TOSFOS DH Meisivei Delet ha'Nigreres

(SUMMARY: Tosfos points out another question that we could have asked.)

(a)

Observation: Without this, we could have asked [a contradiction between] the Reisha to the Seifa, for [the Reisha] calls it dragging (on the ground), and [the Seifa] calls it "high above the ground', and we could have said "ul'Taimech (also for you it is difficult)"!

2)

TOSFOS DH Delet Almanah ha'Nigreres Ein No'alin Bah

(SUMMARY: Tosfos explains that it has a hinge pin.)

(a)

Explanation (Ri): We discuss when they have a hinge pin (on which the door swings). If not, why do we discuss Delet Almanah? Also another door (one may not use it to close the opening)!

3)

TOSFOS DH v'Chen Bei'asa

(SUMMARY: Tosfos discusses in which case this is forbidden.)

(a)

Explanation #1 (Rashi): He arranges eggs on an iron Kli called Gardil in old French (grill).

(b)

Objection (Ri): This is not the way of Binyan! All the Mechitzos are already made. This is unlike a barrel or bed, in which he arranges one [Mechitzah] next to another.

(c)

Support (for objection): There is a widespread Heter to place a pot on a tripod [on Yom Tov. No one forbids due to Binyan for Machshirei Ochel Nefesh!]

(d)

Explanation #2 (Ri): He arranges wood or eggs, and puts an egg on top of them.

(e)

Implied question: We arrange a loaf here, a loaf here and a loaf on top of them, or similarly with a Sefer!

(f)

Answer #1: It is forbidden only when he needs the air underneath them.

(g)

Answer #2: It resembles Binyan only when he does so on land, but not on a table.

TOSFOS DH Mevi Mafte'ach u'Meni'ach b'Iskufa

(SUMMARY: Tosfos explains like Rashi concluded.)

(a)

Explanation #1 (Rashi): From here we deduce that R. Meir retracted from [his stringency about] garden gates, and he does not decree about one who stands in Reshus ha'Rabim, that he may not move [items in a Karmelis];

1.

Source: The porch is a Karmelis like we say below.

(b)

Rebuttal (Ri): We cannot prove from here [that he retracted]. We can establish that tomorrow he opens and closes, e.g. when he stands on the porch.

(c)

Support (of Rebuttal): We must explain like this, for if he stands in Reshus ha'Rabim, why does it say "and similarly", which connotes that it is like the case of garden gates [that we permit]?

(d)

Explanation #2 (Ri, and Rashi's rectification): It is proven from the Seifa that R. Meir retracted from [his stringency about] garden gates. It teaches that above 10, he places [the key] in the lock, and tomorrow he opens and locks;

1.

Even if he stands on the porch, this is from a Karmelis to Reshus ha'Yachid;

2.

You are forced to say that the porch is a Karmelis, for if it is Mekom Petur, why does he need to place the key in the lock? He should leave it on the porch!

5)

TOSFOS DH mideka'Amar v'Chen Chanuyos mi'Chlal dib'Iskufa Karmelis

(SUMMARY: Tosfos explains the inference.)

(a)

Explanation: "And similarly" connotes that it is like the case of garden gates [that we permit]. If the porch were Reshus ha'Yachid, if so he transfers from Reshus ha'Yachid to Karmelis!

1.

Similarly, if [the porch] were Reshus ha'Rabim, he would transfer from Reshus ha'Yachid to Karmelis, and it is unlike garden gates, which we forbid in such a case.

6)

TOSFOS DH Ein Chokekin

(SUMMARY: Tosfos explains that therefore, the lock is Mekom Petur.)

(a)

Explanation: [We do not say Chokekin,] and it is Mekom Petur.

(b)

Implied question: Why does it say "he leaves it on the porch"? (Since the lock is Mekom Petur, he could leave the key in Reshus ha'Rabim!)

(c)

Answer: [Indeed,] the same applies (he may leave it) in Reshus ha'Rabim, but normally it is not guarded on the ground. Therefore, [the Beraisa] did not say so.

7)

TOSFOS DH R. Yosi Omer Isur Nahagu Bo v'Hitiru Lahem

(SUMMARY: Tosfos explains why he was allowed to permit them.)

(a)

Question: It says in Nedarim (81a) and Pesachim (51a) that if something is permitted, and some people's custom is to forbid, you may not permit it in front of them!

(b)

Answer: That is when they know that it is permitted, and they are stringent on themselves lest people get used to being lenient, and they will come to permit Isur;

1.

However, if they are stringent due to a mistake, you may permit it in front of them.

8)

TOSFOS DH Ki Pligi beshe'Ein Nital b'Igudo

(SUMMARY: Tosfos discusses when we permit a bolt.)

(a)

Explanation (Ri): Only here it is permitted, because there is a ball at the end (which can be used to crush peppers, so it is considered a Kli);

1.

If there is no ball at the end, [R. Yosi] agrees that it is forbidden, even if it is tied to the door. He holds like Rabanan of R. Yehudah regarding a bolt that drags [on the ground - they forbid it below (102a)].

2.

Alternatively, [R. Yosi] holds like R. Yehudah, who permits [a bolt] that drags. Here we discuss what is tied to the bolt. R. Yehudah agrees [that it is forbidden] when it cannot be taken through the rope attached to it, like is proven below;

i.

This is why he requires in our Mishnah that it has a ball at its end.
