SHELUCHIM WHO COULD NOT SAY THE PROPER DECLARATION (Yerushalmi Perek 2 Halachah 1 Daf 9a)

מתני' המביא גט ממדינת הים ואמר בפני נכתב אבל לא בפ"נ בפני נחתם אבל לא בפני נכתב בפני נכתב כולו ובפני נחתם חציו בפני נכתב חציו ובפני נחתם כולו פסול

(a)

(Mishnah): If a Shali'ach brought a Get from overseas, and he said 'in front of me it was written, but not signed', 'in front of me it was signed, but not written'; 'in front of me it was totally written, and half was signed'; or, 'in front of me it was totally signed, and half was written' - [in all of these cases,] it is Pasul;

אחד אומר בפני נכתב ואחד אומר בפני נחתם פסול

If one [Shali'ach] says 'it was written in front of me', and one says 'it was signed in front of me', it is Pasul;

שנים אומרי' בפנינו נכתב ואחד אומר בפני נחתם פסול

If two [Sheluchim] say 'it was written in front of us', and one says 'it was signed in front of me', it is Pasul;

ור' יהודה מכשיר

(d)

R. Yehudah says, it is valid.

אחד אומר בפני נכתב ושנים אומרים בפנינו נחתם כשר:

If one says 'it was written in front of me', and two say 'it was signed in front of us', it is valid.

גמ' ניחא בפני נכתב אבל לא בפני נחתם בפני נחתם אבל לא בפני נכתב כלום קיומו של גט אלא בחותמיו.

(Gemara) Question: Granted, when he says 'in front of me it was written, but not signed' [it is Pasul, because there was no Kiyum]. However, when he says 'in front of me it was signed, but not written', is not Kiyum through the signatures?! (We ask according to R. Yochanan, who says that the declaration is due to Kiyum - RIDVAZ.)

Answer: This is like R. Yehudah. R. Yehudah disqualifies Tofsim [written without the husband's command. Tofes is the standard text that is the same in all Gitin. In Mishnah 3:2, the first Tana is Machshir; R. Yehudah disqualifies, and R. Elazar disqualifies due to Lishmah. Even R. Yochanan, who holds that even Bnei Chutz la'Aretz know laws of Gitin, could agree that they do not know that R. Yehudah requires even the Tofes to be Lishmah.]

ודרבי יהודה בחוצה לארץ במגרש בארץ ישראל. ויש טופסי גיטין בחוצה לארץ במגרש בחוצה לארץ.

Question: Does R. Yehudah hold [that we are concerned for a Get that will be given] in Chutz la'Aretz only if he divorces in (i.e. from) Eretz Yisrael, but there is [a Heter to prepare] Tosfei Gitin in Chutz la'Aretz (to give it in the same Medinah, and no declaration is needed?! This is unreasonable! We explained this like ME'OR HA'SIMCHAH.)

עד שידע שהוא גט אשה. עד שידע שהוא נעשה שליח. ולא היה יודע שהוא גט אשה עד שיכתוב כולו בפניו עד שיתחתם כולו בפניו.

Answer: [The Shali'ach] must know that it is a Get Ishah, and he must know that he is made a Shali'ach. He knows [from the beginning] that it is a Get Ishah only if it is written totally in front of him and signed totally in front of him. (Then, he is meticulous to ensure that it is done properly. - RIDVAZ)

תני רבי חנין אם היה נכנס ויוצא מותר.

(j)

(R. Chanin): If [the Shali'ach] entered and left [while they were writing it], it is permitted (he may say the declaration).

ר' יוסי בעי אמר בפני נכתב ובפני נחתם אלא נתייחד ברשות הבעלים בין כתיבה לחתימה.

Question (R. Yosi): If he said b'Fanai Nechtav uv'Fanai Nechtam, but [the Get] was alone in the husband's house between the writing and the signing (are we concerned lest it was switched)?

נישמעינה מן הדא אחד אומר בפני נכתב ואחד אומר בפני נחתם פסול.

Answer: We learn from [our Mishnah]. If one says 'it was written in front of me', and one says 'it was signed in front of me', it is Pasul;

מפני שאחד אומר בפני נכתב ואחד אומר בפני נחתם. אבל אם אמר בפני נכתב ובפני נחתם אלא שנתייחד ברשות הבעלים בין כתיבה לחתימה כשר.

Inference: Because one says 'it was written in front of me', and one says 'it was signed in front of me', it is Pasul, but if [one] said b'Fanai Nechtav uv'Fanai Nechtam, but it was alone in the husband's house between the writing and the signing, it is Kosher! (If lack of supervision between writing and signing is enough to disqualify, the Mishnah should teach this, and automatically we know that it is Pasul if neither saw both the writing and signing!)

Question (Rav Chisda): If half is through the enactment, and half is mid'Oraisa, [what is the law? This will be explained.] (We explained this like HAGAHOS R. DINAR.)

Explanation (R. Elazar citing R. Avin): [Rav Chisda] asked [whether Kiyum can be half through the Shali'ach's declaration, i.e.] he said 'it was written in front of me, and one witness signed in front of me' and two [witnesses] testify about the [signature of] the other witness.

אמר רבי אמי בבליא [דף י עמוד א] אין כשר אלא זה.

Answer (R. Ami of Bavel): Only this is Kosher! (I.e. surely two witnesses about the second signature is even better than when the Shali'ach himself testifies about it);

ר' אבא לא אמר כך אלא אמר בפני נכתב ובפני נתחתם בעד אחד ואני הוא העד השני נעשה כנוגע בעדותו.

R. Aba said [that it is Pasul] only when he says 'it was written in front of me, and one witness signed in front of me, and I am the other witness', for it is as if his testimony affects him (he testifies about the other signature in order to sustain his signature).
