ERUVIN 96-100 - Dedicated in memory of Max (Meir Menachem ben Shlomo ha'Levi) Turkel, by his children Eddie and Lawrence and his wife Jean Turkel/Rafalowicz. Max was a warm and loving husband and father and is missed dearly by his family and friends. His Yahrzeit is 5 Teves.

TOSFOS DH v'Chen b'Keren Zavis

תוספות ד"ה וכן בקרן זוית

(SUMMARY: Tosfos explains why two cases were taught.)

פי' בקונטרס שג' צדדיו נכנסין תוך המקצוע ואין נראה מבחוץ אלא צד רביעי

Explanation #1 (Rashi): Three sides enter the corner [of where two walls of the Chatzer meet], and only the fourth side is seen from outside.

ואיצטריך למימר תרוייהו קרן זוית להודיעך כחו דרב ששת ונגר דמשני צדדיו להודיעך כחו דרבה דשרי

Both of them needed to be taught. A corner teaches the extremity of Rav Sheshes, and an irrigation channel, which is [seen] from two sides, teaches the extremity of Rabah, who permits.

ומיהו מודה רבה בסמוך לכותל שאינו שוה לארץ אלא מצד אחד דאסור

However, Rabah agrees when it is near a wall, that it is even with the ground only from one side, that it is forbidden.

והא דנקט ברייתא בסמוך וצדו אחד שוה לארץ לא תקשי לרב ששת

(b)

Implied question: The Beraisa below says that one side is even with the ground. This is difficult for Rav Sheshes [who forbids even when two sides are even with the ground]!

דלדידיה לאו דוקא נקט צדו אחד דהוא הדין משני צדדין

(c)

Answer: He holds that "one" is not precise. The same applies when two sides are even.

TOSFOS DH Matan Dalet b'Matan Achas

תוספות ד"ה מתן ד' במתן אחת

(SUMMARY: Tosfos explains that the former needs two Matanos that are like four.)

פי' עולה שהיא מתן שתים שהן ד' בבכור או בפסח

(a)

Example: [Blood of] an Olah is put twice [on opposite corners of the Mizbe'ach,] which is four (the blood goes on all four sides. It was mixed with blood of) Bechor or Pesach (which is put only once).

אבל אין לפרש מתן ד' היינו חטאת

(b)

Suggestion: "[A Korban whose blood] is put four times" refers to Chatas (its blood is truly put four times, once on each corner)!

דאם נתערבה מתן חטאת בפסח או בבכור אין להם תקנה לפי שזה למעלה מחוט הסיקרא וזה למטה

(c)

Rejection: If [blood of] Chatas became mixed with [blood of] Pesach or Bechor, there is no solution, for [Chatas] must be put above Chut ha'Sikra (a divider at half the height of the Mizbe'ach), and the other must be put below.

וא''ת וליתי עשה ולידחי לאו דבל תוסיף

(d)

Question: The Aseh (to put the blood in the proper place) should override the Lav of Bal Tosif!

וי''ל דלא דמי כלל לכלאים בציצית דהכא ע''י פשיעה הוא בא והיה יכול להתקיים בלא דחיית הלאו

(e)

Answer: This does not resemble at all Sha'atnez in Tzitzis (from which we learn that Aseh Docheh Lo Sa'aseh). Here (the need to transgress in order to do the Aseh) came through negligence. [Had they not become mixed, the Aseh] could have been fulfilled without overriding the Lav!

TOSFOS DH Yinasnu b'Matanah Achas

תוספות ד"ה ינתנו במתנה אחת

(SUMMARY: Tosfos explains that this suffices to be Machshir the Korban.)

דקיימא לן כל הניתנין שנתנו במתנה אחת כפר:

(a)

Explanation: We hold that any [blood] that must be put [on the outer Mizbe'ach], if it was put once, (he fulfilled his obligation and the Korban) atoned.

TOSFOS DH Lo Kashya Ha b'Lachim Ha b'Yeveshim

תוספות ד"ה לא קשיא הא בלחים הא ביבשים

(SUMMARY: Tosfos explains why we do not permit dry trees.)

וא''ת והא לעיל אסרינן ביבש דפריך והא נתרי קינסי כו'

Question: Above we forbid dry, for it asks "twigs will fall off...!"

וי''ל דבאילן שהוא גבוה שייך למגזר טפי משום דמינכר ביה ניתרי קינסי

(b)

Answer: In a tree, which is tall, it is more appropriate to decree, for it is evident in it [when] twigs fall off.

TOSFOS DH v'Ha'idna d'Kaima Lan k'R. Shimon Kulhu Shari

תוספות ד"ה והאידנא דקי''ל כר''ש כולהו שרי

(SUMMARY: Tosfos explains that we cannot deduce a Heter for trees.)

פי' ר''ח דהאי היתר לא קאי אלא אעשבים דשרי בכל ענין אבל באילן אין להוכיח מכאו (כן נראה להגיה, וכן הוא בתוספות הרא"ש) שום היתר אפילו יבש דשייך למיגזר טפי משום דמנכרא מילתא:

Explanation (R. Chananel): This Heter is only for grass. It is permitted in every case. However, one cannot prove from here any Heter for a tree, even if it is dry, because there is more reason to decree, because it is evident.
