TOSFOS DH V'YA'ASEH MAH SHE'LIBO CHAFETZ

(Summary: Tosfos clarifies the statement.)

(a)

Refuted Explanation: Chas ve'Shalom, says the Rach, that this is a Heter to transgress a sin ...

(b)

Authentic Explanation: What Rebbi Ila'i therefore must mean is that the travails of traveling and staying at inns, together with the wearing of black, will break the Yeitzer-ha'Ra and prevent him from carrying out the sin.

2)

TOSFOS DH EIN MAKIFIN B'CHILUL HASH-M

(Summary: Tosfos grapples with the fact that the Gemara refers to it as a Mishnah.)

(a)

Explanation #1: The Rach explains that it is a Mishnah in Pirkei Avos.

1.

Clarification: Maybe it is the Mishnah in Perek 4 (Mishnah 4) Whoever desecrates the Name of Hash-m in private gets punished in public'.

(b)

Question: But the Lashon 'Ein Makifin' (One does not give credit) is difficult.

(c)

Explanation: Perhaps it is a Beraisa, notwithstanding the fact that the Gemara says 'T'nan'.

TOSFOS DH TALMUD GADOL SHE'HA'TALMUD MEIVI LI'YEDEI MA'ASEH

(Summary: Tosfos resolves a discrepancy between this statement and the Sugya in Bava Kama.)

(a)

Introduction to Question: The Gemara at the end of the first Perek of Bava Kama (Daf 17a) relates how, after washing his hands and putting on Tefilin, Rebbi Yochanan said that we read "He observed the Mitzvos" (by the coffin of a dead person), but not "He learnt Torah" ...

1.

Introduction to Question (cont.): But', the Gemara asks, 'did Mar not say "Torah-study is great, since study leads to the observance of Mitzvos"?' - and Rashi explains 'What depends on what? Surely the less important thing depends on the more important one, in which case since we say that he observed, how much more so did he learn, which is less important ...

2.

Question: So we see from here that keeping the Mitzvos is more important?

(b)

Explanation #2: The explanation there is as follows: 'And afterwards he said "He observed, we say, He learned, we don't" ' - and the Gemara asks from Mar, who said 'Torah-study is great, since study leads to the observance of Mitzvos' - in which case how can he have observed Mitzvos if he did not study? ...

1.

Explanation #2 (cont.): Consequently, when we declare 'He observed', we are automatically saying that he studied, so how can you say "He observed, we say, He learned, we don't"? ' ...

2.

Explanation #2 (cont.): And the Gemara answers 'One refers to learning, the other, to teaching' - Regarding studying, observance is greater, but teaching others is definitely greater than observing the Mitzvos ...

3.

Explanation #2 (concl.): ..therefore we do not say that he taught others.

(c)

Explanation #3: Other commentaries explain that if a person who has not yet learned and comes to ask whether he should learn first or study Torah, one tells him to study first - because 'An ignoramous cannot be pious' (Pirkei Avos, 2:6) ...

1.

Explanation #3 (cont.): ... but as far as someone who has already learned is concerned, deeds are more important than learning (See also Tosfos, Bava Kama 17a DH 've'ha'Amar).

4)

TOSFOS DH EIN TECHILAS DIYNO SHEL ADAM ELA AL DIVREI TORAH

(Summary: Tosfos reconciles this statement with the Gemara in Shabbos.)

(a)

Question: When the Gemara says in Perek Bameh Madlikin (Shabbos, Daf 31a) that when a person is taken before the Heavenly Court, they ask him 'Were you honest in your business dealings'? ...

(b)

Answer: ... that is specifically with regard to the interrogation, but he is first punished for not fixing times to learn Torah (See also Tosfos, Sanhedrin, 7a).

5)

TOSFOS DH V'YESH OMRIM AF PASUL L'EIDUS

(Summary: Tosfos disagrees with Rashi's explanation and elaborates.)

(a)

Refuted Explanation: Rashi explains that since he (someone who eats in the street) does not care about himself and he is not embarrassed to demean himself and to become Pasul.

(b)

Refutation: ... why should that disqualify him from testifying, seeing as the Yerushalmi relates how, when Rebbi Meir saw Rebbi Shimon the son of Rebbi eating in the street, he said to him "It is not respectable for a Talmid to eat in the street!", implying that regarding anyone else, it doesn't matter?

(c)

Authentic Explanation: The Rach explains that it speaks here where he grabs food and eats it.

(d)

Question: In that case, it is obvious that he is Pasul, since he is a Gazlan?

(e)

Answer #1: It speaks where he stole less than a P'rutah's worth ...

(f)

Answer #2: Or things on which the owner is not particular.

(g)

Answer #3: ha'Rav R. Eliyahu explains that he goes around from seller to seller tasting a bit of food here and a bit there, giving the impression that he wants to buy from them.

1.

Answer #3 (cont.): According to that, it fits to call him a dog - since he is like a dog that eats a bit here and a bit there.

(h)

Answer #4: Whereas Rabeinu Tam explains explains that 'eats in the street' means that he actually eats a meal of bread, which is exceptionally demeaning.
