THE FINE FOR AN OX THAT GORED A SLAVE (Yerushalmi Perek 3 Halachah 10 Daf 22b)

מתני' האומר פיתיתי את בתו של פלוני משלם בושת ופגם על פי עצמו ואינו משלם קנס

(a)

(Mishnah): If a man says 'I seduced Ploni's daughter', he pays for embarrassment and blemish due to his own admission, but not the fine;

האומר גנבתי משלם את הקרן על פי עצמו ואינו משלם לא תשלומי כפל ולא תשלומי ארבעה וחמשה

(b)

If one says 'I stole an animal' he pays the principal, but not double or (if he sold or slaughtered it) four or five times its value;

המית שורי את פלוני או שורו של פלוני הרי זה משלם על פי עצמו

(c)

If one says that his ox gored Ploni, or Ploni's ox, he pays due to his admission;

המית שורי עבדו של פלוני אינו משלם על פי עצמו

(d)

If he says that it gored Ploni's slave, he does not pay due to his admission;

זה הכלל כל המשלם יותר על מה שהזיק אינו משלם על פי עצמו:

The rule is, anyone who pays more than he damaged, he does not pay due to his admission.

(Gemara - R. Yitzchak) Question: Does one pay the [true] value of a slave [that his ox killed] through his admission?

מה צריכה ליה

Question: What is his question?

כל שלשים קנס או יותר מדמיו קנס [דף כג עמוד א]

Answer: [The 30 Shekalim that one pays for a slave -] is the entire 30 a fine, or [the true value is Mamon, and] the excess over his value is a fine?

אין תימר כל שלשים קנס אינו משלם אין תימר יותר מדמיו קנס משלם

If you will say that the entire 30 a fine, he does not pay. If you will say that the excess over his value is a fine, he pays [the value].

תמן תנינן המית שורך את עבדי והוא אומר לא המית משביעך אני ואמר אמן פטור

Answer (Mishnah): If Ploni said 'your ox killed my slave', and he says 'it did not kill', and Ploni said 'I impose a Shevu'ah on you', and he said Amen, [even if it really killed] he is exempt (for he need not pay through his admission, i.e. even the value)!

אמר רבי חגיי קומי רבי יוסי תיפתר שהמית עבד מוכה שחין

Suggestion (R. Chagai, to R. Yosi): We can say that it killed a leper slave (he is not worth anything. If so, this does not answer the question!)

אמר לו אמור דבתרה המית שורך את בני והוא אומר לא המית משביעך אני ואמר אמן חייב

Rejection (R. Yosi - Beraisa): If Ploni said 'your ox killed my son', and he says 'it did not kill', and Ploni said 'I impose a Shevu'ah on you', and he said Amen, he is liable;

ופתרה במוכה שחין ויהא פטור

[According to your suggestion,] we should establish [also the Beraisa] to discuss a leper, and he is exempt!

Note: Why should the Beraisa discuss the same case as the Mishnah? Perhaps it was known that the Beraisa was taught regarding the Mishnah, or the Reisha of the Beraisa taught just like the Mishnah.

אמר רבי חגיי קומי ר' יוסי תיפתר כמאן דאמר ונתן פדיון נפשו של מזיק

Question (R. Chagai, to R. Yosi): We can say that it is like the opinion that "v'Nasan Pidyon Nasho" (Kofer) is the damager's value. (He is liable even if the victim was not worth anything.)

אמר ליה ואין כמאן דמר ונתן פדיון נפשו של מזיק כולו קנס

Answer (R. Yosi): (You cannot.) According to the opinion that "v'Nasan Pidyon Nasho" (Kofer) is the damager's value, it is totally a fine (it does not depend on the amount of the damage. Why is he liable for a false Shevu'ah?!)

Question: [When one admits to a fine,] do we tell him "[you should] fulfill your obligation bi'Ydei Shamayim"?

נישמעינה מן הדא מעשה ברבן גמליאל שהפיל שן טבי עבדו אתא גבי דרבי יהושע אמר ליה טבי עבדי מצאתי עילה לשחררו

Answer (Beraisa): A case occurred in which R. Gamliel knocked out a tooth of his slave Tavi. He came to R. Yehoshua, and said "Tavi my slave, I found a justification to free him!"

אמר ליה ומה בידך ואין קנסות אלא בבית דין ובעדים

R. Yehoshua: You have no reason. Fines are only through witnesses and in Beis Din.

ויאמרו לו צא ידי שמים הדא אמרה שאין אומרים לו צא ידי שמים

Inference: [Why didn't] they tell him 'fulfill your obligation bi'Ydei Shamayim? This shows that we do not tell him "fulfill your obligation bi'Ydei Shamayim."

Question (R. Gamliel bei R. Avinah, to R. Mana): Does R. Gamliel hold like the opinion that one may free [an Eved Kena'ani? I.e. if he forbade, a Chiyuv bi'Ydei Shamayim would not override the Isur. We explained this like NO'AM YERUSHALMI]

אמר ליה כל גרמה אמרה שאסור לשחררו די לא כן היו לו לשחרר משעה ראשונה:

Answer (R. Mana): This teaches that he forbids. If not, he should have freed him earlier!
