves.

Question: According to R. Yochanan, the dispute between R. Yosi Haglili and Chachamim is understood. But according to R. Elazar there does not seem to be a dispute...?

אלא כיני דבריו קיימין דברי ר' יוסי הגלילי וחכמים אומרים לא עשה כלום

Rather, the Beraisa should actually say that R. Yosi Haglili says that his words are fulfilled and the Chachamim say that he has not said anything...

Question: What do the Chachamim mean by "he has not said anything''?
