Dedicated by Harav Avraham Feldman of Yerushalayim, Dr. Yehoshua Daniel of Efrat, and Rabbis Eliezer and Zalman Stern of New York, who merited to study under the Rosh Yeshiva zt"l in Yerushalayim.

THE DIALOGUE BETWEEN R. MEIR AND CHACHAMIM (Yerushalmi Perek 9 Halachah 1 Daf 56b)

ר''מ אומר אין אתם מודין לי בכלים ששבתו בחצר שמטלטלין אותן בחצר מה נשתנה גג מחצר

R. Meir says, do you not agree to me about Kelim that were Shoves in the Chatzer, that one may carry them in the Chatzer? Why is a roof unlike a Chatzer?

אמרו לו לא אם אמרת בחצר שאין לה דיורין למטה תאמר בגג שיש לו דיורין למטה.

Chachamim: No - if you will say [that one may carry in the Chatzer Kelim that were Shoves] in the Chatzer, which does not have residents below, will you say so about a roof [which has residents below? Just like the residents divide below, they divide above!]

אמר להן הרי שהיתה החצר למעלה מן הגג מהו

R. Meir: If the Chatzer was above the roof, what is the law? (You permit carrying in the Chatzer, even though there are residents below!)

אמרו לו לא אם אמרת בחצר שאין כל אחד מכיר את מקומו תאמר בגג שכל אחד מכיר את מקומו.

Chachamim: No - if you will say [that one may carry] in the Chatzer, where everyone does not recognize his [private] place, will you say so about a roof, where everyone recognizes his place (above his Dirah)?!

אמר להן הרי שהיתה החצר חלוקה בפסיסיות מהו

R. Meir: If the Chatzer was divided through planks [so everyone recognizes his place], what is the law?

עד כאן היתה תשובה.

Until here was an answer [to R. Meir's question, but they did not answer this].

א''ר יוסי בי רבי בון מיכן והילך היו משיבין לפניו אמרו לו לא אם אמרת בחצר שמחיצותיה עולות עמה תאמר בגג שאין מחיצותיו עולות עמו.

(R. Yosi bei R. Bun): [Also] from here and onwards, they answered him! They told him no - if you will say [that one may carry] in the Chatzer, where the walls rise [recognizably], will you say so about a roof, where the walls do not rise [recognizably? It is not evident where is above each Dirah.]

והוא מימר לון אף אנא אית לי עמוק כגובה.
